I thought that Freepers might be interested in this ongoing issue not only because it's interesting in and of itself, but because it is reminiscent of some of the hassles that Free Republic has been subjected to.

Damned if I can understand how linking can be illegal. It is no different than citing an article in a footnote. You still have to go to their website for the content.

But then the Law has always been An Ass.

I think a real test in the courts would fail. Web sites are CREATED to give people access to their material. If anything, you are ASSISTING them and increasing their hits.

And as for the articles themselves, just do what FR does and excerpt them according to 'fair use' rules.

Basically you can't sue someone (and win) for using what you put out for public use.

It isn't. If he puts the URL to the paper's homepage on his site, there isn't thing one the paper can do about it. If he has an embedded link to the same URL on his website, I still don't think there is anything they can do. The letter calls it "inappropriate linking". What the hell is that? If has a link to a specific article or content or...he has a logo for the paper that is itself an embedded link...then...maybe.

Just because some shyster lawyer says it is a violation of the law doesn't mean it is. As I see it, copyright laws cover reproduction of protected content on another website not associated with the copyright holder....not linking to URLs.

He can't QUOTE the paper? are they telling their readers they have to keep silent about anything they read in their paper? ( I would like to tell you about something I read the other day BUT It's against the law for me to do so.

As a Tulsa native (moved to OKC in Sept.) let me just chime in...We all know the Tulsa World is slanted (if not downright capsized) to the left side. Good for you for calling them on the carpet.

I don't think they have a leg to stand on in the "linking to their site" charge. OK bump.

There was a blogger, do not recall the name, who sent them a nice letter....basically telling them to "SHOVE IT!"

The blogger informed them that they no nothing of the law and unless the note was on a lawyer's letterhead, their letter would be ignored.
