Money for Terri Went to Attorneys, Michael

According to the Associated Press, Michael Schiavo sued medical professionals who he said failed to recognize symptoms that caused his wife's heart to stop beating, causing her brain damage. As a result, he won a $1.2 million settlement. At the time, Michael sought the funds with the promise to use the money for Terri Schiavo's care and rehabilitation. As part of the settlement, Michael Schiavo received $300,000, the rest being earmarked for Terri's care and rehabilitation. His attorneys say today most of the money designated for Terri is gone, spent on her care and legal bills. One of his lawyers, Deborah Bushnell, told the AP that more than half of the $700,000 designated from the malpractice award for Terri's care has been spent for that purpose, with the rest going toward litigation. But that statement is at odds with records that show that lawyers - not medical care - ate up most of the expenditures and have been paid directly from Terri's Medical Trust fund, with the approval of Judge George Greer: Here’s where most of the money went:

Atty. Gwyneth Stanley - $10,668.05 Atty. Deborah Bushnell - $65,607.00 Atty. Steve Nilson - $7,404.95 Atty. Pacarek - $1,500.00 Atty. Richard Pearse (GAL) - $4,511.95 Atty. George Felos - $397,249.99 Other - 1st Union/South Trust Bank – $55,459.85 Michael Schiavo - $10,929.95 Total: $545,852.34

These funds, the result of a malpractice suit, were meant solely to provide for Terri Schiavo’s care and rehabilitation, not to pay lawyers to help Michael Schiavo kill his wife. Schiavo’s primary attorney, George Felos, a professional advocate of mercy killing, has received upwards of $400,000 dollars since Schiavo hired him. This same attorney, at the expense of Terri’s medical fund, publicly likened Terri to a "houseplant" and has used Terri’s case on national television to promote his newly published book.

what I'm trying to say is that the money is being charged by the lawyer's only to funnel into a poll that other guardians have pooled. The money is invested bringing great profits, which are kept by lawyers, some judges, and the guardians. It's a way family members to hide large sums of money from the Gov. ie have Medicare Medicaid to foot the bill so the guardian can keep it when so called incompetent person dies.

Well .. while you're pointing fingers at our "leaders" - remember there are 3 other fingers pointing directly back to us.

We have sat back in our comfortable homes or hit the beach - totally oblivious to what the liberals were creating around us .. ELECTING CIRCUIT COURT JUDGES like Greer - just because nobody could be bothered to find out what kind of person he really was.

Florida has a real mess on their hands - and where I live - it's the same. My mom and I are both going to have documents filed with the state so some angry family member cannot FORCE US TO BE STARVED TO DEATH .. because elder abuse is on the rise in my state.

America is a government OF THE PEOPLE - BY THE PEOPLE - FOR THE PEOPLE - I believe WE have abdicated OUR RESPONSIBILITY as the PEOPLE. We must be more involved in political issues and we MUST STOP ELECTING PEOPLE WHO DO NOT HAVE AMERICA's BEST INTERESTS AT HEART.

We have a major tool at our disposal - the internet - a tool which can inform and enlighten. We need to be exposing these people who are running for office - BEFORE WE ELECT SCUM LIKE GREER.

Let's stop accusing leaders and start helping them to make the right decisions. I email - almost on a daily basis - I don't just come here and whine about things I don't like. I go directly to the senators or representatives - TV stations - radio stations - trying to get my point of view into the arena.

Just today - this thread - a story by the AP - exposing this money trail. Little by little stuff is leaking out. We must not allow ourselves to become discouraged by the seemingly overwhelming forces of evil working against Terri.

Unless they UNSEAL the financial and medical records we will never know the truth. Greer would NOT unseal this information to DCF so it made it impossible to prove any "medical" abuse or anything else. The Shindlers have NEVER had access to Terri's medical records.

Has anybody seen an accounting of where the money went for The Terri Schindler Schiavo Foundation? And why contributions are no longer tax deductable? And why they are no longer a tax exempt entity? Ask the Schindlers. All four of them, and only them, are in charge of the foundation.

The whole problem seems to have started when MS received the rehap monies. Had there been no lawsuit, no rehab money, the husband would be now be divorced, remarried, and Terri would be with her parents.

This is sick, sick, sick. How can eating and drinking normally be considered extreme measures to keep someone alive? This ought to scare the heck out of everyone!

The only good thing out of this is that Greer has been asked to leave his church - at least someone in Fl has principles.

I believe Robert Melton, an auditor in Pinellas County, has been investigating misuse of these guardian trusts. However, he's hitting a brick wall in some of the cases.

Pinging amdgmary to this post, Claire ... she had posted some photos on the Terri threads. Michael drives a silver Mercedes and his beloved Jodi drives a black one. Their house is in the $3 to $5 hundred thousand range, if I remember correctly. There's lots of water in the back yard in the form of a pool. Protesters have been in front of Michael's house for days.

Your first sentence obliterates your entire post. Brain dead means no brain activity. Clearly, Mrs. Schiavo has brain activity, hence her ability to breath, see and move.

I find it very telling that the president of the United States and the governor of Florida and the entire federal legislature can't even shove aside one judge and a local police department. I'm sure North Korea and Iran have realized that we are governed by pussies, unwilling to do what's right.

If you can't negotiate a glass of water for an infirmed woman in America, I find it hard to entrust international negotiations on nuclear missiles to anyone other than Judge Greer. Hate him and call him the evil that he is, but the guy just beat the snot out of the executive and legislative branches. Not too bad for some piss ant judge.

Hello Bush brothers...its time to come out and play.

I'm not saying there isn't anything these guys can do but in all fairness the deck was stacked against Terri since 2000 when Schiavo, Greer, Felos and company set this whole sorid tale in motion by lobbying to have the laws changed. Where was the outcry back then? Either nobody cared or nobody was looking while the this occurred.

It seems to me Jeb has been fighting this battle for a while and until late did not have much support nation wide.

Also, the right-to-life crowd has to acknowledge the contributions that W has made to the world with regards to protecting innocent Afghanis and Iraqis from the tyrannical governments that were out to destroy them.

We need to keep this all in perspective.

My prediction is that sadly, neither Jeb nor W will step in at the last minute and stop this atrocity. I don't think people will forget this and public outcry will be great when Terri does finally pass away. Bloggers will continue to hammer away at this Florida collusion of death and many things will be learned that will be eye opening to everyone.

You hit the nail on the head. That is the biggest failure of the Bush Brothers. The average joe doesn't have an army of staff to keep tabs on events. But when your business is politics, it is incumbent on you to deal with these events on a timely basis.

This thing was no surprise; and there should have been an indepth plan developed to deal with this long before it could escalate into a giant political football. Jeb Bush, who somehow managed to tie the knot in his own noose by signing the 1999 legislation, should have had legislation planned to close the legal loopholes. He also should have had many agencies at hand ready to prosecute and discredit this death cabal from every possible angle. But, last week when the crap finally hit the fan, we saw that Jeb was a hollow shell. That behind his rhetorical concerns, and his paniky last minute hail mary to the Florida legislature, he had done virtually nothing to prepare his case.

"Brain dead" has a very specific clinical meaning, and is not the same as PVS:

"Neuroscience experts continue to define brain death as irreversible cessation of all functions of the entire brain, including the brain stem. This definition remains consistent with the definition of brain death initially presented by the President’s Commission for the Study of Ethical Problems in Medicine and Biomedical and Behavioral Research.1,13"

All I can find is that Philadelphia Consolidated Holding Corp. (phly on nasdaq) apparently bought JERGER & CENTONZE INSURNACE AGENCY, INC sometime in 2001 (?). I don't know how to research back to find corp. articles, etc., on company purchases. Maybe someone else knows how to do this. Odd, IMO, that this stuff happened about the same time that Terri was supposedly moved to the hospice (allegedly without the Schindlers knowing about it).

Again, just my opinion; counts for nothing.

I think the media are making things harder by limiting coverage to simple issues and telling everyone to get a living will. More outrage and support would come if the abuse and fraud were covered well.

If I were a parent of any child anywhere in the vicinity of where their kids when they get to the dating age, I'd be on the watch...

One. If they have daughters, look out because they probably have a the same mecurial instincts their bios have.

Two. If they a sons.... let's just say I wouldn't want my daughters (if my children were girls) ANYWHERE NEAR any of his male offspring for any length of time.....

And I'm not picking on the kids because their kids.

If they're around people who believe it's okay to starve someone to death the odds are good they'll have that attitude.

There's a lot of suspicion that insurance fraud is going on, not to mention the likelihood of medicare fraud with the hospice, considering the fact that Terri was illegally a resident of a hospice for the dying, for 5 years, when 6 months is supposed to be the limit.

That hospice is being investigated by the feds (HHS) for just that reason. As a result of that investigation, HHS is seeking to recoup 15 million dollars in federal funding collected by Suncoast in the name of patients who were not actually terminally ill, going all the way back to 97, when Felos was on the hospice board.

Not true. My husband, at age 18, took out a large universal life insurance policy. His father died when my husband was just 3 years old, leaving behind him, his widowed mother and little sister. My husband took out the policy, and named his mother as beneficiary, in the event that anything happened to him and he wasn't able to help take care of her in her declining years.

Upon marrying, I was named beneficiary, three years before we owned a home and seven years before we had our first child. I also carried over $250K in life insurance from the day we married.

I lost a nephew at just 6 months old, and that terrible event taught me to insure my children, as well. My nephew's passing was devastating, and his funeral was expensive. If anything were to happen to my babies, my husband and I would have sufficient funds to cover the funeral, plus allow us to take time off from our jobs to recover, as best we could, the shattered fragments of our lives. I pray to God I never, EVER have to use it.

Since we frequently travel as a family, my sister and my husband's sister would benefit in the event of a air disaster. All totaled, we have almost $1M in death benefits and assets, which would be evenly split, according to our wills (written many years ago, too!).

The long and short of it is this: there is every possibility that Michael had a large policy out on Terri, and would stand to collect should she pass.

What a tangled web we weave when first we practice to deceive.

How applicable to the Terri Schiavo case.

Virtually as soon as Michael Schiavo received the monies from the medical malpractice claim involving his wife, Terri Schindler-Schiavo, he withheld all therapy and rehabilitation services from her.

Terri Schiavo had sustained a serious brain injury as the result of a suspicious incident in their home in 1990 and in 1992, her husband had filed claims against several of her former doctors, claiming her “collapse” was caused by a misdiagnosis. He received over $1.5 million in 1993 including $750,000 which had been specifically earmarked by the trial jury for Terri’s rehabilitation based on a life expectancy of 50 years.

Mary and Bob Schindler Sr., her parents, consulted a St. Petersburg attorney about removing Michael Schiavo as their daughter’s guardian and discussed the case at length with him.

Unfortunately, the Schindlers did not have the amount of money the attorney demanded as a retainer to take the case.

That attorney became the judge in the case-----a totally prohibited conflict of interest.

Thereafter, the attorney-judge approved the hiring of George Felos as the attorney for Schiavo to be paid from the trust fund and the stage was set for her judicial homicide..

The judge wasn’t George W. Greer.

It was Mark I. Shames.

Same here. It's off my list entirely of vacation spots, and we used to go there for a number of years.

What kills me about that is that the FL constitution (someone posted the executive sections the other day and for some reason, I can't link to the website today, keeps getting refused) allows the governor step in if any officer is acting unlawfully. If Greer is violating the law by refusing her oral nutrition, I don't understand how on that basis, Jeb didn't intervene.

I am sorry for all the tragedy you have had in your family but I think you will concede that you are the exception not the rule. In any case if there was a large insurance policy out there I suspect we would have heard about it by now. I am sure during all the trials, depositions, etc. Michael was asked about that.

Oh my God. This article should be a thread of its own. I just read it in its entirety with my hand over my mouth. Unbelievable stuff in there. The more The Empire Journal uncovers, the more appalling this whole thing is.
