There is something that bugs me about this choice. It's almost as if saying that Bush can't get a woman past conservatives, a subtle smack at us, who have mostly been pulling for Janice Rogers Brown. I'm not surprised, really. FRegards....

Maybe Janice R. Brown had already told the President "no thanks." Nothing to do with the "woman" thing at all.

I should like to ask George Bush what he saw in Miers that he didn't see in Alito. This guy seems triple qualified from what I have read so far. Miers was a nobody. Just confirms the charges of crony ism directed at the president

You are wrong.

Roberts was named to replace O'Connor.

Rehnquist died.

A second opening then occurred and Alito will be replacing Rehnquist. Roberts was elevated to Chief Justice and O'Connor agreed to stay on a bit longer is immaterial.

From a conservative's angle, Alito is replacing Rehnquist (2nd nominee, 2nd opening) and Roberts replaced O'Connor (1st nominee, 1st opening).

From a RAT's point of view and the MSM, ALito is replacing O'Connor since it makes the RATs' fight carry a bigger punch.

Krauthammer may not ALWAYS be right, but he sure gave the President and Harriet Miers the rationale for "cover" in her withdrawal. His advice or observation formed the basis of putting right a disastrous situation. His view is the same as my hope: the third pick should be JRB.

Nobody believed the Bush spin about why Miers withdrew, so how effective a cover was it? That nomination was going down whether Krauthammer said a word or not.

No offense but it wasn't just any case, it was Casey. Planned Parenthood v Casey 505 U.S. 833 (1992 (the state was Pennsylvania and Casey was the governor).

And yes SCOTUS ruled for PP, but it 5-4 and maybe most important, Rehnquist(?), in his dissenting opinion, quoted Alito almost verbatim (IIRC).

And here's one salient part of Casey (I love reading it)

JUSTICE SCALIA, joined by THE CHIEF JUSTICE, JUSTICE WHITE, and JUSTICE THOMAS, concluded that a woman's decision to abort her unborn child is not a constitutionally protected "liberty," because (1) the Constitution says absolutely nothing about it, and (2) the longstanding traditions of American society have permitted it to be legally proscribed. See, e.g., Ohio v. Akron Center for Reproductive Health, 497 U.S. 502, 520 (SCALIA, J., concurring). The Pennsylvania statute should be upheld in its entirety under the rational basis test. Pp. 979-981.

So if anything is to be done about Roe, Casey and Griswold - which started it all with penumbras and emanations - has to be addressed too.
