PORT ST. LUCIE - Melissa Barton said she is considering legal action after her son's kindergarten teacher led his classmates to vote him out of class.
After each classmate was allowed to say what they didn't like about Barton's 5-year-old son, Alex, his Morningside Elementary teacher Wendy Portillo said they were going to take a vote, Barton said.
By a 14 to 2 margin, the students voted Alex -- who is in the process of being diagnosed with autism -- out of the class.
Melissa Barton filed a complaint with Morningside's school resource officer, who investigated the matter, Port St. Lucie Department spokeswoman Michelle Steele said. But the state attorney's office concluded the matter did not meet the criteria for emotional child abuse, so no criminal charges will be filed, Steele said.

Now I see why there are so many lawsuits clogging our court system. It’s our only recourse against these incredibly arrogant and abusive public employees.

The insensitivity of this teacher is astounding.
I’d sure love to give those two kids a some form of reward. Those are two savy little kids. They’ve got more going on that that adult (if you can call her that).
These kids are powerful....voting a kid out of class!

Of course a disruptive 5-year-old would be unwanted in a class of little kids but the adult in charge - the teacher - is absolutely at fault for instructing the little children in her care to 'vote' whether or not the disruptive child should have to leave the class. They're 5 years old and self-centered, like many adults and, frankly, almost all little kids are.
My guess is that the teacher wanted the disruptive kid out and figured she could use the children's 'votes' to justify having him taken out of her class.
The school will be sued and lose and the teacher should be fired for incompetence. That she was stupid enough to assume this lame ploy would not backfire or that the disruptive child's parents wouldn't complain and be angry, demonstrates her ignorance and incompetence.

Just what is the criteria for emotional child abuse in Florida? This is horrible, the kindergartner didn't act like the others so the teacher let them humiliate him with personal criticism and then voted him out of their class!
When my son was in grade school there was one child that probably had Asperger's Syndrome. He played alone, couldn't seem to react with the other kids. He was intelligent, but socially unresponsive. So what? He never harmed anyone, he never hurt anyone, and no one was ever allowed to tease him. But this was in a private Christian school, and a not public school.
well, assuming that Alex voted to keep himself in the class, then there was only one kindergartener who voted for Alex. Wow. That kid needs an award ceremony. If I were his/her mom, I would be so proud. I would then pull my kid out of that school.

You really don’t see a difference between someone offended someone else, and a teacher putting a 5 year old thru this?
Class bullying of the highest order!
And we will wonder in 10 years why this kid shot up his school?
Some teachers, especially older ones, don’t think that they should have to work with special ed kids, and actually do everything in their power to keep the special ed kids out of their classes.
When my daughter was in Jr. High, their was a down’s syndrome girl, who had been placed in choir to provide some interaction with the other kids. The night of the concert, the girl showed up, dressed properly and so proud that she had memorized all the words to the songs. My daughter walked into the room where the choir had been preparing before going on stage to find the Down’s syndrome girl in tears. She told my daughter that the teacher told her that she could not go on stage with the rest of the choir.

So its ok for teachers to select a child and encourage the other kids to do this kind of thing? Just checking cause in my opinion this shows incredibly poor judgment. On your part and the teachers.

It probably means their doctor is conducting some sort of behavioral study over a long term.
Nobody in their right mind would want their child to be autistic. Proper diagnosis is critical for the family and for the child.
In the context of this story your comment shows a distinct lack of character.
As long as they are in the union.
