Tim Russert said it was common knowledge that reporters knew Wilson's wife worked for the CIA. Therefore, reporters must be considered part of the "intelligence community."

Its basically Libby's word against Russert, Cooper and Miller. That seems to be what the documents say. It was Libby's comments to them and how he reported said comments in testimony. Comes down to he learned her name from Cheney, so every time in testimony he said he heard her name from others, in his recalling talks with russert, cooper and miller, he is being charged with telling a lie. THough its one lie several times, supposedly. All he had to do was tell the truth. Me thinks Rove is being investigated for saying Plame's name was public, thats why its ongoing.

Its basically Libby's word against Russert, Cooper and Miller. That seems to be what the documents say.

But what we don't know is if there are other witnesses who have testified to the grand jury that back up the reporters' versions. A whole lot of presidential and vice presidential aides were called before the grand jury. Some of them may have been in the room when Libby was talking on the phone and gave testimony about what he said that differs from Libby's own testimony. Or they may have testified about their conversations with Libby that differ from what Libby told the grand jury. Finally, what if some of the conversations Libby had with reporters and other aides were taped! I imagine that would be some pretty solid evidence should it come to "he said/she said."

So Fitz puts something into his document that is both clearly and demonstratably wrong, and has nothing directly to do with the indictment.

Smells like he's covering up not going after Miller for who she was actually covering for.

They got nothing on the underlying crime. They got an "entrapment" indictment which is a whole different kettle of fish. The Special Counsel had to manufacture a crime to justify the expenditure of several million dollars investigating a non-event.

The gauntlet has been thrown down. I have my doubts as to whether they have the will to make a stand. We shall see.

My money is on that this is gonna plead out.

No way jury wouldn't convict if you have a parade of reporters marching in all with the same story. Plus, they all protected the source until Libby let them off the hook for source secrecy (probably under obstruction charges pressure from Fitz - or bad advice from counsel). Oh, and that's not to mention the paragraph that obviously comes from the VP himself re: when he told Libby that Plame worked CIA in counterproliferation or whatever it was.


By the way, Fitzgerald is squeaky clean, and the other investigators - one is this pencil-neck geek looking guy who seems nice and one or two younger women that also seemed nice. I for one don't believe these were a bunch of hacks and/or operatives running the show.

The old line is you can indict a ham sandwich is apropos here, and that being said, the fact that they did not indict him for more than this is a testament to the prosecutors' evenhandedness, I hate to say it.

In fact, I think faced with the information in that indictment, any one of us who had Fitz's job would have had to indict Libby for this. Remember the standard at indictment stage is Probable Cause. Far far FAR cry from reasonable doubt.

The end of the indictment states that its only charges and the defendant enjoys the presumption of innocent and the government has the burden of proving him guilty beyond a reasonable doubt.

Looks to me like Fitz "thinks" that Libby deliberately lied to the investigators and the GJ and made up his story specifically to ensure he could not be charged with the leak. Note that Fitz asked Libby whether he said what he said because he knew of the law against disclosing a covert operative's identity. Libby said, no, I said it because that's what happened.

I really cannot believe that Libby would so blatantly lie to an investigator and to a grand jury while under oath, unless he really thought all the reporters he talked to would refuse to testify forever. And if he did, why would he give them a waiver to testify? Either Libby lied or Cooper and Russert lied.
