Boy, if this recanvassing comes out with a big surge of votes for Doug Hoffman, a whole lot of post-election analyses are going to have to be rewritten: "A recanvassing in the 11-county district shows that Owens lead has narrowed to 3,026 votes over Hoffman, 66,698 to 63,672, according to the latest unofficial results from the state Board of Elections.
In Oswego County, where Hoffman was reported to lead by only 500 votes with 93 percent of the vote counted election night, inspectors found Hoffman actually won by 1,748 votes 12,748 to 11,000. The new vote totals mean the race will be decided by absentee ballots, of which about 10,200 were distributed, said John Conklin, communications director for the state Board of Elections."

was the final vote certified?

You mean Hoffman may have really won the election?
An article I just read said that it had NOT been certified.
I think that’s what is going on now.

I agree.
Those morons or miscreants who cast a vote for Scozzabean on the ballot could have put Hoffman over the top if just 1/2 of them voted for him instead. Maddenning isn’t it.
Owens lied about his healthcare vote so hit him hard with it
at next years election.
Thanks for posting this. I hadn’t seen it before.
I didn’t hear any of his speeches or interviews, but from what I’ve heard it sounds as if he’s an honest and decent guy, with the right principles, but no political experience and evidently very little political smarts.
Yes, prying the Democrat out of congress is not going to be easy, even if it turns out that Hoffman won. Instead of having an empty seat while they fight it out in court, they will have a Democrat seat, which will certainly mean that unlimited money from the DNC will flow in to protect that seat in the courts.
No, the final vote wasn’t certified. However, when Hoffman conceded, that was sufficient for Pelosi to swear in Owens.
Didn't Gore rescind his concession?
Maybe there is still time!!
Very interesting.
Just remind the Dems of Gore's concession take-back in 2000.
so Hoffman has the right to cast the final vote for the opponent? I wouldn’t think there was anything legal about that at all.
No and I do not know how they can sware someone in when the vote has not been certified.
It also seems to be close to recount thresholds (usually under 1%)
I just read on another thread that his concession is meaningless if he actually won.
We have a couple of seats in Erie county that aren’t final yet. I don’t understand that all absentee votes aren’t counted by now. There are only 700 in the district I’m watching and the “new person” was only behind by 180 votes in a close race!
Hope by some miracle of the absentee ballots that Hoffman wins the majority of votes. Let’s see the ‘Rats squirm with that one!
If that's the case, was Pelosi swearing Owens in illegal and did he cast an illegal vote on Healthcare (one vote won't make a difference in overall tally but it could be worth a call to do something about Pelosi and possibly revote).
Is that really true? If so, why are they continuing to count votes?
Of course, in any case, if he'd used the 'Rat playbook, he would not have conceded, and Pelosi's Obamacare margin would have been one vote thinner.
And regardless of how a recount might eventually turn out, Hoffman could have prevented Owens' from casting that vote.
Hoffman's advisors must have been as clueless as he was.
If it hasn't been certified, was it legal to swear Owens in?
And why would that be? A concession just means that the candidate has realized that there’s likely no way that they can win, so they “bow out”. It has no legal ramifications whatsoever.
the intrigue deepens, local Democrat election officials and local pro-Scozzafava Republican officials had every motivation to conspire in a plot to deny Hoffman a victory...
The Dhimmicrats will move to the courts to eliminate the counting of the absentee ballots, citing Hoffman's concession. Arguing that since he's conceded, it is a waste of resources ($$$) to count the absentees.
How could he have prevented Owens from casting that vote? Keep in mind that a concession is just a tradition with absolutely no legal bearing.
Doug Hoffmann was an idiot.
He should not have conceded so fast. I can give him some pass on not having good campaign advise because the DAMN RNC hurt him at every step when they should have been helping this guy and at least should have had him some good advisors on hand on election night (when they were supposedly FINALLY on board with him).
Its just another good reason to keep the money away from the RNC!!!!!!!!!!!!!!!
OMG...........YOU are on this thread stating something remotely positive about Hoffman?
Now I have seen it all, Lord, you can take me now..........
;^)
bump
Hoffman’s advisors must have been as clueless as he was.
That’s about the only post you have ever had that I have some agreement with, DEDEmojave.
From the article:
“Conklin said the state sent a letter to the House Clerk last week explaining that no winner had been determined in the 23rd District, and therefore the state had not certified the election. But the letter noted that Owens still led by about 3,000 votes, and that the special election was not contested — two factors that legally allowed House Speaker Nancy Pelosi to swear in Owens on Friday.”
Sworn in legally. I guess this means that no matter who actually wins the day of the health care vote will stand as is, as Owens was “legally” sworn in.
On another note, what clear thinking individual (this leaves out the left) is actually surprised by this turn of events?
Agreed.
Well now. Isn’t this interesting? No certification, no office. The Dems will be printing absentee ballots all night long. BTT.
Al Gore proved that when he conceded and then back off that concession.
See 37
YES! YES! YES! This scenario is at the top of my Christmas list, Nancy.
How so? 220 to 215. With Hoffman, 219 to 216. Even with Cao not jumping it would have been 218 to 217. Plus, Nazi Pelosi undoubtedly released "Blue Dog" rats to vote no since she didn't need their vote.
You don't think Owens would "do the right thing" and step aside so the will of the people will prevail?
From the article linked at Drudge :
http://www.syracuse.com/news/index.ssf/2009/11/its_not_over_recanvassing_shows_ny23_race.html
John Conklin communications director for the state Board of Elections said this :
“We sent a letter to the clerk laying out the totals,” Conklin said.
“The key is that Hoffman conceded, which means the race is not contested. However, all ballots will be counted,
and if the result changes,
Owens will have to be removed.”
verrry interesting ping
“Owens will have to be removed.” Wow, how wild would that be. Still unlikely though.
Besides Gore there was one other very public case where a winner conceded. Gov Jim Rhodes in OH in 1974 as I recall. He was slightly behind on election night but late returns showed him actually pulling ahead by a tiny margin. He made some joke about conceding, but he was actually sworn in for another term.
How can Owens be “removed” if the vote hasn’t been certified yet?
Did he get sworn in anyway?
What exactly is recanvassing? Simply recounting the votes?
I doubt there is any rule, law or whatever that says the final certified vote count result is trumped by a concession speech.
But even if there is, Hoffman needs to take this to court. If nothing else it will create another negative for the Demrats and Onada. Of course, the morally correct thing for the demrat to do, if it turns out he actually lost, is to remove himself from the scene. Any bets on that happening?
