Ariz. Gov (Brewer) Calls Ruling "Temporary Bump" (Will Appeal)

PHOENIX (AP) - Gov. Jan Brewer says it's just a "bump in the road" that a federal judge blocked key parts of Arizona's immigration enforcement law from taking effect Thursday.

Brewer says she's disappointed by the ruling.

But she notes that it doesn't block a provision barring local governments from restricting the enforcement of federal immigration laws.

Brewer says the fight isn't over and that the state will soon appeal Judge Susan Bolton's ruling to the 9th U.S. Circuit Court of Appeals and to the U.S. Supreme Court if necessary.

In Brewer's words, "this fight is far from over."

I wonder how many other federal laws are currently being enforced by the states? There has to be quite a few from bank robbery to drug trafficking. Perhaps this ruling should be fully applied and the states should simply leave enforcement to the feds. If its a violation of the supremacy clause to enforce this statute, then it would be a similar violation to enforce all other co-concurrent statutes.

It’s temporary. But the final ruling? Will be the same.

Then it goes to the 9th Circuit. Then the Supreme Court.

As a 30+ year resident of AZ I can tell you that most
Arizona Citizens have learned to ignore the Feds a long
time ago.

The people of Arizona have ways of getting things done.
Be sure to vote in November.
Obama is just a flash in the pan. Everything he thinks he's getting done will be rescinded and repealed.

I think her confirmation 10/3/2000 was by unanimous consent. At least the Congressional record reports it mentioning any vote. Thus JD can try to tie the judge’s decision to McCain confirming her. Dang rulling class always wants the credit, but never the responsibility for their actions. Tar them together, JD, and let the voters bring the feathers.

He has forbidden his Governors to pass Laws of immediate and pressing importance, unless suspended in their operation till his Assent should be obtained; and when so suspended, he has utterly neglected to attend to them.

What AZ is doing is known as concurrent enforcement: a person can only be guilty under state law if guilty under the federal law.

Correctly, the Lefty black-robed clowns at the 9th Circus Court of Appeals – the most overturned court in the system got it right and has gone along with that concept.

1st Circuit Court of Appeals - Estrada v. Rhode Island upheld Rhode Island procedures, reasoning that, in Muehler v. Mena, the Supreme Court “held that a police officer does not need independent reasonable suspicion to question an individual about her immigration status…

And the USSC - De Canas v. Bica (1976): States may enact legislation to discourage illegal immigration within their jurisdictions.

Bingo. Brewer must be stunned by the lack of judicial objectivity here, and she apparently knows little about the 9th Circus.
