Italian judge orders CIA kidnapping trial

An Italian judge has ordered 26 Americans to stand trial for the kidnapping of an Egyptian man, setting up the first criminal examination of the CIA's "extraordinary rendition" programme.

Two former Italian intelligence chiefs were also among those indicted by Milan judge Caterina Interlandi yesterday.

Osama Mustafa Hassan, an Egyptian cleric, was allegedly abducted on a Milan street on February 17, 2003, and taken to a high-security prison outside Cairo where he claims he was tortured. He was released on Sunday.

The entire episode hinges on one DA...who apparently also had to bug agents of the Italian CIA...which has the national government in a uproar...but a judge authorized this and they gathered intelligence against the agent.

My guess is that the DA and his legal buddies will start to have visits from the Italian CIA members...with some payback. At some point, you will see a few members of the DA's staff suddenly resign.

Adding to this episode is the fact that Egyptians finally released the Mullah at the cause of all of this in the last week or two. Up until that point...they admitted nothing. The mullah says of course...he was tortured by the Egyptians. So...the Italians have a delicate episode to handle. They can't center strictly on the Americans now...and by going at the Egyptian government...you ripple the turmoil in the Med region.

Finally...the court case can't go forward unless you have the 26-odd Americans, which we know Bush won't ever hand them over. Hillary...might be another story. But I'm guessing that if she did pursue this and attempt to hand the 26 over...they'd make way to Texas, and some ancient Texas law would trigger into effect about legality of US marshall's within the state borders of Texas. This is like a soap opera...which can never come to a conclusion.

The Italians have always been pathetic at finding and jailing terrorists. On the rare occasion they catch one, they look for any excuse to let them go. Abu Abaas, the terrorist mastermind of the Achile Lauro hijacking during which terrorists murdered disabled American Klinghoffer, was released within weeks by the Italians on the flimsiest of pretexts. It took decades--and the invasion of Iraq--before Abass could be be brought to justice. (Democrat defeatists tell us Saddam did not harbor terrorists. Well,thanks to the Italians, he harbored this one, who died in US custody after capture by invading American troops. One hopes he faced sharp questioning before his death).

Italians will not fight terrorists. But they will apparently harass and disrupt those who DO fight them. The judicial system is notoriously corrupt. And infected with the kind of cowardice and lack of principle has has allowed the Mafia to survive.

The next time some US politician whines about the need for allies in the war on terror, remember this: as far as the Europeans are concerned, we are on our own. Worse than that: the Italian case shows that many officials are not merely "neutral" in the war on terror--they actually favor the terrorists.

Oriana was right. Italy is lost as is Western Europe which willingly advances their own Dhimmi status.

Here is Romano Prodi now PM of Italy, then head of EU, after 9/11:

"The tragedy that we are living through and that affects America and all humanity contains the conditions for even deeper political dialogue between Europe and the Muslim countries in the common fight against terrorism. The defence of the universal values of humanity against violence, discrimination and hatred is our common duty, as is a close collaboration in the fight against injustice and poverty.

We cannot give in to hate and confrontation.

May these atrocities never succeed in dividing us, in isolating us from each other, or in thwarting the efforts of so many brave men and women to build bridges between lives and civilisations that are different, but nonetheless an equal source of fundamental values."

He thinks we have "fundamental values" in common with Muslim countries which preach Jihad. He thinks we can dialogue our way into reconcilaition with terror regimes (see Iran).
