The youth and his lawyer Edward Paltzik say the charges are trumped up.
In fact, Paltzik insists that teacher Sharon Cantante, like Gilda Radner's Lisa Loopner on the old "Saturday Night Live" skit, didn't mind getting a few noogies from the boys.
"She had this very bizarre tendency to invite students to give her noogies," Paltzik claimed. "This teacher has a history of encouraging noogie behavior."
The teen is taking his case to the state Appellate Division. The Mirenberg camp showed a photo of the eighth-grade teacher smiling broadly while absorbing a male student's noogie.
The 39-year-old divorcee seems completely at ease while getting the knuckle rub.
So who complained? And if it wasn’t the teacher, then why wasn’t the teacher suspended?
The student gave his teacher two “noogies”, and was suspended for 10 months from school. He is taking it to court as a matter of “fairness”. Are two knuckle rubs worth 10 months suspension?

Placing a person in a headlock with one arm, then using the other to make a fist (with the middle finger’s knuckle sticking up a bit), and then rubbing the knuckle back and forth several times firmly across the top of the persons head.
What would be a just punishment for this?
A noogie is a form of humiliation. Watch the video. This kid is as guilty as sin. He claims it was just a pat on the head and his lawyer says the teacher asked for it.
Forcing the perpetrator’s face into one’s armpit and making farting noises in rapid succession.

It's like a swatzee, except on top of the head instead of the nape of the neck.
When a dad does it to his kid, that’s one thing, and maybe between you and you’re male friends it’s considered a sign of affection. If that’s what you’re in to...well...good for you. When I saw it in high school, it was done by stronger kids to weaker kids as a a form of humiliation.

There are probably lots of sadists who give "noogies" for exactly that reason.
Come to think of it, doesn't everyone who gives noogies have to be a little sadistic?
