Mitt Romney Not Eligible?
May 19, 2010 | Chatter

Posted on 05/18/2010 9:25:22 PM PDT by chatter4

Here is a real mess, that is much more confusing than Obama's ineligiblity.

It has occurred to me that Mitt Romney, may not be a natural born citizen, and may not even be a US citizen. I'll give the facts as I know them, and let you all research the Immigration Laws.

When Congress started cracking down on polygamy, Miles Park Romney (Mitt Romney's great-grandfather) and many other families, left the United States, 5 March 1885, moved to Mexico and began their own settlement.

Mitt Romney's paternal grandfather Gaskell Romney (1871–1955), fathered George Wilcken Romney, however, remained in Mexico until events during the Mexican Revolution forced his family to move back to the United States, when his son was still young. The year they moved back is unknown, but, the revolution started in 1910.

Mitt Romney's father, George Wilcken Romney (July 8, 1907 – July 26, 1995) was born in Colonia Dublán, Galeana, in the Mexican state of Chihuahua – one of the Mormon colonies in Mexico – on July 8, 1907.

Here is the core issue. Under today's immigration law, Gaskell Romney would be considered a US citizen, because both of his parents were citizens, both of whom, did live for a while in the United States, however, his son, George Wilcken Romney was born in Mexico, to US citizen parents who had not yet spent one day on US soil. So exactly what was George Wilcken Romney true citizenship status? I believe that he would have been required to apply for naturalization, but he did not. How can Mitt Romney be considered a natural born citizen, when his father was possibly an illegal alien , and not a US citizen?

Mitt Romney is not a natural born citizen if his father was never a citizen of the United States of America. Same argument applies to 0bama.

Under the power enumerated by the Constitution to the Legislative Branch, from 1795 on to the present day, children born abroad to United States citizens are themselves citizens. This was the law according to the Naturalization Act of 1795 and every such Act since that time.

The 1795 Act repealed and replaced the 1790 Act, which stated that children born abroad (”beyond the seas”) were natural-born citizens. But, returning to the enumeration of powers to the Legislative branch, Congress had no authority over anything but naturalization. Natural-born is not naturalized. So, it was repealed and replaced with language conforming to the Constitution, which was just “citizen” and a naturalized-at-birth citizen at that.

Posts like this are killing FreeRepublic. This is the 2nd kooky conspiracy post I’ve seen this evening. I suppose if one points out that this is crackpot stuff on par with 9-11 troofer toadies, they are automatically a Romneybot, right? Whatever. I don’t care for Romney at all, can find at least a dozen reasons not to vote for him and would never do it, but I refuse to let go of reason and become a laughingstock. I often wonder if the the originators of these types of posts aren’t just lefty trolls hijacking the site. If so, I’ll bet they think they are being real clever, because at the least, they are wasting everyone’s time here and, at the most, they are tainting this place to such a degree that it’s affected the credibility and integrity of this once-great site.

His father dropped out of the race, when it was pointed out that he was born in Mexico. If you read Senate resolution 511, which declared McCain a “natural born citizen”, you will find it states,” Whereas previous presidential candidates were born outside of the United States of America and were understood to be eligible to be President”, this no doubt refers to George W. Romney, and Barry Goldwater. Being born in Mexico, Romney certainly was NOT eligible.

Turning and turning in the widening gyre
The falcon cannot hear the falconer;
Things fall apart; the center cannot hold;
Mere anarchy is loosed upon the world,
The blood-dimmed tide is loosed, and everywhere
The ceremony of innocence is drowned;
The best lack all conviction, while the worst
Are full of passionate intensity.

Surely some revelation is at hand;
Surely the Second Coming is at hand.
The Second Coming! Hardly are those words out
When a vast image out of Spiritus Mundi
Troubles my sight: somewhere in sands of the desert
A shape with lion body and the head of a man,
A gaze blank and pitiless as the sun,
Is moving its slow thighs, while all about it
Reel shadows of the indignant desert birds.
The darkness drops again; but now I know
That twenty centuries of stony sleep
Were vexed to nightmare by a rocking cradle,
And what rough beast, its hour come round at last,
Slouches towards Bethlehem to be born?

— William Butler Yeats, January 1919

Title III, section 301 of the Immigration and Naturalization Act states, “(e) a person born in an outlying possession of the United States of parents one of whom is a citizen of the United States who has been physically present in the United States or one of its outlying possessions for a continuous period of one year at any time prior to the birth of such person;”.
As I stated in the article, His grandfather’s parents, had spent there entire lives in Mexico.

I believe this would apply, “ SEC. 325. [8 U.S.C. 1436] A person not a citizen who owes permanent allegiance to the United States, and who is otherwise qualified, may, if he becomes a resident of any State, be naturalized upon compliance with the applicable requirements of this title, except that in applications for naturalization filed under the provisions of this section residence and physical presence within the United States within the meaning of this title shall include residence and physical presence within any of the outlying possessions of the United States.”

If you’re going to pick your way through the specifics, you’re going to have to deal with statutes as they existed and were applied at the time of his birth. Current statutes may or may not apply.

As far as George Romney’s failed Presidential candidacy and any presumed lack of eligibility, it’s moot. He withdrew and so there was no legal issue regardless.

Under every early Naturalization Act of Congress, he was born a citizen. That’s what matters as far as even the strictest interpretation of original intent.

I really think you’re just tossing out a red herring, but I’ll discuss it just to nip it in the bud. Mitt Romney has no eligibility problem, not that he’ll ever be in any position to worry about it, lol. Mr. President-In-A-Can doesn’t have a snowball’s chance given the mood of the electorate.

I really don’t know. This would all depend on what immigration laws were in effect in 1907. According to today’s laws, his father would not have been considered a US citizen.
