You won't see out-in-the-open Borking. The chairman has influence over who gets sent to the committee in the first place, so good people will get shot down before they're ever formally nominated. It will be all very quiet and efficient. We'll end up with more O'Connors and Kennedys, and most conservatives won't even know what happened.

Lots of people will be ready for a third party if Specter gets in. This is as obvious a case as any for them to forego "seniority" boy's club stuff and put the RIGHT man in the Chairmanship.
There are no excuses on this one.

Senator
Arlen Specter to serve as Chairman of the Senate Judiciary Committee in
the
109th Congress. I appreciate your concerns and value the opportunity
to
respond.
As you know, the United States Senate plays an important role in
confirming Presidential appointments, particularly to the federal
courts.
For over 200 years individual Senators have taken a stand for or
against
each judicial nominee. Unfortunately, in recent years, partisan
politics
have corrupted the process and a small group of Senators have held up
many
of President Bushâs exceptional nominees.
By blocking judges to the federal bench, we are inhibiting the
rights
of Americans to have their cases heard in a fair and timely manner and
it
only exacerbates the already high vacancy level of the judicial
vacancies
on the federal bench. In fact, Chief Justice Rehnquist has warned that
the
vacancy level, coupled with the rising caseload, threatens the proper
functioning of the federal courts. Thus, the shortages of judges
delays
justice for victims of crime in America, and justice delayed is justice
denied.
Today, some Senators are turning our judicial process into a political
battlefield over politics and ideology. The fundamental principle for
picking a federal judge should be their commitment and ability to
administer the law fairly. I believe this years election results
re-affirm
my belief that we need federal judges who put the law before personal
philosophy, ideology, or politics. A judicial nomineeâs
qualifications
should matter most and those qualifications should be the sole criteria
for
approving or blocking a nomination.
We must end the impasse on judicial nominations. This nation has
many issues that need the attention of our lawmakers and our President,
such as improving education, healthcare and economic and job growth.
No
Senator should feel forced to vote for a nominee to the benchâbut
they
should at least allow a fair vote. I have every expectation that my
fellow
Republicans will honor their commitment to allow the Presidentâs
nominees
to be fairly considered for an appointment to the federal courts.

will

I am consistently bewildered by the strange fixation both sides hold for the Roe decision.
The liberals consider it the holy grail (or at the very least, a holy grail). Even if overturned, it does not make abortion illegal in the union. The decison would be left up to the states - frankly, I don't think the landscape would change much if it was left up to the states.
The conservatives consider it one of the main problems in our culture. But even if overturned (which I support because its such a bad decision legally), it would not make abortion illegal in the union. It's an odd lighting rod, it seems. Roe or not, I don't see any changes in the bottom line, abortion-wise.

That's because it is. It legalized infanticide, and it did so by an act of "raw judicial power" -- so it was ethically monstrous and, legally, an act of judicial tyranny.

You are right. Many if not most states would outlaw abortion including PA. If memory serves me two of the states that went farthest in trying to limit abortion in the 1980's was PA and MO. Were they not landmark cases since Roe?

I don't know. I do know that one reason pro-aborts took this all the way to the Constitutional level was because they also knew that if the states were allowed to vote for themselves, most would vote to prohibit it.
