Scalia: You need 4 votes for Obama eligibility case

A lawyer lobbying the U.S. Justice Department and the U.S. Supreme Court for a review of Barack Obama's qualifications to be president says a key conservative justice has hinted that another conservative justice has been voting against hearing the dispute. According to Orly Taitz, a California attorney working through her Defend Our Freedoms Foundation on several cases challenging Obama, said she was presented with an opportunity to ask a question of Supreme Court Justice Antonin Scalia yesterday. The issue of Obama's eligibility has been raised before the Supreme Court at least four times already but has yet to be given a single hearing. Cases have been brought by Taitz, Philip Berg, Cort Wrotnowski and Leo Donofrio.

Sean Hannity just mentioned the controversy for no apparent reason. He said something along the lines of “He’s an American citizen as far as we know, despite the birth certificate controversy”

“Roberts initiated the meeting with obama and Alito was missing. I don’t recall any comments from Alito concerning obama.”

I believe that Roberts, Thomas, and Scalia have each referred an Obama eligibility case to conference.

Sean Hannity has loads of RINOs and democrats on his show including Sharpton, Lanny Davis and others. I like Pat Caddel who is not an insane lib but a Blue Dog N. FL Dem.

Leo Donofrio will be on a large AM station tomorrow in SE Florida at 3:05 pm EST.

You are very likely correct. It was Roberts who agreed to, and presided over what was essentially an ex parte proceeding (highly unusual and certainly unethical) in which Comrade 0bama was invited to meet with the Supreme Court Justices prior to 20 January 09. This, at a time when there were (and presumably still are) cases on the docket before the SCOTUS challenging 0bama's eligibility to serve as President.

The only judge which did not participate in this was Sam Alito.

To invite a party to a pending case to meet privately with a judge or judges without the presence of the opposing party is (I believe), a violation of the American Bar Association's code of ethics.

So your guess about Roberts is probably a good one.

I once heard Thomas speak about the importance of adherence to the constitution and the importance of that in ending slavery despite widespread popular opinion among the people.
