What a nice card.

I've said it for a long time, we're slipping towards a dictatorship of judges, with judges getting away with outrageous decisions.

As to your questions regarding Judges Greer and Baird's qualifiations, the Department is unaware of any deficiencies in their filings.

It's not like me to make this type of comment... but,
WHat a Dimwit!!

This person can't read the statutes with the filing requirements and determine that these filings weren't in the proper time frame?

This is insane! But it's par for the course!

How many judges does it take to screw in a lightbulb?

None, if they're from the Florida 6th circuit! They can do it by telepathy months before one is actually needed!

It's obvious that this needs to be dealt with higher up. I for one believe that we need to go straight to the Florida House of Representatives for impeachment. The House is responsible for initiating impeachments. If the judges and their overseers are "not" going to fulfill their duties we need to call them on the mat.

It would be easy enough to draft a letter, email to contacts and post on the web so people could print and mail it themselves. We mustered enough support via mail and phone calls to get Terri's Law accomplished and we can do it again. It's fairly obvious that petitions are worth nothing. We have to make personal contact to get the job done.

Florida Constitution Impeachment Provision

SECTION 17. Impeachment.--

(a) The governor, lieutenant governor, members of the cabinet, justices of the supreme court, judges of district courts of appeal, judges of circuit courts, and judges of county courts shall be liable to impeachment for misdemeanor in office. The house of representatives by two-thirds vote shall have the power to impeach an officer. The speaker of the house of representatives shall have power at any time to appoint a committee to investigate charges against any officer subject to impeachment.

(b) An officer impeached by the house of representatives shall be disqualified from performing any official duties until acquitted by the senate, and, unless impeached, the governor may by appointment fill the office until completion of the trial.

(c) All impeachments by the house of representatives shall be tried by the senate. The chief justice of the supreme court, or another justice designated by the chief justice, shall preside at the trial, except in a trial of the chief justice, in which case the governor shall preside. The senate shall determine the time for the trial of any impeachment and may sit for the trial whether the house of representatives be in session or not. The time fixed for trial shall not be more than six months after the impeachment. During an impeachment trial senators shall be upon their oath or affirmation. No officer shall be convicted without the concurrence of two-thirds of the members of the senate present. Judgment of conviction in cases of impeachment shall remove the offender from office and, in the discretion of the senate, may include disqualification to hold any office of honor, trust or profit. Conviction or acquittal shall not affect the civil or criminal responsibility of the officer.

History.--Am. S.J.R. 459, 1987; adopted 1988; Am. proposed by Constitution Revision Commission, Revision No. 13, 1998, filed with the Secretary of State May 5, 1998; adopted 1998.

I was writing a next course of action post to you and crashed again. I am no longer with that server. They wouldn't let me cancel so I called my cr card and if they try to bill me again, it is definitely in dispute.

I wish I could remember what I posted but I've been on the phone with India.

Our leaders at www.myflorida.com love to get emails and calls from Terri supporters. All info on House & Senate is at that url.

Embarass the house and senate and also the Judicial Qualifications Commission and the Florida Elections Commission. That's a fine way to start much needed change.

How to embarass them? Not quite sure but maybe some freepers can help me think of ways. Doing the right thing won't move these bureaucrats. Only shame works here in the south if collective guilt seeps into our society down here. I'm afraid following the rules is not something they care about.

Any ideas, freepers?????

They need to help us and they should also visit www.theempirejournal.com and also www.worldnetdaily.com for Terri investigative reports and WND has a considerable archive that portray Terri as the lovely human being she is!

I must re-read this stuff.

I think Jeb must be notified. I wonder if his lawyers can work any of this new info into the US Supreme Court brief. Maybe the Bush family members would be willing to listen to FReepers, since it was a FReeper who broke Dan Rather's Memogate.

How can someone declare a law to be unconstitutional, when legally, he isn't even a judge?

As I've said before, I only wish I were a lawyer.

You don't need to wish that you were a lawyer, Lauren BaRecall. Many fine ones have pushed the rock up the hill for Terri just to hit solid concrete.

Being a lawyer only helps if that lawyer becomes a judge and defeats these horrible judges one at a time or they finally GET BUSTED which is on my Christmas List.

I can tell you for a fact that free republic helped Jeb get re-elected and he did thank the hundreds of freepers who went the extra mile for him. We hope he's going to go the extra mile for Terri and all it takes to contact Jeb Bush is to email: jeb.bush@myflorida.com. (Terri in the subject line as per their specs).

LOL, I needed to laugh just now! TY!

I hoped my attempt at humor would add levity without being seen as derisive. I keep praying for some good news, but for some reason the evil men aren't being held accountable for their actions.

I do find the recent comments about qualification interesting. I wonder what would happen if Jeb Bush were to issue an executive order directing that because Judge Greer was not legally qualified for office his rulings were to be ignored. Not saying that would be a wise move, but I'm curious what would happen. Even if there isn't a 2/3 supermajority in the legislature to impeach Greer, I doubt that there would be a 2/3 supermajority to impeach Bush either.

BTW, I'm surprised that you didn't comment that tomatoes and cubumbers are really fruits. Though since the show does also have an asparagus whose name I don't remember, I think it fair to say that it does depict some talking and singing characters who are, in fact, vegetables.

I've never actually watched Veggie Tales myself, but have nieces and nephews who have sung me songs, and told me about them. I still don't get that whole "tomatoes are a fruit not a vegetable" thing. And "cubumbers" are even better than cucumbers!

I would love to see Jeb just remove Greer from the bench. I thought I read that he could do such a thing, but I'm probably mistaken. My memory isn't working as well tonight as I'd like for it to. Busy, busy day!

The distinction between "fruits" and "vegetables" has to do not with the plants itself, but rather with the portion of the plant that is eaten. The fruit of a plant is the portion that contains the seeds. For some plants, such as cucumbers or tomatoes, that is the part that is commonly eaten. For other plants, such as celery or lettuce, one normally eats stalks or leaves. Not sure exactly how beans and grains fit into things.

I would love to see Jeb just remove Greer from the bench. I thought I read that he could do such a thing, but I'm probably mistaken. My memory isn't working as well tonight as I'd like for it to. Busy, busy day!

I don't know that Jeb would have any authority to do that; the thing I wonder about is to what extent, push come to shove, Greer really has authority over him.

Hmmmm. Greer having authority over Jeb. Now that's food for thought. I'm not enjoying contemplating that one.

BTW, that was the best explanation for the fruits vs. vegetables idea that I've ever heard.

I have finally received a response from D.H. Penton, assistant general counsel at the State of Florida, Department of State, regarding Judge Greer and Judge Baird failing to qualify for election.

Department of State should be under the Executive Branch, no? Then he (or she) would not be part of the judiciary, and Jeb would be his (or her) boss. It sounds like Penton is the "Freedom of Information Officer." It may be an additional title, or just one of his (or her?) functions.

There are other people involved with the foul up, such as (perhaps) County Clerk's office or a "Board of Elections." A county Board of Elections would be under a state Board of Elections. Where are candidates papers originally filed? Board of Elections? Is the BOE under the Executive branch, or the Legislative?

I'm just throwing this stuff out, because if all roads lead to Jeb Bush, then he is the top man to focus upon concerning our communications. I may be wrong, but maybe we can save time and energy by presenting the evidence to Jeb Bush that Greer and Baird aren't judges, rather than going down the road towards impeachment (at least just yet).

I understand that there are those who want to undercut election elegibility and oaths laws as mere "legal technicalities," but the law is the law.

Any ideas out of this mish-mosh?

BTW, a good records search is based upon 2 basic things: 1. the existence of the records in question, and 2. the knowledge, ability, and the dedication of the staff member doing the search.

If you are convinced that the staff member didn't find everything, ask a second time for another search to be done by a staff member with a higher title. (Hot tip of the day!) That's how I obtained a Death Certificate in another state.

Scoop 1, from what I know about governments in general, Penton may comply with your request for her to start the ball rolling towards an investigation, but down in Florida, who is politically in bed with whom? Aw, shucks, it's also the Christmas season, and state employees are putting up the decorations in their offices (not that I begrudge them this - just note the excuse for foot dragging). Or maybe Penton will put your request at the bottom of her "in box." Everyone in government knows how to foot drag. (LOL!)

I'm not suggesting you drop this path, because at the very least, your efforts with Penton will serve as additional documentation.

What I want to suggest is that (IMO) this FReeper Operation needs another route - the equivalent of the good old fashioned phone call to a friend in high places with PULL, who knows how to really get things done. Someone("s") proven friendly to Terri's cause, who can be contacted directly, who knows what to do with this information, must see it as soon as possible

If it can be established quickly with FL government that Greer and Baird are not judges, this would render every single decision they ever made null and void, let alone make Terri's Law a moot point vis a vis a US Supreme Court review (at least directly concerning Terri's life). Remember that the SCOTUS has not yet accepted the Terri's Law case, and we really can't count on them to do so.

(Disclaimer: remember that I'm not a lawyer, so all my legal statements should be checked out by someone qualified.)

As far as I know, the following cases are still open:

1. Terri's Law in the SCOTUS.
2. Terri's religious rights in view of the Pope's statements - appeals court.
3. Greer is still sitting on the Guardianship case.

If Greer is thrown out, that may have a tremendous impact on the Guardianship case, and the other 2 cases, could be pursued on behalf of others in danger of euthanasia. The thing I think that has huge importance is that the lawyers involved with any of the 3 cases potentially can use this damning information to great effect.

Getting back to friends to be contacted (who I thought of):

1. Jeb Bush and his lawyers.
2. Jay Sekulow/American Center for Law and Justice. They have been involved with Terri's Law in the courts. This is the results page at their website for keyword "Terri Schiavo:" http://www.aclj.org/Search.aspx?sc=Terri+Schiavo&SEARCH.x=29&SEARCH.y=10 One way of contacting Mr. Seculow directly is through his live weekday radio show, Jay Seculow Live.

3. Virginia Delegate Bob Marshall, who made sure the feeding tube went back into Terri, after Terri's Law was passed. Delegate Robert G. Marshall. Floriduh voter, I'm under the impression that you know how he can be directly contacted???

What does everyone think? Opinions, additions, ideas?

We;ve already established "quickly" with the actual documents in hand that Greet and Baird did not legally qualify for office.

I apologize for not being clear. I meant to indicate a sense of widespread knowledge of these facts within all 3 branches of Florida government.

I am more than willing to defer to your expertise, however, I am in a position to know a bit about government and politicians, and I offered my knowledge, and associated thoughts, in an effort to help out.

On October 21, 2003, the freeper relay team went into action for the freepers across from Hospice. When word finally reached Bob Marshall, our urgent call for help went through some powerful people in the midwest. We didn't know this until a couple of days later that Bob Marshall was even key in demanding Morton Plant Hospital admit Terri to save her life.

Those freepers knew we were stuck at the vigil and they really outdid themselves.

Bob Marshall does have an email address but I don't have it handy.

I've called what I thought was his phone number before but always got an answering machine so I don't know if I was actually calling him or not.

When Judges retire or resign, it's my recollection that the Governor can appoint Circuit Court Judges. Those interested in the position also need to apply to the Judicial Qualifications Commission, essentially they need to nominate themselves.

Judge Susan Schaefer is retiring due to illness. That's another vacancy right there.

Fla Criminal Statute 825 has been violated by judges, doctors and some lawyers in the battle against Terri. You won't see that in the mainstream media.

"What do you think of sending it to Greta?"

There's also Sean Hannity. He's shown great concern about Terri's situation and has had her parents on his TV show, and I think his radio program as well.

IMHO, even better will be to deluge Judicial Watch's Florida office with your statements about these issues and legal concerns. They're at:

Judicial Watch, Inc.
Southern Regional Headquarters
100 S.E. 2nd Street
Bank of America Tower, Ste. 3920
Miami, FL 33131-2148
Tel: 305-349-2391
Fax: 305-374-9054
e-mail: info@judicialwatch.org.

There's also Florida attorney Jack Thompson who, before 10/2003, submitted a legal commentary in favor of saving Terri's life.

The evidence Scoop1 has acquired from D.H. Penton/FL Dept. of State is meaty and the necessary platform to initiate a wave of FL citizen and legal community complaints.

The A&E Network finally aired their program about Terri yesterday. It "premiered" with a showing between 5 and 6 p.m. EST (up against pro football and college basketball), and no "pre-publicity" for it (at least none that I saw).

I didn't see it, just learned about it from a friend who has her television tuned to A&E 24/7, who watched it.
