President Bush has nominated his long-time friend, adviser and current White House counsel Harriet Miers to replace Justice O'Connor as an Associate Justice of the Supreme Court. We look forward to the Senate Judiciary Committee hearings to learn more about Ms. Miers, her qualifications, her ability to be independent from President Bush, and her views on the role of the Court in protecting fundamental rights and liberties.
As far as we know at this point, Ms. Miers does not have a public record of writings or speeches that would give the Senators and the American people an insight into the kind of justice she would be. Therefore, we urge President Bush to make available to the Committee documents and information relating to Ms. Miers's service in the White House during both terms of the George W. Bush Presidential Administration and for Mr. Bush during his terms as Governor of the State of Texas. Although the Administration did not provide the Committee with files relating to John Roberts's service as Deputy Solicitor General of the United States, we were able to receive from the Reagan Library extensive memoranda and files relating to John Roberts's White House service in the Reagan Administration. The American people are entitled -- at a minimum -- to the same kind of memoranda and files relating to Ms. Miers.
The record we have so far is simply insufficient to assess the qualifications of this nominee. While her resume lists impressive qualifications as a practicing attorney, it simply does not give the Senate -- or the public -- sufficient information to determine her qualifications to be a Supreme Court Justice and her commitment to core constitutional values.
Under the Constitution, no Supreme Court appointment can be made until and unless the Senate gives its advice and consent and the Senate -- and the American people -- must have the same amount and quality of information in approving the nomination as the Executive had in making it. I look forward to meeting Ms. Miers and hearing from her at the Senate Judiciary hearings, and receiving the documents necessary for us meet our joint constitutional role with the President in the appointment of Supreme Court Justices.
Oh, cripes, isn't this the same press release he sent out when Roberts was nominated?
Doesn't she have an extensive paper trail from her work in the law firm?

Naturally, however, Sen. Kennedy had a superb public record when he first ran for the Senate in 1961. The only record he had was that he was Joe Kennedy's baby boy.
Just think of all of the wonderful things Sen. Kennedy has done for MA. Gee. Why do they keep re-electing this gasbag?

I don't know, this seems to be the latest rallying cry among the left... let us root through your underwear and we'll see... only SEE, mind you, about giving you what you want. OTOH, we'll use anything we find on any topic to smear you from head to toe.
LOL I think Kerry released almost the same statement about Miers today too and Pelosi! The Leftists have nothing to go on.

I was a bit skeptical about Roberts and he brought me around to his side with the hearings.
I am more of a skeptic with Ms. Miers. Maybe, just maybe, I will feel better about this after a bit.
I think Bush nominated her knowing the RATS were determined to cause a big stink about anyone he nominated. He knew they intend to vote that nominee down, no matter who it is, just to show their base they are fighting BUSH and flexing their muscle. IMO, Bush has someone else in the wings...just waiting until Harriet is voted down. After they have refused to approve one nominee, the RATS will be unable to make such a huge issue again...as it will look like they are just being difficult to be difficult. Just my opinion.

The obligatory and superficial after-thought about the wishes of the "American people". He does this about two or three times throughout the piece. See? I'm just doing what the American people want.
Kennedy voted against Roberts so it's pretty much a foregone conclusion as to which way he's going to vote here.
Still, I blame the citizens of New England. Kennedy would be nothing more than a rich, local drunk if the voters of that part of the country didn't insist on sending him and his offspring to Washington to urinate on the Constitution every election cycle.

And, those papers (apart from briefs and other public court filings) are likely to be protected by attorney-client privilege. In this case, PRIVATE clients, meaning that Kennedy and his ilk cannot argue that the client was the "American people," as in the case of papers written by Chief Justice Roberts while in the Solicitor General's office. These papers SHOULD NOT be released for public scrutiny.
