Student tears Mexican flag; suspect remains at large

9/19/07

by Jeremy Hunt

Daily Lobo

A student took down a Mexican flag from a flagpole outside Scholes Hall Monday, tore it and took it to the Air Force ROTC office, police said.

A summons was issued for Peter Lynch, 30, by the Bernalillo County Metropolitan Court for criminal damage to property, said Lt. Pat Davis, spokesman for UNM Police.

Davis said Lynch is not a member of ROTC, and it is unclear why he took the flag to that office.

Lynch has not been charged because UNMPD cannot find him, Davis said.

UNMPD investigated the vandalism as a potential hate crime, but witnesses from the ROTC office told police it was not a racially motivated crime, Davis said.

"He was frustrated a foreign flag was flown without an American flag nearby," he said. "We're basically investigating it on witness statements."

The Mexican Student Association raised the flag outside Scholes Hall on Friday for Mexican Independence Day, said Cheo Torres, vice president for academic affairs.

Mabel Gonzales, president of the Mexican Student Association, declined to comment.

Torres and interim vice president for institutional diversity Rita Martinez-Purson issued an apology Tuesday from the University for the incident.

"This sort of incident hurts everyone," Torres said. "It's something that you don't expect to see at a place like the University of New Mexico where we celebrate diversity."

Martinez-Purson said the incident caught her off-guard, as well.

"I don't think anything really prepares you for this type of vindictive behavior," she said. "Obviously, we need to have strong dialog across campus about respect for other people and their cultures."

Whether the vandalism was racially motivated or not, it was offensive, especially to the Hispanic community, Martinez-Purson said.

"There's still an impact that has to be dealt with," she said. "He did insult them. His thoughtless behavior had consequences."

The University won't tolerate that kind of behavior, President David Schmidly said.

"It's inexcusable to desecrate a flag," he said. "I'm not going to be very pleasant to deal with on this issue."

What makes the situation worse is that it was a Mexican flag, Schmidly said.

"For God's sake, New Mexico was part of Mexico at one time," he said. "There's tremendous ties, and we have a large population of Hispanics that live in our state and many of them have relatives and connections to Mexico."

New Mexico is part of the United States of America. Hence the name NEW MEXICO (unlike current, present day Mexico run by corrupt political parties, Napoleanic code of justice, socialism and a government bought and paid for by the drug mafias.)

Good news: Congress may pass a flag desecration bill making it illegal to maliciously damage the flag

Bad news: It will only cover the Mexican flag

Burning or tearing American flag = constitutionally protected right.

Tearing Mexican flag = hate crime.

What a bunch of idiots (the guys who say things like New Mexico was a part of Mexico, and they want to arrest the kid etc). An American flag, by LAW should have been flying AS WELL.

How can you possibly call this kid a hero based upon this disgusting behaviour? Clearly the flag should have been tread upon and buried in an unmarked grave in TJ.

Unless of course it’s an American flag.

"It's inexcusable to desecrate a flag," he said. "I'm not going to be very pleasant to deal with on this issue."

But apparently not to our court system who said that desecrating a flag (or at least the US flag) is free speech.

What makes the situation worse is that it was a Mexican flag, Schmidly said.

Thus the offense taken by foreign nationals trumps the court given free speech "rights" to descecrate a flag.

Some parts of that description apply to NM, too, unfortunately. Most notably the corrupt parties and the socialism.

Free speech should not be to plant a Mexican flag and live as a Mexican in America illegally. True Americans wave an American flag on our soil. Your neighbor isn’t a true American. He should go home to Mexico.

I suppose it would be to much to expect that the apology was for not flying the American Flag

Ethnoreligious relations are worse on university campuses than anywhere else in the country. This is because the most politicized segments of the faculty have every incentive to make it so. It would probably never occur to an employee of a McDonald's to run up a Mexican flag outside his restaurant, and if it did all the non-Hispanics would know that the Big Macs will still taste the same.

Daniel Pipes notes today that academics are more sheltered from the consequences of their choices than any other occupation. This is the fruit of that.

No, flying the mexican flag is the sort of incident htat hurts everyone! I don't see how this (the tearing down of the mexican flag) hurt ANYONE and what does flying a mexican flag have to do with diversity? If there was an american flag flying with it- then maybe I see diversity. Otherwise, I see the flag of a foreign nation as though that foreign nation took over our country/that location.

If you want to celebrate Mexico’s independence day. go to friggin’ Mexico!

I complained to a local Mexican restaurant about flying a Mexican flag and not a US and the reason why it was wrong, three days later it came down and was moved to the wall behind the cash register. That I can live with.

Burning or tearing American flag = constitutionally protected right.

Tearing Mexican flag = hate crime.

My guess is that if he had stolen an American Flag he would also be in trouble with the police. And if he had brought a Mexican Flag that he owned to the ROTC office that he would not be sought by the police.

Thus, the issue is not that the American Flag is not protected while the Mexican Flag is but instead an issue of him taking property that does not belong to him.

It is a simple issue of Property Rights which I hope every Freeper would recognize and support.

Of course not, and I am familiar with all the requirements of the U.S. Flag Code. I will also note that there is no Flag Code violation if I choose to fly the Vatican (or the Confederate Naval Jack) in the absence of the Stars & Stripes.

Maybe, but your opinion won't offend me. I am of the opinion that, when I occasionally fly the Vatican flag, I am not declaring my front porch the sovereign territory of the Vatican.

There is a Mexico flag flying at a home several houses away from me that has been disgusting me for a few months now. I wish there was something I could do .....

What I'd do is go over and start sticking the little American Flags in their yard --- and maybe find some potted plants and stick-em in there. That'd be a pretty harmless way to send a message. :) Luckily in my area, I haven't seen any mexican flags around. I see lots of American flags out, though!

Actually, Vatican City is. This guy should've lowered the Mexican flag, attached the Star & Stripes over it, and hoisted both. Then, the ball would've been back in the court of this Hispanic group. And if they chose to act, we'd be discussing their patriotism instead of trying to justify his.

The Vatican is attempting to win souls for Christ, the Mexicans are invading to take our country over and harvest all the freebies they can. Big difference.

I do like your thoughts on placing a flag above the Mexican flag - but it should the the U.S. flag not a state flag.
