Asked whether the state can continue to grant in-state tuition to undocumented immigrants, Texas Attorney General Greg Abbott said in an opinion Friday that there's not enough legal precedent to answer the question with certainty.

Abbott said the sections of the Texas Education Code that permit illegal immigrants to pay resident tuition at state colleges and universities could conflict with federal law. But he added, "Given the paucity of judicial precedent, we cannot predict with certainty that a court would so find."

IMHO, HELL NO!

I can *almost* understand why the children of illegal immigrants should receive primary education but, that's where it should end.

Even then, these children are putting our entire education system and other public services at risk here in Texas.

Texans should really consider replacing their AG for saying such a silly thing.

Illegals are by definition not legal residents of any state, and even if someone believes that such persons should be allowed to attend a college or university in a given state, there's no way they should be granted in-state tuition because their illegal status prevents them from being legal residents of any state.

I know I shouldn’t joke, but the demands for self-destruction of the country seem endless.

What? This is a trick question isn't it? NO! They are criminals. What they should receive is a one way ride back the the country they entered our country illegally from and either given the boot and told to never return or shot. You pick.

Look at the small print at college sites. They come right out and say residence doesn’t matter and in fact give preference to them. Imagine that. My tax dollars going to pay for a bunch of illegals who take the slots from my kids. Try searching for a scholarship for a bright middle class white kid and you’ll be wasting your time. However, there’s a flood of scholarships for illegals.

And neither should their kids be welcome in our public schools!

Greg wants to be Gov someday. And as such he is riding the fence. I’ve always thought he was a sharp guy, but statements like this catch my attention in a negative way.

In-State Tuition and Unauthorized Immigrant Students

In 1996, the illegal immigration reform law instituted a restriction on states' residency requirements and in-state tuition benefits for higher education, affecting an estimated 50,000-65,000 unauthorized immigrant students annually.

Last I knew that had not been repealed.

Also from the link....

The Illegal Immigration Reform and Immigrant Responsibility Act (IIRIRA) of 1996 (Sec. 505) sought to prohibit states from providing a postsecondary education benefit to an alien not lawfully present in the United States on the basis of residence unless any U.S. citizen or national is eligible for the same benefit. (P.L. 104-208). The Congressional Research Service notes that there is disagreement about the meaning of the provision, and there is no guidance in congressional report language or in federal regulations.

Many colleges and universities have a limited number of places, that is, they admit only a specific number of students each year. In-state tuition for illegals inevitably denies admission to a number American citizens equal to the number of illegals admitted. Combine that with the “diversity” recruiting and you have a situation where the children of American citizens (who have paid taxes all their lives) are denied admission to the state college or university of their choice, for whom there otherwise would be be a spot. In other words, in-state tuition for illegals discriminates against American citizens.

What kind of question is that? Of course, they should NOT get in state tuition. They should not even be here. What part of illegal does the Austin Statesman not understand.

If they are going to just let them stay here and go to college, then at least let somebody in Mexico or whatever country they came from subsidize their college, not Texas taxpayers.

Let me ask: Do Americans illegally in MEXICO get in-state or preferential tuition rates at THEIR universities? Perhaps a Mexican can answer this?

What the hell is the matter with these ‘Texans’ the law identifies them as illegals and then someone starts in about sending them to college. Are they too stupid to just get em outa the country?

I agree ... HELL NO!!!!!

costs for residents keep going up. This is probably one of the reasons. Abbott's a good man, but he is way off base with this issue.

If we took our laws and sovereignty seriously, they wouldn't even be allowed to enroll in college. Citizenship or legal residence should be a requirement for admission to any college in the US.
