Attorney Philip J. Berg defends Obama birth certificate lawsuits

Editor's note: Philip J. Berg, former deputy attorney general of Pennsylvania and an activist attorney who brought a lawsuit challenging the eligibility of Barack Obama to become president of the United States, has written the following reply to Jamie Freeze's Dec. 22 RenewAmerica article "Facts are stubborn things: Obama is a natural-born citizen."

Jamie Freeze, a law student, has called any of us who question Soetoro/Obama's citizenship status and constitutional eligibility to serve as U.S. President --- a constitutional right of ours, of course --- incompetent idiots. Ms. Freeze, however, may want to continue her education. Part of being a lawyer, a very important part, is being able to comprehend what you read and to cite the correct law to collaborate it, something Ms. Freeze has clearly failed to do.

I will respond below to Ms. Freeze's allegations. My responses are in bold. I also want to make very clear to all readers that none of the eligibility cases have been heard, litigated, or dismissed based on the law pertaining to any of the issues raised. Instead, the eligibility cases have been dismissed on the basis of "STANDING" only.

I think her name calling invited the abuse. To wit: "Here goes: If you believe that President Obama is NOT a natural-born citizen, then you are an incompetent idiot who is probably watching Glenn Beck while wearing a tin-foil hat. You probably think Obama's a Muslim too."

She found the necessary words to insult many people to make her case. Rather than investigate the veracity of Berg's claim she chose to attack him and equate Beck to him. To my knowledge Beck has never stated he believes Obama is NOT a citizen. I think he shies away from the subject and occasionally makes a reference to it but has not declared a position.

I did read the article. I found her to be, as usual for pundits these days, to be quite intensely equivocating.

I do, however, like her conclusion: "So the question isn't whether a Christian can be a Republican (or Democrat). The question is whether Christians are being Christ-like in a Christ-less society."

To me the last comment by Mr. Berg is the most troubling to explain away. If Obama was born in Hawaii and there can be no question about that produce the long form birth certificate and be done with it rather than spend over a million dollars fighting its release. I am a US citizen born in this country and proof of my citizenship is a matter of clear record. Why does Obama have such a problem simply releasing the records that would make this whole thing go away?

Legal fees are listed in the Obama presidential campaign’s FEC filings that are public. You can find it by googling the FEC reports. It shows that since the election, Team Obama has spent some $1.7M on legal fees, presumably defending various eligibility challenges.

That bothers me a lot, too. You hear this claim all the time plus the number of law firms fighting to prevent the release of the BC, but I've NEVER seen any hard evidence to back it up. It seems to have become urban legend.

I respect Mr. Berg's response, but he needs a proof reader and less dependence on spell-checking: "Part of being a lawyer, a very important part, is being able to comprehend what you read and to cite the correct law to collaborate it, something Ms. Freeze has clearly failed to do."

Clearly he meant "corroborate it." Small nit to pick in an otherwise fine response.

But when you combine her profile with the picture she paints of herself with her comments, Freeze looks very much like a liberal pretending, for strategic purposes, to be a conservative. For example, some conservatives might think Glenn Beck is a bit over the top but none would try to marginalize him in an ideological context.

We can certainly agree, the young (and I stress "young") lady is quite naive and that her writing skills could definitely use some further honing. And I also agree she needs to acquire a bit more humility, which should come as she grows through real life experiences, but the point of my reply to you was basically aimed at the knee-jerk, uninformed reactions by folks on this forum.

It will be interesting, only mildly, to follow how she develops once she leaves the insular existence of academia and enters the real rough and tumble world.

There might have been that land deal but Rezko took the fall and it was hushed up. There had been speculation there were other real estate shenanigans but all's quite now. There is also most assuredly hush money being thrown around the world but that most likely being conducted behind closed doors and far, far away from any connections to him.

I don't think so. They are defeating these cases on the argument that no one has standing to litigate the issue, and therefore, the court never has to address the issue. IIRC they have never submitted anything that deals directly with the issue of Obama’s birth, because the court has never allowed it to get that far.

In Hollister v. Soetoro Bob Bauer asked the court to take “judicial notice” of the fact that his client, Barack Obama “publicly produced a certified copy of a birth certificate showing that he was born on August 4, 1961, in Honolulu Hawaii.” And noting a birth announcement published in a Honolulu newspaper.

Neither document was provided for the court, because neither document exist, but the fact that Bauer only had these items to “offer” the court as proof of his clients eligibility is quit interesting.

Article one section of the Constitution does not give Congress the right to enforce us citizen to but a product from a private company. The spin will be to make it a tax but still I believe we can defeat this, but just like obama BC cases no “standing” might apply until it goes full bloom with passage of bill,refusing to buy arrested and convicted then one will have standing to challenge the bill as unconstitutional

Of particular importance in this discussion is Hemenway's quote from the SCOTUS opininion in Scheider v. Rusk in which it is made absolutely clear that statutory law concerning naturalization has nothing to do with the eligibility requirement of Article II, Section 1, Clause 5 and that statutory law cannot alter constitutional provisions. Berg seems to ignore this point just as he does the 19th century case law indicating the importance of Vattel's views on this point. It is perhaps fortunate for Colonel Hollister that Berg and his team resigned from the case, since he seems to needless and erroneously concede a fundamental point that is very much at issue.

One wonders how a self-described methodical law student can have failed so badly to research the law as to confuse statutuory law of naturalized citizenshship with the Constitutional requirement for presidential eligibilty that long preceded the 14th Amendment and was unaffected by it, as the Supreme Court points out. The quote in question was used by the 10th Circuit not long ago in the Craig case to make the point she seems completely ignorant of. What kind of a law student thinks statutes can alter the Constitution. Is that being taught in law schools these days?

I’ve said before that I believe Barry’s birth certificate carries 1- a different name for his father and/or 2- his race as Caucasian.

Both would be embarrassing to him. But what’s worse is the ADOPTION by Lolo Soetoro and his use of Indonesian Citizenship to attend Occidental College as an Affirmative Action Foreign Student and to get the Passport to go to Indonesia and Pakistan back in 1981 when he should have reestablished himself as a US Citizen [IF he indeed could have done that legally].

He’s using the Social Security Number of a deceased Connecticut person. Orly Taitz has ALL that documentation from the many SSNs he’s used. Yet NO JUDGE QUESTIONS that? It’s been surmised that his GrandMother (the White folk one) assisted him in obtaining the SSNs when she was working at the Bank in Hawai’i.

Collusion with the Judiciary? If it could be proved, the entire SCOTUS should be recalled, impeached, imprisoned, drawn, quartered, tarred, feathered, run out on a rail. Not necessarily in that order.
