Sure, and if the law has unintended moral consequences the proper remedy is to change it through legislation (rather then the judiciary). Often this happens with an anecdotal case that grabs the publics intention such as the current one.

The only constitutional question in this case is whether this is the right legislature. More properly the state should have jurisdiction over such particulars (such as having alleged "guardians" held to some common sense minimum standards to maintain their legal guardianship) ...however in this case the Federal legislature has the enumerated constitutional power to define the jurisdiction of the federal judiciary, which they did not seem to step beyond. I don't see any dangerous "precedence" here. Heck, from a constructionist stand point I wish congress would exercise this power more often (such as limiting the federal judiciary from ruling on terrorist's appeals for habeas corpus).

The 14th Amendment explicitly gives Congress the power to pass all legislation necessary to prevent states from violating or failing to protect people's rights.

I think that's what the did in a narrow case here, the broader case, the house approach, will be debated later.

Further, they could make the law exempt from judicial review by placing it outside the jurisdiction of any court, as the constitution allows Congress to do.

I wasn't aware this was possible. Can't any law be challenged?

I should also thank the democrats who supported the bill. I do so now. I'm also saddened that the general public seems to be so incensed and by the delays.

I know legal procedures have to be followed. But sometimes saving a life should trump wasting all this time in the courts imo.

Another problem I don't have a good answer for.

Does anyone know how to listen to view of tape of Terri and her father? I keep hearing about it but can't find it. Why isnt' it out there for all to see? Some people need to have proof and maybe this would make their decisions.
