The committee vote in tuesday.
Dems have only said they will have a cloture vote by january 31st.
That is the date of the state of the union a week from next tuesday.
There was already talk of dragging this out until the next week.
We are at least a week from a cloture or floor vote on next friday.
It could be as late as 10 days starting a week from tuesday.
Frist just took Alito's careful modest conservative jurist image on the week on the committee and gave alito a whole new image for the dems to fearmonger with.
Frist should have to resign for this stupidity.
Dems hold their annual weekly meeting next wednesday. Should be word after that on what their plan is.
The time to pounce was right after the hearings and get dems on record not to filibuster.
The problem was it happened when the senate was out of session so the dems for the most part weren't available to make early statements pinning them down.
Conrad, Pryor have made statements they didn't see extroadinary circumstances. Feinstein, biden, byrd have made similiar statements.
But feinstein also said before the bolton vote she wouldn't block bolton but reid got her too.
This might all come down to john warner, arlen specter, chuck hagel and murkowski.
Dems get two out of the four they win. Maybe then we won't have to hear how the dems don't have any power. They already blocked bush from being able to pick an estrada or brown. They block anwr, estate tax, lots of other conservative legislation.
As I've often noted before, you have little faith. I have far better feelings about our fellow citizens than you do. The days of the 90's our long past this country. ;)

All that meant is they won't filibuster. But in no means did that mean they would vote for the nuclear option.
There are only 47 votes for the nuclear option. We need 3 more to get to 50 and have cheney break the tie. Out of Warner, Specter, Murkowski, and Hagel we need 3 of the 4. All have made statements that they don't want anything to do with it. They haven't said a definate no but they will be very hard to get.
If we had the votes last time frist would have used it last time.

any promise from a Dem on the filibuster, except for Nelson, is meaningless anyway. the Dems are watching what our guys are doing, we should too.

reid only needs 6 no votes for the nuclear option.

Dems have 44 seats plus jeffords gives them 45.
Dems can also count on chafee, mccain, collins, and snowe who have all said they will never vote for the nuclear option.
Warner has said he doesn't want to break senate tradition.
Hagel has said you have to protect minority rights.
Specter was non commital and very rinoesque in the debate in may.
Murkowski has said not been too positive either.
That gives the dems 49 votes and gives us 47 with 4 votes in play.
Republicans would need 3 out of the 4 and dems would need only 2 out of the 4.
On cloture I think Durbin, Schumer, Kennedy can get every dem they want besides nelson.
Since the dems only need 41 votes they might let 4 red state dems vote for cloture. That would still give them 41 votes when you include jeffords.
The second stupidist mistake was john cornyn who leaked that the dems top witness was going to be someone who compared killing animals to the holocaust.
Also Alito should have just said it was settled precedent for abortion. During the hearings alito said another law was settled and you can see he knew he messed up. Because that gave the dems the opening to bring up roe. Saying it is settled precedent means nothing. You can always overturn precedent.
Settled precedent means the precedent is settled until the case comes up again where supreme court precedent says precedent isn't definate.
There is no legal definition for precedent.
Congratulations, Senator Frist. You've just leapt to the front of the pack in the dumbass of the year contest for 2006. About the only good thing there is about your comment is that's it's still very early in the year and there is plenty of time for someone else to outdo you. However, you have set the bar for other dumbass of the year competitors very, very high.
There are entirely too many people on the conservative side acting way too cocky and way too sure that this nomination is a "slam dunk." That misplaced arrogance and bravado is all the Dims need to rally the troops for a filibuster. Sam Alito may well have pulled off the greatest performance ever by a SCOTUS nominee before the Judiciary Committee. It makes me want to vomit that the rest of the GOP is seemingly hell bent on pissing it away for him.
Do you mean red state dems that are up for re-election this year? I can think of other red state dem senators (Landrieu, Bill Nelson, e.g.) but don't know if they're up for re-election this year.
Bill Nelson is up for re-election this year, and I believe he has announced that he will oppose Alito. So far Ben Nelson is the only Dim who has announced he will support Alito.
I think McCain would vote for the rules change - if he didn't, his presidential primary chances are finished if he is seen as assisting in Alito's defeat, even if indirectly via the rules change.
but you are correct on the others - I don't yet see a solid 50 Rs for the rules change.
McCain stated on Hannity that he would never vote for the nuclear option.
McCain said we can't hurt minority rights.
McCain is a DEFINATE NO.
and if Alito goes down, I cannot even imagine who Bush will send up next.
what good was the gang of 14 deal then, if any filibuster by the Dems for any reason (they can claim "extraordinary circumstances" for anything) is going to be sustained with republican votes.

the thread started because of some stupid comment that Frist made - a comment that is not going to help Alito. that doesn't mean Alito is sunk, but comment on some of the vote analysis being presented here - and tell us which R senators you think are going to give us the "slam dunk" we need for a rules change if it comes to that? go ahead, tell us.
