Why is the dog owner considered negligent for the dog running loose, but the cat owner is not also considered negligent for the same thing? Per the article, the cat was in its own yard. The dog repeatedly got loose and got into the cat owner's yard. If they both were running loose, I'd agree with you, but it does not seem that was the case.

Nope, I told her that if she objected to me beating her dog, then I would require a trip to the emergency room for the dog bite, followed by a trip to my attorney's office. Now when I garden, I keep a baseball bat handy.....

Pellet guns are legal to discharge, make no noise, and are very effective. My neighbors cat went INTO my Mercedes and took a sh*t on the console (I had left the window open because it was a hot August day). I found my "gift" later that afternoon.
Let's just say that a pellet gun pumped 40 times will discharge with enough force to kill a cat, without admitting that I have such a gun or did harm to my neighbor's cat.
