BAKERSFIELD - A woman defending her home shot a trespasser after two warning shots Wednesday afternoon. It happened on O Street around 2 p.m.

Police said a man who may have been on PCP was attacking two pitbulls outside the woman’s back yard.

The assailant was allegedly beating the dogs with a belt when he awakened a couple sleeping inside.

The woman, who is said to be in her 40’s, came to the back yard and asked the suspect to leave. Police said he then came at the couple and pushed the elderly man to the ground.

The woman fired two warning shots into the air before shooting the man in the thigh.

“It sounds like the occupants life was legitimately in danger,” said Det. Jack Smith from the Bakersfield Police Department. “They didn't know who he was he seemed to be under the influence of some sort of drug.”

“She was just pretty much trying to get the guy out of their yard,” said the woman’s son, Casey Jones. “She was scared.”

The Bakersfield Police department said when they arrived, the suspect was non-responsive. He was rushed to Kern Medical Center, where he is under arrest.

Investigators said the wound is not life threatening and no charges will be filed against the woman.

The suspect is facing assault charges, as well as breaking and entering.

"no charges will be filed against the woman."

In CA? Really? Astonishing.

Here in MA we're taught to expect arrest, loss of license, and extended legal trouble for defending ourselves.

This is a second time a a week that we have heard of "Warning shots".. What up with that? Maybe it's time for a new NRA public education campaign based on center of mass and the proper use of defensive firearms use...

Agreed. Don't un-holster until somebody needs to die. The reason is: Once you squeeze the trigger, you don't really know for sure where that bullet will end up. You at least stand a good chance of killing somebody when you fire, so it had better be reasonable that that somebody should have died.

Even with the right bloodlines and disposition, dogs will fail in a protector roll of they are not given a great deal of training. Part of that training requires that the dog be submitted to physical attack. JUst ask and K9 trainer or Shutzhund hobbyist.

The vast majority of people that think that there dogs will protect them are quite mistaken about this. It is not for want of trying on the dogs part, but when a professional crook , a drug addict or a deranged person gets physical with the average dog the odd are that the dog will back down.

They will warn and scare off the coward and the amateur, but they will do little else.

I teach my students to shoot center mass on the range. You TRAIN as you FIGHT! Because once the involuntary side takes over, you do as you train.

Hey Mal! Mystery solved. Casey Jones is the son of this lady in California that shot a trespasser in the leg.

That is one tough (or stupid) guy. I would have emptied my gun into him then reloaded and done it again.
