Duke To Reinstate Seligmann, Finnerty (DukeLax)

(01/03/07 -- DURHAM) - Duke lacrosse defendants Colin Finnerty and Reade Seligmann are both expected to be reinstated today as Duke students in good standing, two sources close to the case told ABC News. Also on abc11tv.com: Send us news tips | Desktop Alert | ABC11 AccuWeather | Pinpoint Traffic Defendant David Evans was allowed to graduate last spring, but underclassmen Seligmann and Finnerty were suspended from the University pending a resolution of the assault charges.

December 22, 2006, prosecutors dropped rape charges against the three Duke lacrosse players accused of attacking a stripper at a team party, but the three still face kidnapping and sexual offense charges.

According to court papers filed by District Attorney Mike Nifong, the accuser says she now does not know if she was penetrated during the alleged attack.

The accuser, a 28-year-old student at North Carolina Central University, has said three men raped her in a bathroom at a March 13 Duke lacrosse team party where she was hired to perform as a stripper.

The indicted players - Dave Evans, Collin Finnerty and Reade Seligmann - all say they are innocent, and their attorneys have consistently said no sex occurred at the party.

Evans graduated from Duke in May, the day before he was indicted. Sophomores Finnerty and Seligmann were suspended following their April 2006 indictments.

The Duke lacrosse team was also suspended from play, but was reinstated in June on a provisionary basis.

A press conference from defense attorneys is expected this afternoon.

DUKE OFFERS TO REINSTATE FINNERTY, SELIGMANN

Duke officials have offered to reinstate Collin Finnerty and Reade Seligmann for the spring semester, President Richard Brodhead confirmed Wednesday afternoon.

The decision, which could allow the two to graduate with their class and make them eligible for the upcoming lacrosse season, comes nearly two weeks after Durham District Attorney Mike Nifong dropped charges of rape against all three indicted members of the 2005-2006 men's lacrosse team.

David Evans, the third player indicted, graduated with his class last May. The three still face charges of kidnapping and sexual offense.

"We have decided that the right and fair thing to do is to welcome back Reade Seligmann and Collin Finnerty to resume their studies at Duke for the spring semester," Brodhead said in a statement. "Although the students still face serious charges and larger issues require Duke's collective attention, the circumstances in this case have changed substantially, and it is appropriate that the students have an opportunity to continue their education."

In a memo to Brodhead Jan. 2, Larry Moneta, vice president for student affairs, said that although the charges against the two are still unresolved and very serious, the "totality of circumstances" has changed in such a way that the University now feels the two should have the chance to resume as students in good standing.

"As circumstances have evolved, we have attempted to balance recognition of the gravity of legal charges with the presumption of innocence, and concern for the well-being of the community with the students' needs to continue their education," Moneta said in the report. "Circumstances have clearly changed. At this point, further extension of the students' leaves would do unwarranted harm to their educational progress."

Finnerty's father, Kevin Finnerty, told The Chronicle Wednesday afternoon that Collin had been reinstated and that Collin and his family will not make a final decision on Duke's offer until all charges have been dropped.

"We are hopeful for successful resolution to these charges ASAP so Collin can move on with his life academically and athletically," Kevin Finnerty wrote in an e-mail. "We need to focus all of our attention to attain the right [innocent] outcome to these false accusations."

Moneta, who called Finnerty to announce the University's decision, said that he believes Finnerty is now leaning toward returning to campus for the spring semester.

Seligmann was not immediately available to speak about whether or not he will return. Moneta said Seligmann and his family were still tyring to weigh the consquences and implications of returning.

"We are also glad that Duke University has now made it clear that Reade is welcome to return to the University and look forward to the day that he can return to living a normal life and continuing his education as a full-time student," the Seligmann family said in a statement Wednesday. "By now it should be plain to any person who has any objectivity that the charges against Reade are transparently false."

Should they ultimately choose to return, Finnerty and Seligmann would be
eligible to compete for the Blue Devils this spring, members of the Department
of Athletics confirmed this week.

"There would be no question as to their eligibility," said Chris Kennedy, senior associate director of athletics.

Throughout the ongoing legal case, head coach John Danowski has maintained his stance that the indicted underclassmen would be eagerly welcomed back to the team once they are reinstated to the University. He reiterated his desire for the players to return in an interview with The Chronicle last week.

Though the complete schedule has not been released, Duke begins its 2007
campaign at home against Dartmouth Feb. 24.

You know this tread has caused me to reflect that even as we debate whether or not anyone in the country still believes these guys are rapists, THE CASE CONTINUES. The prosecutor was elected a mere two months ago and was sworn in yesterday. It is just amazing.

Nope.

Granted, these young men appear to be suffering some unjust consequences. But, the damage to their reputations isn't unjust.

By and large, we all deserve whatever damage is done to our reputations. Walter Williams said much the same just the other day when he subbed for Rush.

Rush is a bonafied loser ~ knew him when he worked here at a local station ~ used to go around town with a bodyguard (yeah, hype yourself, Rush baby ~ Sactown's a dangerous place... uh huh) ~ what a joke. Anywho, your argument is not valid ~ a reputation as a rapist, which is I think what you are talking about, is only deserved if you are one.

As for me, their reputations in my book have changed dramatically. I'll be the first to admit to a certain "mindset" when I formally thought of "jocks" - but these guys have proven themselves to be made of sturdier stuff than I could ever have imagined. Throughout this, they have behaved with honor and class. I think they're great.

RUSH: I want to go back to December 22nd. This story came out after the last broadcast of the year. The twenty-second was when I left for vacation. It came out that night, posted at 9:18 Eastern Time: " Brodhead Calls for Nifong to Step Down as Prosecutor -- In response to Mike Nifong's decision Friday to drop charges of rape in the Duke lacrosse case, Duke president Richard Brodhead questioned Nifong's conduct and called for the DA to relieve himself of his duties in the case." I thought, well maybe you should step down along with him, Mr. Brodhead! You're the guy that threw your players under the bus the first moment that an accusation. The coach? Nobody talks about the coach! The whole lacrosse program was shut down for a while, and the coach was canned, and now all this is utter BS.

It wasn't a piece by Susan Estrogen. I guess it was ran... Sorry. Estrich. Okay, anyway, it was about Nifong, and she was lamenting that Nifong made a mistake; he's gotta go, but couldn’t understand why do this! Surely he couldn't do this just to win an election. I was shouting to the column, "Susan, he's a Democrat! Of course he would do it to win an election!" But the point is, even she -- and she's a lawyer, and she is a law professor at USC, University of Spoiled Children. (Well, that's what they call it.) She proved the point that nobody thinks law enforcement would be corrupt. Nobody thinks law enforcement would do anything wrong -- other than Republicans members of Congress. They are lawmakers. It was amazing to read her piece about this. Now, Brodhead, the University president, the minute this allegation was thrown around, pshew!

These three kids may as well have been guilty. The lacrosse program had to be shut down; the coach had to be let go. I think maybe Mr. Brodhead is just hoping folks will forget his own despicable actions here by calling for Nifong to step down. Then there was a piece in the Los Angeles Times that ran on New Year's Eve ( a big news day, of course): "Duke's Recovery from a Rush to Judgment." Why do they have to put me in every story? There was a headline about Saddam's execution over the weekend about "Rush to Execute Saddam Considered..." I thought, jeez, I'm being blamed for that now. "Duke's recovery from a rush to judgment, what you read and hear about Duke University's out-of-control athletes and parties is far from the truth." It's by Michael Skube. Here's an excerpt:

"Privately, people who rallied to her defense [of the victim] tell you that they were snookered. As they do, a different posse prowls the airwaves and Internet. This one wants not the Duke lacrosse players brought to heel but Durham County Dist. Atty. Mike Nifong — and along with him, the highest stratum of Duke's administrative hierarchy, including university President Richard Brodhead. It was the university, these critics argue, that failed to stand up for its students," it's customers, if you will, and the story goes on to talk about all these people, all these great leftists who believed this accuser and Nifong now talked about how, "We just got a snookered, Mr. Limbaugh! We just got snookered." Here's a quote from somebody named Kennington -- and I'm sorry, I don't know the first name but it shows up earlier in the piece. Kennington, Kennington, Kennington.
Find out if this is a male or female. Why does it matter? It just does. I'm curious. Men and women think differently. Ned Kensington. It's a guy. "One who has come to understand the critics' distemper is Ned Kennington, who last March was among those calling for justice swift and certain. 'I am outraged,' he said back then, 'that 40 Duke students know what happened and won't come forward.' Today, he speaks in tones measured and a little rueful. 'I'll be frank with you,' says Kennington, a former faculty member who lives near the campus. 'I trusted that Mike Nifong was talking in a careful, judicious way when he called the lacrosse players hooligans. It wasn't long after that that I felt betrayed, and I regret what I said at the time.'" Huh. Well. I guess cleansing the soul is healthy. Another quote here from Ned Kennington, the former Duke prof.

"Duke is populated by a faculty that is very socially conscious. I think I am guilty of that. But this [case] was fueled by Nifong's assertions, which fit into our preconceptions." Exactly right! What are the preconceptions? Rich, white, brute, predator athletes, on the lacrosse team! Of course! Well, you can't get more elitist than lacrosse, and who was the alleged victim? A bedraggled, poor stripper trying her best to put herself through college and earn a living for her daughter. (Crying.) It's so demeaning she had to strip in the first place, and these white, elitist SOBs lured her into that little dump of a house! It fit the preconception. This is the way the liberal mind works. At least Mr. Kennington has had a soul cleansing about this and realizes that he got hooked and cooked and tricked by Nifong. Now, Nifong late yesterday... He was a sworn in yesterday, of course in private. There was no media allowed. But late yesterday had a press conference afterward I think in Durham, Nifong said this.

NIFONG: Durham has some healing to do, and I need to be part of that healing process, and I need to -- to have something to do with what -- how -- how we move forward in light of the events that have brought all of you here. Because you're not here today for a swearing in; you're here today because of things that happened over the course of the last year.

RUSH: This is akin to a star athlete spitting on an opponent on the field and after caught and fined, says, "You know, I apologize. That wasn't me. This is not who I am." Yes, it is! You did it! I'm not attacking T.O. I couldn't even think of who did it. T.O. is not the only one. Bill Romanowski. They all do it. Athlete punches athlete and says, "I'm sorry. That's not who I am." Yes, it is! You did it! Nifong is trying to take the third person. He's trying to assume the role of spectator here. "Well, I know you're not here for a swearing in, you're here because of what happened in the past year, and I gotta help with the healing process." Well, then resign! You are the wart! Nifong is the pus that is oozing from the wart! He wants to cause the healing?

He cannot be the wart and the Neosporin! You can't be the pus and the Neosporin at the same time. You are one or the other.

I heard somewhere that it was costing the defendants $80,000 per month in legal fees since the indictments.

Is that a known fact?

And, if so, will Duke pony up tuition and fees and a free kick?

Oh, and will the Trustees accept the Admininistrations' resignations and bring back the coach?

And why hasn't Nifong been charged?

Not sure I'd want to go back to a college that didn't have my back and cancelled the season because some hooker lied to KnifeLong and the Police. Not to mention ruined my life and will cost me a lot of $$$ to defend myself from a whore's accusations who just had a baby and doesn't know who baby daddy is. Where is Maury Povich for the Paternity test.

Why? Why wouldn't you normally be on the side of the TRUTH?

Your home page indicates you live in the US? You know that country where one is innocent until the state proves you guilty? Why would you throw away the American presumption of innocent until proven guilty?
