Sheriff: Attempted carjacker gets shot

EDINBURG -- The clerk warned Alejandro Salinas about the suspicious men who had been hanging out in front of the convenience store for the past hour. He told Salinas to be careful as he went back out to his Chevrolet Z-71 pickup truck, that he had just filled at the Aziz Convenience Store about 11 a.m. Saturday.

Salinas walked out to his truck and hopped in. But before he could close the door, 18-year-old Hector Severo Ramos was holding a .25-caliber pistol at Salinas' neck, said Hidalgo County Sheriff Lupe Treviño.

"He says ‘Get out of the truck. I'm going to take it and I'm going to kill you," Treviño said of Ramos.

Salinas told the gunman to calm down; they could work things out. Then he pushed Ramos' pistol away, pulled out his own pistol and fired two 9 mm bullets into Ramos' chest....Three men who were with Ramos took off from the convenience store at Texas Highway 107 and Alamo Road in a brown Chevrolet Impala, deputies said....

Salinas had a license to carry a concealed firearm and a clean criminal record, Treviño said....

Meanwhile, the sheriff said he would likely not pursue criminal charges against Salinas..."This is not a murder," Treviño said. "This is a justifiable homicide."

Salinas kept his word. They worked things out perfectly. I'd hire Salinas for whatever kind of work he does if I got the chance, since he did the job right - solving the problem while saving on medical expenses, court costs, and prison crowding.

The three men with Ramos should be identified, if possible, and charged with felony murder.

Ramos' family should be sued for all costs related to this incident.

The perp apparently bled all over the defender ... the defender should sue the perp's estate for cleanup costs.

The two men tumbled to the pavement as blood spilled from Ramos' chest.


I hope Mr. Salinas wasn't wearing a nice shirt; that mess will never come out.

This seems to be dependent on state law. I know it was effectively used in Arizona. I'm now living in California and I don't think the law exists. Obviously apparent results....

The mode of death was not homicide, justifiable or otherwise. It was suicide by car owner. The perp could have stopped the chain of events that led to his death at any time up when the trigger was squeezed. Mr Salinas was given no choice in the matter except his laudable decision to live.

It is indeed dependent on state law. Michigan used to have such a law, but sadly it was changed in the never ending quest to protect the criminal class from the evil citizens.

Texas Penal Code Sec. 7.02. CRIMINAL RESPONSIBILITY FOR CONDUCT OF ANOTHER.

(a) A person is criminally responsible for an offense committed by the conduct of another if:

(1) acting with the kind of culpability required for the offense, he causes or aids an innocent or nonresponsible person to engage in conduct prohibited by the definition of the offense;

(2) acting with intent to promote or assist the commission of the offense, he solicits, encourages, directs, aids, or attempts to aid the other person to commit the offense; or

(3) having a legal duty to prevent commission of the offense and acting with intent to promote or assist its commission, he fails to make a reasonable effort to prevent commission of the offense.

(b) If, in the attempt to carry out a conspiracy to commit one felony, another felony is committed by one of the conspirators, all conspirators are guilty of the felony actually committed, though having no intent to commit it, if the offense was committed in furtherance of the unlawful purpose and was one that should have been anticipated as a result of the carrying out of the conspiracy.

We still don't care for criminals in Texas.
