According to the U.S. nationality law, a citizen at birth is a person born in the United States. Parental citizenship doesn’t matter. It only matters if the child is born outside of the United States.

See http://www.law.cornell.edu/uscode/8/1401.html.

There are just two types of citizens: born in the U.S. and naturalized (14th Amendment).

“Natural born” simply distinguishes between those born in the U.S. and those naturalized.

Well it’s a new day. Starting fresh. My reasons for thinking it’s real: the folds would be hard to fake and age, the star burn or stain appears to have bled onto the folded paper and that would be hard to fake, although easily doable, and finally the lack of signatures. I don’t know if it’s been discussed but that is a good sign. The original would have signatures, but a hand typed facsimile would not. My biggest reason for thinking it’s a fake: The name Joshua Simon Oduya? I keep thinking theres a pun in that name that I’m missing? Josh you? ... O do ya? Maybe it’s just me though!

Earlier was a picture posted of an Eric Lavender at a Uganda misestry conference in Kampala, Uganda in November 2004. Here, in Feb. 2004 he is at an event in Feb. 2004 Kings School Trust, Zambia. As expected, Eric is from the UK. Have you heard any updates overnight?

“During the visit to Zambia in February Arthur put in place a board of management to oversee the day to day running of the School. This consists of Arthur and Margaret and Eric Lavender from U.K. plus three Zambian Nationals.”

“Natural born” simply distinguishes between those born in the U.S. and those naturalized.

Not neccessarily.

It could be determined that a natural born citizen born overseas to two US citizens is a natural born citizen for the purpose of running for President.

The founding fathers wrote that into a law..then took it out during the French Revolution and when they wanted immigrants not to be able to vote for a particular party.

Thanks so much!

LOL...it should be

It could be determined that A child born to two US citizens in a foreign land is a natural born citizen for the purpose of running for President. This is the only time the natural born status kicks into play.

That is one definition. Not the only definition. A poster on Saturday brought up the Elg case.

There is another definition as per SCOTUS.

I don’t believe they intended that definition to be one used for the presidency. I think it came from mixing terms.

Nevertheless, unintended consequences.

I haven’t seen this addressed anywhere: How long has the number 7 typically had a line through it to insure that it is read as a seven and not something else? I notice this in the BC application number. How far back does this practice go?

Good question. It goes a long ways back, well before OCR. I picked it up in the early 70s when I was first being taught computers. Its usage was typical in the computer books of that time, so I guess it goes back much farther than that.

Also later in that thread it was pointed out that the JPEG compression of the photo makes font analysis harder.

Yes, that’s the one. You’re right it was on Dutch paper. But did it have any of the same names on there, e.g. registrar etc as on the Kenyan BC.

Like I said, the Kenyan BC can be easily disproved if it’s a fake. I mean the first thing is to go to this book it references, and look up the page number etc. where the birth is recorded.

But of course, that could have been altered by now, so you would have to look at the signatures and the people listed.

I find it believeable that the document was obtained for divorce and was probably on file in some Hawaii courthouse and someone copied it, but if you look at it, it looks like it’s an original with the seal embossed.

Then it was stolen from the court files?

Very strange.

That statement among others. He was reiterating the comments he had read.

I do not believe that Polarik takes this as “Bogus” birth document. This document is as good as you or anyone is going to get from the registrar in any Kenyan district. There isn’t anything inherently bogus about it in the way that there is with the Hawaii COLB in that there is not another actual “Birth Certificate” as the primary document.

In Kenya, the proimary document is a big heavy book, with sequentially numbered intact pages, and the birth record is inscribed on one of these pages. That is the primary record, and it is not avialable for issuance. All anyone will get is an attestation in a prescribed form as to its content. That is what was issued in 1964. It is a real document with typed words on it and a signature, which makes it much more amenable to verification than a laser printed sheet of paper with no real signature.

What about the two different Registrars listed? E.F. Lavender and Mr. Miller??

I don't think it's Mr. Miller, but rather M.R. Miller. If the typist had left out the period after the "M" then typed the "R", he/she would have had to manually push back and hold the carriage and then overstrike part of the "M" with a period which is pretty much what the image shows.

(c) Notwithstanding the provision of subsection (a) of this section, a person born, after December 23, 1952, outside the United States and out of wedlock shall be held to have acquired at birth the nationality status of his mother, if the mother had the nationality of the United States at the time of such person’s birth, and if the mother had previously been physically present in the United States or one of its outlying possessions for a continuous period of one year.

Not sure about the last clause. Certainly his mother was in the US continuously for over one year, but not prior to his birth. The clause doesn't make that distinction so he would be a US citizen. But of course, that is not the issue, IMO. If this BC is true, he lied about where he was born and has spent a large amount of money to cover it up.

Welcome to FreeRepublic as a poster. You have provided valuable information — mainly because you know the exact dates you acquired your album. I don’t know if you mentioned it, but it is likely that the stamps you acquired in 1964 were older — sitting around in stock somewhere.

I wonder what Stanley Ann, or even Stanley Dunham would think about all this fuss over their comings and goings? They are probably laughing their hearts out. Somehow, I doubt that Madelyn would be amused at all this attention.

I’ve read almost all of this thread, and my head is spinning and eyes are crossed. Thanks for your contribution. Keep posting.

Not quite.

Madaraka Day - June 1, 1963:

- Kenya was given sovereignty over their political affairs and their resources
- Kenya was given a Bill of Rights to be enforced by an independent judiciary
- Kenya created a democratic Nation by rule of law

Jamuhuri (Republic) Day - December 12, 1963:

December 12th 1963 (Jamuhuri or Republic Day), Kenya attained independent dominion status within the British Commonwealth under a constitution that was negotiated and agreed at three multi-party Constitutional Conferences held in London and Nairobi between 1961 and 1963.

December 12, 1964, Kenya became a republic and the last British governor in Kenya departed, leaving Kenyatta to steer the country as its first president.

Yes, you might be able to look into what is required under that one year clause in other situtions. For her the only thing would be 1 year right before birth because she qualifies under any other scenario. You would have to find some case law interpreting it.

assume that BC is real.

You can use the fact that Sr claimed they were married in the eyes of Kenyan law as proof there was a tribal marriage.

Then you can loop back around to the born of a marriage law....and Jr. would not be a US citizen.

The only proof that they were married in a tribal marriage may be by that BC. Kenya did not recognize a mix of statutatory and customary marriages.

Of course, Jr can claim Daddy thought they were legally married in Hawaii even if they weren’t..to which you respond....he knew he was already married and he had to claim he wasn’t to get that marriage license

I don’t think they were married in Hawaii but that is just a wild guess.

In any event, I think his presidency is destroyed if Born in Kenya..even if they allow him to stay in...

He went to elementary school in Indonesia as Barry Soetoro, but was sent back to Hawaii to live with his grandparents prior to adolescence. I don’t think his high school records have been released, and no one knows when he changed his name back to Obama or what passports he has used.

He has apparently had Kenyan, British, Indonesian, and — one would assume — U.S. citizenships.

Didn't your post have 3 links yesterday?

I've read maybe 70% of this thread ...what a Sunday! I learned more about Kenya than I ever wanted to know!

Whether this Certification is real or fake may not matter anymore. We must consider how twisted the leftists are. The way I'm seeing the situation is, this Certification may solidify the Resident's stay in power. Think about it, what better person is there to lead the NWO than a person who was born on two different continents? He has experienced life in both and now has two proofs for his double birth.
I just wish he didn't choose USA as his home base (or the planet Earth).

If he were an honest man, he'd step down till this BC is cleared, for his own peace of mind. He's Barry, so he won't.

All I know is, God is still in control and His word lasts. He will have the last word. The truth will set us free.

Although I was raised in the midwest, I had a German math teacher in the '70s who literally would rap your knuckles with a ruler if he saw you making a 7 without a slash through it. So my impression is that it's a continental European thing.

The other memory I have of him was that he had a wandering glass eye. You never could tell if he was looking (or even speaking) to you or to some other kid across the room.

He and I never got along very well, but you know what? I love math to this day. So I guess the old psycho was good at his job.

Ask yourself if you were the mother of a boy grown to manhood, would you make a nonsensical comment like 'Yes I was present when I gave birth to my son.' ... The grandmother wouldn't either!

Looking into this further, it appears that the woman interviewed was a stepmother to Obama Sr. - his father had more than one wife. So yes, it was a reasonable statement, as she could easily not be present. However, I'm not persuaded that's what she meant, although I did note the interviewer, Bishop McRae, at times referred to her "son" when he meant "grandson."

From listening to the whole audio, it is clear that she said several times that he was born in America - different from the snippet that I'd also heard.

I may get flamed for this, but the tape "evidence" is ambiguous at best, and could be considered clearly against a Kenyan birth. The evidence is what it is, not what we want it to be.

Right now, IMO, Elg is the case to look to..before Saturday I said it was the Wong case and they decimated the subject to the jurisdiction thereof clause...

but a poster brought up ELG and that is a later case.

And it is on point...even though I think it is an unintended consequence.

No one can say how a court would rule today.

Anyone here claiming to know what SCOTUS would do is out of their minds.

All you can do is guess...and we have one Freeper that says SCOTUS can’t interpret it and it would have to go to a Constitutional Convention...one we haven’t had since the first one.

I don’t buy into that argument.
