Jaz, I knew you knew that. :-) I wasn't sure whether Ewers had testified in Lt. Col. Chessani's Article 32. I had to check.

If he was going to testify in any of the hearings I believe it was improper for Gen. Mattis to appoint him his top legal counsel due to the appearance of UCI.

Megadittoes to that statement, jaz. Not only appoint him as top counsel, but invite him to sit in on all those meetings getting Mattis's and other's input before he might testify.

I have to question how, if Folsom does rule that UCI was in fact evident in the prosecutions charge statements, he can allow a ruling “without prejudice” and permit a refiling.

That's a good question. It will be hard to thread that needle, won't it?

Agreed a “without prejudice” ruling wouldn’t make much sense. If the well is poisoned, it’ll never be pure. Any new trial, sometime down the road, would have to make use of testimony and materials gathered under a UCI cloud.

Here's a Father's Day thought on the state of affairs from Don Dinsmore...

The little girl is one of the lieutenant colonel's daughters. She's giving out treats to the departing 3/1 Marines, before one of their deployments.

Tuesday would be a good day for it. If the show starts at 9:00 Pacific and lasts an hour as projected, we should be getting word after lunch here in the East.

Of course, I know you mountain folk have your own indigenous means of time telling. Hope it's a sunny day down where you are. And check the Pole star reading before you turn in!

It's not easy to get this beatup old dog near tears, but damn if you havn't done it.

Whether you trust Walt or not, Knowing some people’s names show up with publishing agencies and book companies on their lists makes me wonder just who is in this for the money and are they just posting here because the know people are going to discuss this openly and possibly give information and viewpoints that would be helpful for their future books, eh?
