Witness says Martinez man choked, killed son

MARTINEZ — A Martinez man confided to a friend that he had killed his 16-year-old son by choking the boy so hard that his mouth bled and that he was afraid he'd be going to jail, the friend testified Tuesday at the start of the father's murder trial.

Erhan Kayik, a 43-year-old self-employed rug dealer, is charged with killing Volkan Kayik on July 4, 2007, during a fight in their home. Prosecutors say he then buried the boy's body in a shallow grave in the Sierra, where he ultimately led authorities four months later.

The killing was reported to police in August by Kayik's friend and business associate, Omer Tutmaz, who was the first witness called to testify at the trial.

Tutmaz testified that Kayik said his son had refused to answer questions about why he was always running away from home, so he tried "with his hands" to make the boy answer.

As Kayik choked the boy, "quite a bit of blood" spilled from the youth's mouth, and the boy agreed to cooperate, Tutmaz testified.

"You had the chance to tell me. Now there is blood coming out of your mouth. So long. Too late. Now, I kill you," Kayik replied, according to Tutmaz.

"He said if he had let him go, (the father would have) to face the consequences and go to jail for that," Tutmaz said. "For that reason, he chose to finish it."

Tutmaz said he asked Kayik if the boy struggled.

"He said, 'You know, he was a very skinny and little boy. He basically fell into my hands and he was gone,' " Tutmaz said.

Volkan Kayik, a student at College Park High School, frequently ran away from home, often sleeping in Hidden Lakes Park, a favorite fishing spot.

Deputy public defender Rebecca Brackman said in her opening statements that Erhan Kayik killed his son, but it was an act of manslaughter — not murder. Kayik had suffered a near-fatal heart attack that resulted in a brain injury that made it difficult for him to process stress, she said, and Volkan had numerous behavioral problems that were challenging to a parent.

After Kayik's wife was killed in a traffic accident in Turkey when the boy was young, the boy was raised by his grandmother. When problems developed during the boy's teen years, Kayik brought his son to the United States to live with him, Brackman said.

The father was devastated about killing the son and wanted go to police, Brackman said. But family members in Turkey advised him against it, saying they couldn't bear to lose him, as well as the son, and because they counted on Kayik for financial assistance.

Tutmaz said he tried to convince Kayik to confess to police, but was unsuccessful. So Tutmaz tearfully walked into a police station near his Orange County home and reported the boy's death.

"What was the main reason you felt you needed to betray the defendant's trust?" Deputy district attorney Colleen Gleason asked.

"I didn't see the necessity to kill (the boy)," Tutmaz said.

Now is that a typo and supposed to say “Drug dealer” or would “carpet salesman” been a better choice?

This man choked the life out of his own son. The lawyers, of course, will try to add a bunch of their gobbledygook to this murder to try and get this sob a lesser sentence. He killed his son because he did not want to go to jail for assault or attempted murder.

The man who stood and watched is not a whole lot better even though he did finally go to the police. I could not stand and watch someone choke a dog to death let alone a human being. I can not even begin to contemplate what kind of human excrement a family would be that would not want justice just because this murderer was sending them money. He should be hanged by his neck, until dead.

Read the article again. The killer's friend did not witness the murder. He was the one who reported the crime to the police and was also the first witness to testify at the trial.
