"Many people refuse to answer any questions or allow census takers on their property. None have been prosecuted, at least by 2000. I worked for the Census in 2000 and in 1988-1990. In training we were told all these things and when questioned about how many people were prosecuted the answer was well, none, but they could be."

Several of my friends from church are working on the census this year. One of them told me Sunday that any form with 3 responses is considered "returned" and is not being followed up upon. That corresponds to what many of us have provided - number of residents, gender and age.

Another friend, who is a census supervisor, yesterday wrote me that the census workers are encountering some pretty abusive citizens:

"They have been spit on, bitten by dogs, chased with baseball bats and cursed out with the foulest words you can imagine."

While I don't condone abuse of enumerators, I can certainly understand people's frustration with government intrusion, nosy questions, racially divisive agenda, and excessive cost.

What do census takers do with all the people who own more than one home in various states? Are they counted twice or considered uncooperative if they are not at their second home?

My story with the “club”.
I have “No Trees-pass” signs since I moved here.

In 2000 after the basic questions posed by an elderly “Taker”, I began to receive harassing phone calls, claiming I did not answer all the questions. Then I ignored the the calls.
Weeks later.

I was stalked by a new “taker”. He left tree limbs across my driveway, legally referred to as, “Denying Freedom” When I challenged him about trespassing, he stated he was from the government and go could go anywhere.

This was echoed in 2009, by another “Taker” not even the year to take the census.

Back to 2000.

He sat in his car where he could see me drive in and out. He stopped me while I was walking my dog. Finally fed-up, I open the right side of my vest, and pointed to Mr. Glock. Nothing more until 2009.

Two visits from a female “Taker” I got the “go anywhere” crap. Then a male “Taker”, I was not home but a relative was. The Taker never I’d himself, just his first name and left a paper which stated how my data was protected. Found out later he was GPSing the area. Nothing until 2010, two weeks ago a female taker showed up. I was not home she left the blue “rag”. 3 days ago she was observing my driveway from a distance. She saw me enter my drive, and followed me. I drove my car into the garage and closed the door. She proceeded to continually knock at one of my doors for ten minutes, while calling out my name.

In my state we have laws which deny access to property which has No-trespass signs. I have notified the “Taker’s” management they do not have my permission to enter my property. If the do I’ll call the police and ask they be charged with criminal trespass and stalking.

People who work for the “Taker’s” are dirty.

If this fine is constitutional then could it follow that a fine for not having health insurance be constitutional?

I’m both ignorant of the law and unsure of the following - but it has a link. It says that this only allows census workers onto the grounds, not into individual units. This is one of the comments on the ajc page.

This is a pretty liberal reading of the code! The relevant language is at Title 13, Chapter 7, Subchapter II, § 223 of the US Code. The section prevents the owner or manger of “any hotel, apartment house, boarding or lodging house, tenement, or other building” from refusing to provide a list of the buildings occupants or providing access to “such premises”. This means a building’s owner or manger cannot refuse to let a census worker into or out of the building and cannot refuse to provide a list of occupants for the purpose of the census count. The penalty for refusal is $500. No where in the section does it authorize entry into individual apartments, lodgings, or “living quarters”.

Nothing is beneath Obama and his hired thugs. The census will be “fixed” at the proper time, anyway ;-)

I call shenanigans on the basis that if I am not home, the census taker has no one to count, so his being in my place is pointless.

He was sane in the past, but has gone wingnut.... As others have said, I can't find the section that Barr says authorizes this. Can you find it?

Well, that would be hugely funny if it weren't so naive.

Barr is a stinking politician.

Do you know how to tell if a politician is lying?

His mouth moves!

Barr sometimes has his heart in the right place...but the bottom line is...a politician sells their souls, period.

I do not trust anything any politician says until I personally verify it, nor should you.

But this is, after all, a "free" country...you may feel and do as you please.

But your mileage will vary, particularly if you take every politician at face value.

I got a visit from a census worker yesterday. Answered the first question on the census form and mailed it back the same or next day after we received it. Surprisingly, a really cute woman in her early 20's with a bubbly personality, although the diamond stud in her nose ruined an otherwise lovely face. Conversation went something like this:

ME: Can I help you with something?

WORKER: I'm with the census.

ME: Sent it back already.

WORKER: Ummm ... it musta been lost in the mail or something.

ME: Yes, another finely-tuned government agency.

WORKER: (Opening the folded form) I just need to go over these ....

ME: 2 people live here

WORKER: (scrambling to find the right place to enter '2') Okaaaaay and ...

ME: That's all you get. 2 people live here.

WORKER: (looking quite confused, bless her heart) But I need your name and date of birth and ...

ME: 2 people live here. That's all the info you're getting. Period. Oh, except under race you can put American.

WORKER: Can I get the name and birthdate of the other person who lives here?

ME: (sigh) 2 people live here (now I'm getting a little aggravated, but I'm still smiling)

WORKER: Can I have your phone number?

ME: No. It's listed if they really want it badly enough.

WORKER: If I don't get it, they will just send somebody else to get it.

ME: Fine, tell 'em to come on.

WORKER: Yes ma'am, thank you.

ME: This is nothing personal sweetie, really. This is my little personal stand against the idiots and that doesn't include you. Be careful when you pull out of the drive.

Doesn’t the Bill of Rights discuss something about a search warrant. I believe the founding fathers had a problem with Red Coats doing this.

Legitimately empowered to do those things, no way. But it is common knowledge they "ask around" for info that is not volunteered. Little doubt they make things up too.

Our neighbor took a job as one of those census canvassers. She has drank the kool-aid with regard to her reason for being but that's beside the point (we actually had quite a discussion about it).

Now, when we got our census form in the mail I answered question #1 (the count) and that's all. I didn't even read the other questions and whatever information I have as to what was asked is second hand. She says answering only question #1 is satisfactory in our locale, and that our house is not on the list for follow up.

Of course there may be different "goals" in other areas, where they might more aggressively collect all the unconstitutional demographic stuff. I just don't know.

On the other hand, some census worker somewhere may try this and get away with it, temporarily.

As often happens, it might take a court case to clarify the law’s intent. Just as likely, higher-ups in the Census Bureau would understand the law’s intent, and take care of the isolated incident internally, with a specific policy directive.

(An ocean of ambiguities in the regulations of the income tax is the reason that there’s yards of case law ‘clarifying’ them.)
