Swinger's club draws opposition

New Haven's lawyer says a fight with the adult club could be tough and expensive A "swingers" club opened in New Haven Township despite a new ordinance attempting to regulate adult-oriented entertainment in the rural township.

The town board members and residents expressed disapproval and tried unsuccessfully to discuss the new club with one of its owners at the board's regular meeting Thursday night.

Michael J. Bennin, who along with David Holman are listed as owners of the facility called Club WetSpot, refused to answer questions at the public meeting. He said his attorney, Jeff Scott Olson, was unavailable and several times responded to questions about the business by saying he could not answer questions without his attorney present.

He did say his attorney said the club doesn't fit under the town's ordinance. That ordinance was adopted by the town in September, before the club opened.

The club is listed on the Web site of NASCA, an organization for those who enjoy the "swinging" lifestyle. In a question and answer section on that group's Web site the lifestyle is described as primarily for couples who enjoy sex with those who are not their partners. That can be either with a single person or with groups. It notes that single men and women can attend.

On the local club's Web site, it says that single men need a sponsor for admission. Single women and couples apparently don't. The Web site indicates that people attending should bring their own liquor, but the club supplies mixers.

Town Chairman Bob Krause said he visited with Bennin at the club last week and gave him a copy of the ordinance. At that time Bennin claimed to be unaware of the ordinance, Krause said.

The club, located on Gillette Drive in Adams County, is on the site of a former recycling center. Krause said the property sold for $100,000 and the 12,000 square foot building on it has been partially remodeled for the new club. The club is in about 4,500 square feet within the building. A two-story structure has been constructed within the building, bathrooms have been added, heating added and rewiring, Krause said.

No building permits have been issued for the structure, and they are required by Adams County. Krause also said no well or septic permits have been issued. He said the club relies on a holding tank, but another person at the meeting said he thought new septic tanks had been installed.

The county has not inspected the place, Krause said, because it does not have a certified commercial building inspector. The county's building inspectors are certified for home inspections, he said, and did not want to inspect the commercial site fearing a lawsuit.

The county's zoning administrator was not available for comment Friday.

The town's attorney, Eric J. Pollex said businesses like these are designed to get around ordinances. He also indicated that the club's attorney, Olson, travels the country defending adult-oriented establishments.

"It's (the ordinance) is crystal clear that it applies to strip club and applies to any adult-oriented business," said Pollex, who wrote the ordinance.

Krause said ordinances like New Haven's are difficult to enforce, because the clubs claim they impinge on 1st Amendment rights to free speech.

Pollex said quietly when Krause finished speaking, "if not done right."

"This will be a big fight and it's going to be tough," Pollex told the board. He said he did not agree that the club was "outside the box" set up by the ordinance. The downside of fighting the club's operation would be that if the town loses it would have to pay the club's attorney fees, he said. That could be as high as $500 per hour and could reach $600,000 or more.

Becky and Ken Hutchinson, who live next door to the club and have two children, said, "We don't need this." Becky Hutchinson said the club has a lot of traffic and patrons come out and "talk trash" that can be heard by the children. The Hutchinsons' home is about 30 feet from the club, which has put up a fence.

Ken Hutchinson said that during construction, he was approached and asked if his well could be used. He agreed and was given $100. He understood that the use would only be during construction, but the well continues to be used.

Pollex asked Hutchinson to call him to discuss that situation in private.

Pollex also said he would call or meet with the club's attorney and notify the board of the results of that meeting. He did advise the board to put the subject on its next meeting agenda. That meeting is scheduled for Jan. 19 at 7 p.m.

The NASCA Web site lists seven other clubs in Wisconsin in Kenosha, Oshkosh, Janesville, Madison, Merrillan and Milwaukee.

We've been there a time or two, just for research purposes of course. The town businesses love the 'weekends'. We talked to a few of the local merchants while shopping one time.

The townies figure the 'campers' dump nearly a quarter million into the local economy in about 4 or 5 days. That buys a lot of 'tolerance'.

The campground is right across the road from a 'Native American' owned bar. So, on one side of the road you have a bunch of Ho Chunks and Chippewas drinking firewater at a private club and banging drums all night and on the other side of the road you have a bunch of consenting adults on private property drinking firewater and banging.....

Oh never mind.

And business owners don't have rights? And the swingers don't have a First Amendment right of free association? Could the town pass an ordinance outlawing sex in a hotel...which is also a business?

Plus the fact that the owners of this crap are partners with or hiring someone who tours the country supporting their practice of setting up shop in small towns.

So its evil to hire an attorney who is specialized and experienced?

Going against the town laws, and then suing, so the small town can't afford to fight them.

The story says that it was "a new ordinance,"...a new ordinance to stop this particular club? And the article doesn't say anything about the club suing, the club owners just want to be left alone...but if the town wants to shut down a private club, it may have to pay a price.

I don't know anything about the place in this article, but I can tell you about the one I've seen.

It's five miles outside of town. The only business is that Indian bar I mentioned, otherwise there's nothing on either side of the road for miles. The owner of the property goes to great pains to see that nothing is visible from the main road. There is a stage where on weekends there's live music.

All this guy provides is some water and electic hookups and a bunch of tent sites for camping. Security is provided by the campers so no family who got lost looking for Disney World can just wander in to the place.

Mostly nobody does anything too stupid and there hasn't been a single death or serious injury to my knowledge. The only reason anyones dialed 911 is for an ambulance ride because of dehydration. Check that, I think someone messed up cutting firewood with an axe once; which was ugly considering the circumstances...

The only reason anyone goes to town is to spend money on food, beer, ice, camping stuff, fuel, etc. And these people do spend money.

Considering what I have going on in my community I'd take a bunch of folks who just want to run around naked in a red hot heartbeat.

You'll move because, in a way, you have no choice. Better to decide on a move for other reasons than to feel like you're forced out.

Although I was content in my home, I had thoughts of moving away due to the lifestyle of next-door neighbors. It burned me up that I should have to give up my home to get away from it.

We're still here. Said neighbors, in their 60's, lost their home, the husband sadly died in prison, and his wife is cleaning houses for an income. Such a waste!!

In case you may assume that I describe an area of low-cost housing, I don't. These homes sell quickly and the last I know of went for $329,000.

The suburban areas are not immune to "neighbors" we'd rather not have.

LMAO...Dehydration....Now that's a Larry the Cable Guy joke in the making there Lurker......LOL !

Ax is a dangerous thing in even the hands of a person that knows what they are doing. I use the estwing versions (after reshaping and resharpening) and they last FOREVER yet when I am hunting in remote regions I leave em at home and take the folding sierra saws or a take down bow saw.

I've helped search for hunters and campers that just bled out after a injury caused by a ax.....

Private swinging between freaks is not my business but if they neighborhood doesn't want it then so be it....We have titty bars, adult books, queer wanker booth-joints, massage parlors, turkish baths, private dancers.....and Swingers clubs of all types within the same zoning overlay here in nashville....basically in a ring around downtown...and a new Hustler store too..

Diana might remember this. It's a small, few hundred families and retirees, rural Wisconsin town. There are other towns, more tourism oriented, with strip clubs witin 20 miles. IMO, they picked the wrong town to do battle with. As I alluded to earlier, there was a multi year battle with Perrier conducted a few years ago. The opposition to the bottling plant was based not only on enviornmental concerns, but the fact that the town residents didn't want trucks rolling down their roads, no matter what the economic impact. That's not why they live there. A major difference here, the Governor probably won't come down on the swing clubs side.

Towns of Newport and New Haven, Wisconsin vs. Perrier

In 2000, Perrier informed the residents of two townships near Wisconsin Dells that they had a plan to begin continuous pumping of 500 gallons per minute of Big Spring into bottles (3). The company promised that pumping would have no effect on the local lakes and streams, and that it would bring jobs and money to the local economy. Many local people started asking "Who needs this?" says Hiroshi Kanno, a local resident. Many of the local residents are retirees who did not need jobs or large trucks rumbling by. Residents got together, putting up signs along roads reading "Go Away Perrier!". The towns even held referendums, voting 4-1 and 3-1 against letting Perrier pump the water. Perrier came back, giving the town $20,000, and launched a public relations offensive; the people of New Haven stepped up their community organizing. After the town chairman accepted the money, the residents held a recall, voting 263-92 against the chairman. Once the new chairman was in charge the people gave the money back to Perrier (4).

The majority voice of the residents was not enough. Governor Tommy Thompson and the Wisconsin Department of Natural Resources (DNR) gave Perrier the permits it needed to pump. A group called Concerned Citizens of Newport (CCN) filed a lawsuit against the Wisconsin Department of Commerce and DNR on a number of grounds, claiming that the DNR violated its duty to protect the Public Trust, the DNR violated WEPA (Wisconsin Environmental Protection Agency) by not adequately identifying and mitigating significant environmental impacts, and by dividing Perrier’s proposed water bottling operations into segments, among other objections (5). After a year, a judge decided that the DNR had not gathered enough data to show there would be no significant impact on the environment.

"In September 2002, Perrier announced that it would not seek to renew its drilling permits in Wisconsin. The CEO of Perrier was quoted as saying that his Wisconsin experience was the worst his company had ever had, and that the people of Wisconsin do not appreciate a good business. Perrier has since turned its sights towards Michigan." (6)

it's a much hotter issue in a small town....in a larger city, they sorta fade into the seedier areas

some small towns have strip joints though....usually associated with a military base or heavy industry or mining lower end tourims etc

Yes they are. I'm not a big wikipedia fan, but I'll post their page below. Ironically New Haven is within 15 or 20 miles of the Wisconsin Dells area, with several strip clubs, a large casino, and what I'd guess is the states largest tourist destination. Much better location, of course dramatically different property values.

Geography
New Haven is located at 43°40'43" North, 89°38'57" West (43.678790, -89.64926)1.

According to the United States Census Bureau, the town has a total area of 78.7 km² (30.4 mi²). 75.8 km² (29.3 mi²) of it is land and 3.0 km² (1.1 mi²) of it is water. The total area is 3.75% water.

Demographics
As of the census2 of 2000, there are 657 people, 260 households, and 197 families residing in the town. The population density is 8.7/km² (22.4/mi²). There are 338 housing units at an average density of 4.5/km² (11.5/mi²). The racial makeup of the town is 97.26% White, 0.15% African American, 0.91% Native American, 0.30% Asian, 0.00% Pacific Islander, 0.30% from other races, and 1.07% from two or more races. 1.22% of the population are Hispanic or Latino of any race.

There are 260 households out of which 25.8% have children under the age of 18 living with them, 66.5% are married couples living together, 5.4% have a female householder with no husband present, and 24.2% are non-families. 19.6% of all households are made up of individuals and 10.8% have someone living alone who is 65 years of age or older. The average household size is 2.53 and the average family size is 2.87.

In the town the population is spread out with 21.0% under the age of 18, 5.3% from 18 to 24, 29.1% from 25 to 44, 24.5% from 45 to 64, and 20.1% who are 65 years of age or older. The median age is 42 years. For every 100 females there are 96.1 males. For every 100 females age 18 and over, there are 101.2 males.

The median income for a household in the town is $35,536, and the median income for a family is $38,173. Males have a median income of $30,096 versus $22,083 for females. The per capita income for the town is $15,624. 11.3% of the population and 7.5% of families are below the poverty line. Out of the total population, 16.0% of those under the age of 18 and 13.3% of those 65 and older are living below the poverty line.

History
Originally named Big Springs, the town of New Haven was founded in 1838 by a man named Jared Walsworth.

Today, New Haven is a quiet rural town with a population of 657.

OK, I checked the web. Apparently they're a little closer to the Dells than I thought, or the limos drive fast, but apparently they're targeting tourists, which the Dells gets a lot of all year round..

It will be interesting to see if they last. I'm guessing a creative prosecutor could work with the "admission fee"/prostitution relationship.

Love the way they describe the facilities, compared to the articles, they put in bathrooms.

I withdraw my suggestion that you toke up more. ALthough, maybe if you tried it, it might mellow you out, since you are the one lacking a sense of humor. A laughing fit or two might massage that old liver and lighten up your mood.

I used to be a pot smoker but haven't touched in many, many years.
