Obama Citizenship - Another Focus

“(g) a person born outside the geographical limits of the United States and its outlying possessions of parents one of whom is an alien, and the other a citizen of the United States who, prior to the birth of such person, was physically present in the United States or its outlying possessions for a period or periods totaling not less than five years, at least two of which were after attaining the age of fourteen years:”

My understanding is that this language, which would have conferred birth citizenship on Barack Obama, was adopted 25 years after his birth. Has there been any adjudication whether this language confers citizenship retroactively? I have seen it stated that it does not.

Of course you can lose, or renounce, US citizenship.

I don't doubt, however, that Barack Obama is presently a US citizen. He carries a US passport.

He may have re-acquired his citizenship. Perhaps he never lost it to begin with. I'm sure the March raid on Obama's passport file had something to do with this.

His current citizenship is not at issue. What's at issue is, if you are "born in the USA" can you EVER lose or surrender "natural-born" status?

I doubt it.

I had a thought the other day, it doesn’t matter where he was born, just that he was the son of an American citizen. That is how the left and the courts are going to rule at this point. I would think that SCOTUS would rule that way in a 5-4 decision. It would be a minor change to immigration law and not to the Constitution.

True, but he HAD to renounce his American citizenship to be an Indonesian citizen, and there is not even a record of his re-affirming his oath.

Right?

Hospitals normally do a very good job of keeping records.

But the thing is (i'm trying to confirm this after reading FR a few weeks ago) the Hospital he names in his book, was not in existence when he was born.

After returning to Hawaii and upon turning age 18, Obama could possibly have given up his Indonesian citizenship and become a naturalized U.S. citizen, with the proper paperwork filed through the U.S. State Department and by swearing an oath of allegiance to the United States. It is believed that Obama did not do so. [258,300,301]

If Obama [a minor] did not formally and personally renounce his citizenship in Indonesia before a US consular official, he wouldn't have to be naturalized when he returned to the US at age 10. I would wager that he travelled to Indonesia at age 6 on a US passport and returned the same way to Hawaiii at age 10.

OK. We will have the Electoral College counting on Jan 6. 2009. Can a Senator or US Representative issue subpeonas with sufficient authority NOW to attempt to recover documents required to confirm Obama’s natural born citizenship to be presented when objections are solicited on Jan. 6th?

does the Jan 6th, 2009 proceeding allow for a period of discovery, search for documents?

I don't know, but my guess would be no. They'd probably just have an up or down vote. I imagine a lot would depend on how egregious and shocking the evidence and what the public's reaction to it was.

It would be interesting whether the SCOTUS would allow itself to become involved. They might just decline to take it up, on the theory that it is up to the House to impeach and the Senate to remove.

It happened in 2005. The Donks tried to get Ohio's electoral votes tossed, on the grounds that there had to have been fraud because of the discrepancy between the exit polling and the actual vote. They didn't get far.

You have that incorrect, since Indonesia would require renouncing the US citizenship to quailify for school in Indonesia, so his school documents in Indonesia reflect solely Indonesian citizenship, again, they did't allow for dual. It does not matter that US did allow dual, that is NOT where he was.

First, I seriously doubt that the school would not be that stringent if the father provided the adoption papers. The point is that the Obama himself would have to personally and formally denounce his US citizenship before a US Consular official in Jakarta. Being a minor at age 6, that just wouldn't be allowed. I say that advisedly having worked at the US Embassy in Jakarta as a foreign service officer including doing a stint in the consular section.

Yeah, I agree, it is VERY CREEPY that no one is allowed to pronounce barack’s middle name. Everything is creepy about Obama, even his angry, arrogant wife.
