Alleged MS-13 Gang Members in North Carolina Charged in 70-count Superseding Indictment

Two Members Charged with Gang-Related Murders in Charlotte and Greensboro; A Notice of Intent to Seek the Death Penalty was Filed

WASHINGTON — Twenty-six alleged members of La Mara Salvatrucha, or MS-13, have been charged in a superseding indictment that now charges 70 criminal counts, Acting Assistant Attorney General of the Criminal Division Matthew Friedrich and U.S. Attorney for the Western District of North Carolina Gretchen C.F. Shappert announced today. The initial indictment was filed on June 23, 2008, and charged 26 members of the violent gang MS-13 with federal racketeering and related crimes occurring in the United States and El Salvador.

According to the new criminal counts, Alejandro Enrique Ramirez Umana, a/k/a “Wizard” and “Lobo,” intentionally killed brothers Ruben Garcia Salinas and Manuel Garcia Salinas on Dec. 8, 2007, in Guilford County, N.C., in aid of an enterprise engaged in racketeering activity. The Department filed a notice of intent today to seek the death penalty against Umana for the killing of these two individuals in aid of racketeering and during and in relation to a crime of violence. Also according to the additional criminal counts, Elvin Pastor Fernandez-Gradis, a/k/a “Tigre” and “Flaco,” intentionally caused serious bodily injury that resulted in the death of Ulises Mayo on April 12, 2008, in Mecklenburg County, N.C., in aid of an enterprise engaged in racketeering activity.

The first superseding indictment, with an additional fifteen counts, was returned today by a federal grand jury in Charlotte, N.C., and alleges that the 26 defendants conspired to commit violent crimes in aid of racketeering, resulting in murder during the course of their alleged participation in a racketeering enterprise, MS-13, in the United States and El Salvador.

The superseding indictment also carries new charges including: use and carrying of a firearm during and in relation to a crime of violence, which carries a maximum sentence of life in prison; use and carrying of a firearm during and in relation to a crime of violence resulting in death, which carries a maximum sentence of life in prison or death; murder in aid of racketeering, which carries a maximum sentence of life in prison or death; use and possession of a firearm during and in relation to a crime of violence resulting in death, which carries a maximum sentence of life in prison or death; accessory after the fact to murder, which carries a maximum sentence of 15 years in prison; reentry after deportation, which carries a maximum prison sentence of two years; felon in possession of a firearm, which carries a maximum sentence of ten years in prison; illegal alien in possession of a firearm, which carries a maximum prison sentence of ten years; and possession of marijuana with intent to distribute, which carries a maximum prison sentence of 20 years.

As alleged in the superseding bill of indictment, the murders committed by MS-13 members occurred in Greensboro, N.C., and Charlotte. Those involved in the murders allegedly received assistance from other MS-13 members in avoiding detection from law enforcement. In addition, MS-13 members are alleged in the superseding indictment to have discussed plans to murder an individual who they believed was cooperating with law enforcement.

Those charged in the 70-count superseding indictment include: Umana; Fernandez-Gradis; Manuel de Jesus Ayala, a/k/a “Chacua”; Heverth Ulises Castellon, a/k/a “Misterio” and “Sailor”; Julio Cesar Rosales Lopez, a/k/a “Stiler”; Juan Gilberto Villalobos, a/k/a “Smoke” and “Smokey,” “Juan Alberto Irias” and “Freddy”; Juan Ruben Vela Garcia, a/k/a “Mariachi”; Jose Amilcar Garcia-Bonilla, a/k/a “Psicopata,” “Sicario” and “Lucio Caesario”; Yelson Olider Castro-Licona, a/k/a “Diablo”; Carlos Ferufino-Bonilla, a/k/a “Tigre”; Nelson Hernandez-Ayala, a/k/a “Sixteen”; Mario Melgar-Diaz, a/k/a “Nino”; Alexi Ricardo Ramos, a/k/a “Pajaro”; Carlos Roberto Figueroa-Pineda, a/k/a “Drogo”; Cesar Yoaldo Castillo, a/k/a “Chino”; Edgar Miguel Granados-Alvarez, a/k/a “Gorilon” and “Alexander Granados”; Michael Steven Mena, a/k/a “Cholo”; Johnny Elias Gonzalez, a/k/a “Solo”; Jaime Sandoval, a/k/a “Pelon”; Santos Canales-Reyes, a/k/a “Chicago”; Jose Efrain Ayala-Urbina, a/k/a “Peligroso”; Oscar Manuel Moral-Hernandez, a/k/a “Truchon”; Santos Anibal Caballero Fernandez, a/k/a “Garra”; Manuel Cruz, a/k/a “Silencioso”; Javier Molina, a/k/a “Big Psycho” and “Gringo”; and Mario Guajardo-Garcia, a/k/a “Speedy,” “Iran Guerro-Gomez” and “Luis Angel Galindo.” All of the defendants except for Ayala, Castro-Licona and Ferufino-Bonilla, who remain fugitives, are currently in federal custody where they have remained since being arrested on the original indictment charges in June 2008.

An indictment is merely an allegation. Defendants are presumed innocent until and unless proven guilty in a court of law.

The charges that resulted from the alleged conspiracy span two countries, three states, four federal districts and several North Carolina cities. The charges stem from a long-term investigation initiated by the FBI “Safe Streets” Gang Task Force from North Carolina, which is composed of the FBI; the Bureau of Alcohol, Tobacco, Firearms and Explosives; U.S. Immigration and Customs Enforcement; the Charlotte-Mecklenburg Police Department; and the Gastonia, N.C., Police Department. Additional law enforcement investigative support was provided by the North Carolina State Bureau of Investigation, as well as the Greensboro Police Department and the Durham, N.C., Police Department. Substantial assistance has been afforded by the U.S. Marshals Service for the Western District of North Carolina; the Mecklenburg County Sheriff’s Office; the Raleigh, N.C., Police Department; the Durham County Sheriff’s Office and the North Carolina Highway Patrol.

The FBI’s MS-13 National Gang Task Force played a significant role in coordinating the international aspects of this case, with additional critical assistance provided by the Transnational Anti-Gang (TAG) Center. TAG was created in 2007 by the Department of Justice, including the FBI’s MS-13 National Gang Task Force and the El Salvador National Civilian Police (PNC) with funding provided by the Department of State. TAG is comprised of experienced FBI anti-gang agents and PNC investigators in El Salvador. FBI anti-gang agents serve at the TAG center in San Salvador, side-by-side with PNC officers and analysts and El Salvadoran prosecutors, to combat transnational gang activity that affects the United States and countries in the Central American region.

The case is being prosecuted by Assistant U.S. Attorneys Kevin Zolot, Jill Rose and Adam Morris from the U.S. Attorney’s Office for the Western District of North Carolina and Trial Attorney Sam Nazzaro from the Criminal Division’s Gang Squad Unit.

The following is a summary of the daily reports broadcast by the IMB’s Piracy Reporting Centre to ships in Atlantic, Indian and Pacific Ocean Regions on the SafetyNET service of Inmarsat-C from 16 to 22 September 2008.

Gulf of Aden
Masters using the Maritime Security Patrol Area (MSPA) while transiting the Gulf of Aden are not relieved of their obligation and should continue to maintain a strict 24 hour look out using all available means to get an early warning of an approaching threat. Early indication of a piratical incident will enable the master to contact the Coalition Navies, the IMB Piracy Reporting Centre and respond appropriately to prevent boarding.

Nigeria
Violent attacks carried out by pirates on board vessels at anchor and vessel carrying out STS operations. Mariners are advised to exercise extreme caution in these waters.

Chittagong anchorage, Bangladesh
The number of attacks has reduced since 2006. However, the area is still listed as a high risk area and mariners are advised to be cautious especially while approaching the anchorage and while at anchor at Chittagong

19.09.2008: 2145 LT: Posn: 10:16.3N - 064:34.3W, 2 nm north of Guanta port, Venezuela.
Five robbers boarded a general cargo ship at anchor. They broke into the forecastle store and stole ship’s stores and property. Alarm raised and crew mustered. Robbers escaped with stole items. Duty crew directed search light at the robber’s boat, saw the name of the boat and informed port control. Coast guard came on board the vessel to take statements and later searched for the boat. Two hours later, the boat was found with the stolen items. Master went to police station to give statement and now waiting for court hearing in few months to receive the stolen items.

21.09.2008: 0310 UTC: Posn: 02:30.0N - 051:59.5E, 250 nm off Somali coast, Somalia.
Four pirates in three speedboats boarded a bulk carrier underway. They took hostage 19 crewmembers and hijacked the ship. Owners are unable to contact the ship.

20.09.2008: 0030 LT: Posn: 06:41.1S - 039:26.2E, Dar es Salaam anchorage, Tanzania.
16 pirates, in a 15-meter long boat, armed with knives boarded a container ship awaiting pilot. The pirates gained access to the ship via the forecastle deck. They took hostage three duty crew and tied them up. The pirates broke into three containers and stole cargo. D/O sent another crew to check the status of the three duty crewmembers who were not responding. The crew noticed the pirates and informed D/O who raised the alarm. All crew mustered and searched the forecastle. Pirates jumped overboard and escaped with crew personal belongings, ship’s stores and property.

20.09.2008: 1700 UTC: Posn: 02:37N - 051:25E, 250 nm Off Somali coast, Somalia.
Three pirates armed with machine guns and RPG in a white coloured fast boat chased and fired upon a tanker underway. Master increased speed, took evasive manoeuvres, sent distress message, raised alarm, crew mustered and activated fire hoses. Pirates aborted the attempted boarding after 30 minutes.

18.09.2008: 0250 UTC: Posn: 02:22.22N - 050:55.26E, 250 nm off Mogadishu, Somalia.
Five armed pirates in a speedboat attacked a bulk carrier underway. They took hostage 25 crewmembers and hijacked the ship.

18.09.2008: 0618 UTC: Posn: 14:13.0N - 049:59.0E, Gulf of Aden.
About eight pirates armed with guns boarded a bulk carrier drifting for engine problems. Pirates took hostage 25crewmembers and hijacked the ship.

18.09.2008: 0630 UTC: Posn: 13:54N - 049:31E, 40 nm se of Al Mukalla, Gulf of Aden.
Two white hull boats with several persons onboard approached aggressively a chemical tanker underway with intend to board. Master raised alarm, increased speed, took evasive manoeuvres and contacted coalition forces. SSAS activated and crew mustered. The boats keep on following and at 0700 UTC, the boats aborted the attempt.

18.09.2008: 0045 UTC: Posn: 06:40S - 039:35E, 18 nm Off Dar es Salaam, Tanzania.
Six pirates boarded a product tanker drifting. They broke forward store and stole ship’s stores. Alarm raised and crew mustered. Pirates jumped overboard and escaped with stolen stores in a waiting small craft.

15.09.2008: 10:47 UTC: Posn: 13:33N – 049:09E, Gulf of Aden.
About 15-armed pirates boarded and hijacked a chemical tanker underway. The vessel enroute to Mumbai, India, was carrying chemical products. 22 crewmembers have been taken hostage. Pirates have sailed the vessel into Somali waters. Further information awaited.

13.09.2008: 0440 UTC: Posn: 13:32.5N - 048:47.5E, Gulf of Aden.
Speed boats chased a chemical tanker underway with intend to board. Master increased speed and took evasive manoeuvres to prevent boarding, altered course southward to rendezvous with a coalition warship. Speedboats approached as close as two cables before aborting the attempt.

03.09.2008: 1436 UTC: Posn: 13:36.9N – 049:12.2E, Gulf of Aden.
Two speedboats with five armed pirates, in each, attempted to board a bulk carrier underway. Master activated SSAS alert, increased speed, altered course and mustered crew. Pirates open fire on the ship. Master informed a coalition war ship who immediately responded and came to assist. On sighting the warship, the pirates moved away. The warship escorted the ship.

Homemade Bomb Kills, Injures Iraqi Children

American Forces Press Service

WASHINGTON, Sept. 26, 2008 – Iraqi and coalition forces responded to an explosion yesterday that killed and injured Iraqi children in southern Baghdad’s Rashid district, military officials reported.
Three children were killed and two were injured when a homemade bomb detonated in the neighborhood, police from the 2nd Battalion, 5th Brigade, 2nd National Police Division reported. U.S. soldiers from the 4th Infantry Division’s 1st Battalion, 22nd Infantry Regiment, 1st Brigade Combat Team arrived on the scene to conduct a post-blast analysis.

“This attack is a tragedy and clearly demonstrates that the cowardly enemy will stoop to the lowest level to commit atrocious attacks on innocent children,” said Army Lt. Col. Paul Hossenlopp, deputy commander of the 1st BCT.

“The soldiers of the 1st BCT partner with the brave volunteers of the [Iraqi security forces] who work daily to free the streets and neighborhoods of Rashid from the extreme violence of terrorists,” he said.

In other operations yesterday:

— Coalition forces and Iraqi police captured 22 wanted people, two days after a Sons of Iraq citizen security group checkpoint was attacked in the northern city of Siniyah. The operation was aimed at finding people who did not choose to clear their names during the reconciliation period over the past few months in the adjacent city of Beiji, officials said. Some were also being sought for possible involvement in the checkpoint attack.

— Soldiers from the 4th Infantry Division’s 10th Cavalry Regiment, 1st Brigade Combat Team discovered a bomb next to a school in southern Baghdad’s Hadar community after receiving a tip from a concerned Iraqi citizen. An explosive ordnance disposal unit arrived on the scene and properly disposed of the 130 mm projectile.

— Soldiers serving with the 25th Infantry Division’s 14th Cavalry Regiment, 2nd Stryker Brigade Combat Team seized a rocket, three 60 mm mortar rounds, five 120 mm mortar rounds and eight rocket-propelled grenade warheads north of Baghdad. Later in the evening, Iraqi soldiers found a 60 mm mortar round, a hand grenade and an RPG while on patrol in the Kadhamiyah district of Baghdad.

In other developments, soldiers assigned to the 4th Infantry Division’s 6th Infantry Regiment, 3rd Brigade Combat Team worked with Iraqi soldiers to seize a weapons cache in Baghdad’s Sadr City district Sept. 24.

The munitions included six grenades, two grenade fuses, nearly three pounds of Iranian-manufactured C-4 explosives, two improvised firing devices, an electronic blasting cap and about 25 pounds of C-4 explosives in a garbage bag.

On Sept. 23, Marines assigned to Multinational Force West discovered an old weapons stockpile near Haditha. The Marines, with 2nd Battalion, 2nd Marines, discovered the munitions while on patrol 20 miles west of the city. Among the contents of the find were about 10,000 82 mm rounds, 106 155 mm rounds, one 100 mm projectile, 19 rockets, and one rocket tube.

Militants Detained in Khowst, Ghazni Provinces

WASHINGTON, Sept. 26, 2008 – Coalition forces detained two suspected militants during operations targeting a Haqqani terrorist network in Afghanistan’s Khowst province yesterday, military officials reported.
The operation targeted a suspected Haqqani militant in Sabari district, near the Pakistan border, who is suspected to be in direct contact with Haqqani commanders.

The targeted militant also is suspected to be an active participant in the intertwined financial, bomb-making and foreign terrorist network.

Elsewhere, coalition forces detained two suspected militants during an operation in Ghazni province Sept. 23. The two militants were detained for their suspected ties to a Taliban terrorist network and foreign fighter facilitation in Andar district.
