Statement on Elena Kagans Confirmation to the U.S. Supreme Court
Wayne LaPierre, Executive Vice President, National Rifle Association & Chris W. Cox, Executive Director, National Rifle Association-Institute for Legislative Action
Today, the U.S. Senate confirmed Elena Kagan to the highest Court in the land. To NRA members and gun owners nationwide, Ms. Kagan presents a clear and present danger to the right to keep and bear arms. Her political record reveals that she does not believe the Second Amendment guarantees a fundamental right and, in her recent testimony, she refused to acknowledge respect for the God-given right of self-defense. That is why, more than a month ago, the NRA announced its strong opposition to Elena Kagans confirmation to the Court. In that announcement, it was made very clear that this vote matters and will be considered in the NRA's candidate evaluations.
The U.S. Supreme Court has affirmed that the Second Amendment guarantees a fundamental, individual right that applies to all law-abiding Americans. Nonetheless, during the hearings Ms. Kagan refused to state her support for the Second Amendment, saying only that the matter was "settled law." When asked about the Heller decision, Justice Sonia Sotomayor used the phrase "settled law" repeatedly during her confirmation hearings to win support. Justice Sotomayor then worked to destroy the Second Amendment in the McDonald case. We have no doubt that Ms. Kagan shares the same view of the Second Amendment.
Since she has no judicial record, we have only her political record to examine. And that political record demonstrates a clear hostility to our right to keep and bear arms. As a clerk for Justice Thurgood Marshall, Ms. Kagan said she was "not sympathetic" to a challenge to Washington, D.C.s ban on firearms. As a domestic policy advisor in the Clinton White House, a colleague described her as "immersed" in Clintons aggressive assaults on the Second Amendment. As U.S. Solicitor General, Ms. Kagan chose not to file a brief last year in the landmark McDonald case, thus taking the position that incorporating the Second Amendment and applying it to the states was of no interest to the Obama Administration or the federal government.
The expansive support that self-defense laws, the decisions in the historic Heller and McDonald cases, and the Second Amendment enjoy from the American public is a clear indication that Elena Kagans radical views are out of the mainstream. Any nominee, that far out-of-step with the American people, should not be on the Supreme Court.
The nomination and confirmation of two justices with an inherent bias against the Second Amendment is a direct assault on our treasured freedom. The fate of our Second Amendment hangs perilously - by one vote. The need for eternal vigilance on the part of every American has never been greater.
Yah... so, you jest keep supportin Dingy Harry, there Wayne...
They announced their opposition to Kagan once the Senate Judiciary Committee hearings were done over a month ago.
IIRC, Judd Gregg is retiring. Lugar and Grahamnesty should be primaried. Collins & Snowe could be primaried, but the result might be a rat winning in the general election.
Yeah LaPierre, Harry says she’ll be a great justice like Sotomayor. Go Ahead Make My Day says Dingy Harry
I have made(as per)a BRILLIANT deduction! If you look at her photo(upper lip/up),she’s a dead ringer for Bob Costas!
Or the Waynes Wold guy ( mike myers.
Harry's no sure bet. Check the link in comment# 18.
The only upside I can see to this debacle is that we won’t have to wince at any more staged photos of `Butch’ in a tight dress and stilt heels, crossing her leg left ankle on her right knee like an NFL linebacker.
That was awkward for everyone.
A Saturday Night Live butt-hole is a US senator, a muslim Marxist is president and a bull dyke is a Supreme Court Justice. To paraphrase Maggie Thatcher, they’ve run out of our money.
This country is so screwed.
Are you “raining” on my leg, everdem? Wayne’s lips were vapor-locked to Harry’s skinny a** at the dedication of that NV gun range.
The Senate in this Congress has had four 2nd Amendment Votes, IIRC, Kagan and Sotomayor were party line votes with the exception of Nelson from Nebraska today. The Coburn Amendment for concealed carry in national parks passed. He did that trick once with the Thune Amendment for reciprocity of concealed carry privileges amongst the states. What did I forget?
No. Let's just wait until the ratings come out, and see if they endorse Reid.
And Fancy Grahamnesty, or Lugar or any of the Dems who voted for her?
“Party leaders need to oust the 5 rinos who voted for this troll.”
Before that can happen the “party leaders” need to be replaced with real Republicans.
The same Harry Reid that voted for Kagan? Both of whom by the way are anti-Second Amendment clowns.
Harry Reid is no supporter of the Second Amendment. He’s running for re-election and he won’t get re-elected running as a anti-gun freak in the state of Nevada. That day at the LV gun range was a photo op.
It is not if you fumble it is when you fumble.
It is interesting to see how many FReepers fell for the liberal-planted story that the NRA was going to endorse Reid.
I thought conservatives were smarter than this.
