Police Uncover New Duke Lacrosse E-Mail Apr 05 3:15 PM US/Eastern Email this story

By EMERY P. DALESIO Associated Press Writer

DURHAM, N.C.

Hours after an exotic dancer was allegedly raped by members of the Duke University lacrosse team, a player apparently sent an e-mail saying he wanted to invite more strippers to his dorm room, kill them and skin them. It was not clear whether the message was serious or a joke.

Investigators did not return calls seeking comment about the nature of the e-mail. But a lawyer for the player who purportedly wrote it said the content suggests his client is innocent.

"While the language of the e-mail is vile, the e-mail itself is perfectly consistent with the boys' unequivocal assertion that no sexual assault took place that evening," said attorney Robert Ekstrand. The e-mail "demonstrates that its writer is completely unaware that any act or event remotely similar to what has been alleged ever occurred."

No charges have been filed in the case, which has roiled the campus and the community and led the school to suspend the lacrosse team from play.

The e-mail, according to an application for a search warrant of the player's dorm room, was sent from his Duke e-mail account just before 2 a.m. on March 14. Police said investigators received a copy from a confidential source, though they later won a court order seeking access to the account.

In the e-mail, addressed "To whom it may concern," the player says he has "decided to have some strippers over" to his dorm room, "however there will be no nudity."

"I plan on killing the bitches as soon as the walk in and proceding to cut their skin off," the author of the e-mail says, adding in vulgar terms that he would find the act sexually satisfying.

The e-mail was signed with what police said is the player's jersey number.

The warrant for the player's room was made public on Wednesday. In it, police provide a detailed timeline of the alleged attack and some additional details of their investigation. The warrant also adds conspiracy to commit murder as one of the crimes police are investigating.

The dancer, a student at a nearby university, has told police she was raped at the party by three men who restrained and choked her in a bathroom.

Investigators have collected DNA from 46 of the 47 team members. The team's lone black member did not provide a sample because the dancer, who is black, said her attackers were white. A spokeswoman for the state attorney general's office said Wednesday the analysis has not been completed.

The lacrosse team's co-captains have denied that anyone was sexually assaulted at the party, as have attorneys for the players.

According to the warrant, the alleged victim told police she believes the players used false names and falsely claimed to be members of Duke's baseball and track teams. A team captain and resident of the house where the party took place told police he used an alias when hiring the dancers at the party, the warrant states.

Fair enough but since Duke has students from all over it doesn't necessarily clear out quite as much as other more regional schools.

How about she was working her "profession" with several partners before she showed up at the lax party? How about she had consensual sex with several Duke students but not lax team members? Lots of scenarios. It's also possible that, if there was a rape, it was not lax team members but she thought that they were?

I think you missed my point. The lax players, the ones who have given DNA samples, have stated that they did not have sex with her, consenual or otherwise. If their DNA shows up inside of her, then that would be a great blow to their case- they can't then turn around and say "Oh yeah, I guess I did have sex with her." Credibility in rape cases is very important, since consent cannot often be proven solely by physical evidence. Of course if there is semen from other parties and not the Duke lax players, it would prove them credible and IMO should end the investigation.

I wonder if many of those students at Duke just made it because they cheated their way while in high school. I am sure there are many Duke students who earned it get in.

When I was in college, dorms were not really empty during spring break. Also, during spring break there was South by Southwest, which kept students in town.

I disagree. Remember Robert Chambers the Preppy Murderer? After he was accused of killing Jennifer Levin, he was videoed at an all girl slumber party where he pretended to strangle a doll. The doll's head came off and he was recorded saying, "Ooops, I think I killed it!" Jennifer had been strangled and raped. He claimed consentual rough sex. He was convicted of murder and sentenced to 15 years.

I don't know the guilt or innocence of the Duke Lacrosse player, but I can see a guilty person sending an email like that one.

Agreed. If she has LAX DNA inside her then the jig is up.

Well, I think you can cheat your way out of high school while getting mediocre grades, but I don't think that the kind of credentials needed to get into Duke can be gotten by cheating. If you are at the top of your h.s. class, as many Dukies are, from whom are you going to cheat?

When I was high school, we had 10 Valedictorians. Most schools have one or two. We had a GPA system for Academic (Regular), Honors, and Gifted and Talented. We used a 7 point GPA system, which is weird. Then the only person I knew who went to Duke was a Valedictorian, but he also got into other good schools, but chose Duke.

It is stupid to write down sadistic, homocidal, sexual fantasies, but it is not a crime unless there is TRUE intent to do harm.

Some DNA must have been found on the victim or else why would they test the team?

DNA can last for a couple of days. They may find DNA from multiple sources but it could be from days earlier.
