Owner says smoking ban hurt the business

Rick Naylor, owner of Jimmy Mac's restaurant and bar on Elmwood Avenue, was fined $2,000 by Erie County.

A restaurant that has openly defied the state's smoking ban is now for sale.

Owner Rick Naylon is asking $125,000 for Jimmy Mac's, a restaurant with a bar at 555 Elmwood Ave. E.K. Henderson Assoc., a company in which Naylon has a minority ownership interest, would retain ownership of the building. The restaurant's equipment and other assets are for sale.

"Jimmy Mac's is for sale," Naylon said. "But because of all the pending legal actions, I'm really not in a position to discuss the sale at any length."

On Monday, the five-judge Appellate Division of State Supreme Court in Rochester postponed a decision on Erie County's appeal of a State Supreme Court ruling that granted Naylon a six-month waiver on the state's Clean Indoor Air Act.

The county also fined Naylon $2,000 for violating the smoking ban.

Naylon has said that the smoking ban has hurt his business and made it difficult to keep the restaurant open. With smoking not allowed, drink sales have plummeted.

Jimmy Mac's has been a fixture on the Elmwood strip for the last 23 years.

In 1981, Naylon and his partner, Jim McLaughlin, bought the Shamrock bar. They opened a restaurant with a bar named after McLaughlin, who left the business after the first year. In its fight against the smoking ban, Jimmy Mac's had patrons sign a slip acknowledging that they are violating the state law and then took no action to stop customers from lighting up.

"Unfortunately, smoking tobacco indoors in NYS is Illegal," the slips stated. "By law, we have to inform you of this law. If you decide to break the law, there is no fine or penalty for the smoker. Please sign below to indicate that we have informed you of this law."

Naylon said his business increased by $25,000 from the previous month when smoking returned to the restaurant.

He signed a bill yesterday outlawing the 50 cal in Ca. and he has a couple more on his desk waiting for signature. One requiring fingerprints for any ammo purchase in Ca and the other outlawing gun shows (I believe at the cow palace but I may be wrong on the location).

Sam Hoyt and Byron Brown both won their primaries.
We need to vote out all the incumbants.
I'll be voting for Dave Penna and with not much enthusiam Al Cappolla.

Sometimes I really wished I had stayed in the race for assembly.
I would have my face all over the papers, tv, radio saying that these incumbents did this to us...

What is with these people I don't know. They are destroying the hospitality industry nation wide. They don't like the smell of cigarette smoke. So they send their loony goons after us. They are only hurting people. They are helping no one. They have another catch phrase Which I saw on TV tonight. They said "second hand smoke, you are either on the doctor's side or on the tobacco company's side." From experience, I know the majority of doctors can't read data or know squat about statistics or sound methodology. I am on the side of the tobacco companies. Why the liberals want prohibition I do not know..

In my neighborhood here on Long Island, at least THREE places have closed in the last six months (two pubs and one straight up bar).

They remain vacant, with soaped-up windows. All three had been long-time establishments -- one of them was in business as long as I can remember.

This entire anti-smoking era/campaign smacks of underhanded backdoor manipulation.

Economics over social control was once the rule.

I guess that was before the mistakes Hitler made were solved concerning anti-smoking laws.

This is really bad news. I don't know how many bars are going to have to close before people start figuring this out. Probably all of them, and these morons still won't care.

I will miss NY when I move from here someday, but not it's politics or the stupid sheep which populate this once-great State!!!
