Is It Possible the Wrong Guy Was Sworn In on NY-23 ?

Boy, if this recanvassing comes out with a big surge of votes for Doug Hoffman, a whole lot of post-election analyses are going to have to be rewritten: "A recanvassing in the 11-county district shows that Owens’ lead has narrowed to 3,026 votes over Hoffman, 66,698 to 63,672, according to the latest unofficial results from the state Board of Elections.

In Oswego County, where Hoffman was reported to lead by only 500 votes with 93 percent of the vote counted election night, inspectors found Hoffman actually won by 1,748 votes — 12,748 to 11,000. The new vote totals mean the race will be decided by absentee ballots, of which about 10,200 were distributed, said John Conklin, communications director for the state Board of Elections."

It also seems to be close to recount thresholds (usually under 1%)

We have a couple of seats in Erie county that aren’t final yet. I don’t understand that all absentee votes aren’t counted by now. There are only 700 in the district I’m watching and the “new person” was only behind by 180 votes in a close race!

Hope by some miracle of the absentee ballots that Hoffman wins the majority of votes. Let’s see the ‘Rats squirm with that one!

An article I just read said that it had NOT been certified.

If that's the case, was Pelosi swearing Owens in illegal and did he cast an illegal vote on Healthcare (one vote won't make a difference in overall tally but it could be worth a call to do something about Pelosi and possibly revote).

No. But with Hoffmann's preemptive concession it doesn't matter now.

Is that really true? If so, why are they continuing to count votes?

Of course, in any case, if he'd used the 'Rat playbook, he would not have conceded, and Pelosi's Obamacare margin would have been one vote thinner.

The vote on the health care bill this past weekend might have gone very differently if Owens wasn't sworn in time for the vote.

And regardless of how a recount might eventually turn out, Hoffman could have prevented Owens' from casting that vote.

Hoffman's advisors must have been as clueless as he was.

And why would that be? A concession just means that the candidate has realized that there’s likely no way that they can win, so they “bow out”. It has no legal ramifications whatsoever.

the intrigue deepens, local Democrat election officials and local pro-Scozzafava Republican officials had every motivation to conspire in a plot to deny Hoffman a victory...

The Dhimmicrats will move to the courts to eliminate the counting of the absentee ballots, citing Hoffman's concession. Arguing that since he's conceded, it is a waste of resources ($$$) to count the absentees.

How could he have prevented Owens from casting that vote? Keep in mind that a concession is just a tradition with absolutely no legal bearing.

Doug Hoffmann was an idiot.

He should not have conceded so fast. I can give him some pass on not having good campaign advise because the DAMN RNC hurt him at every step when they should have been helping this guy and at least should have had him some good advisors on hand on election night (when they were supposedly FINALLY on board with him).

Its just another good reason to keep the money away from the RNC!!!!!!!!!!!!!!!

“Conklin said the state sent a letter to the House Clerk last week explaining that no winner had been determined in the 23rd District, and therefore the state had not certified the election. But the letter noted that Owens still led by about 3,000 votes, and that the special election was not contested — two factors that legally allowed House Speaker Nancy Pelosi to swear in Owens on Friday.”

Sworn in legally. I guess this means that no matter who actually wins the day of the health care vote will stand as is, as Owens was “legally” sworn in.

On another note, what clear thinking individual (this leaves out the left) is actually surprised by this turn of events?

Al Gore proved that when he conceded and then back off that concession.
