Therein may be the point of contention between you and other Freepers on this thread. You seem to take the position that the judge is bound totally by the law. That is the invalid (and actually impossible to actualize with any semblance of reality) theory of Legal Perfectionism.

Legal Perfectionism was addressed by the ancient Greeks, who agreed that the ideal was for law to deal the same with all men all the time.

However, it was agreed that the Greek city/state was too large and complex for such laws to be possible.

Therefore, they relied upon human judgment. Judgment, as in the activity of judges.

Had Judgie Pooh not been a black Liberal who was doubtlessly a legal perfection practitioner, we might not be discussing core legal theories.

Perhaps a coffee break is indicated? I have difficulty understanding how you arrived at the implication that other posters considered Justice Thomas to be unqualified?

Judges are, after all, best judged by their decisions. As far as I read, the other posts disagree with the decision, not the judge’s melanin level.

According to the statistical racist to whom I replied, a picture of a black man is sufficient to determine his lack of qualifications -- because of statistics, you see. A more perfect example of racism would be difficult to make up. The picture of the "unqualified" Justice Thomas was added to drive home how abysmally stupid that poster's comment was.

And a different idiot said that the picture was sufficient to demonstrate that Judge Jackson was an "imbecile." The poster who said that is a damned fool, as well as a racist.

According to the article, the judge several times challenged the prosecution to demonstrate -- beyond arm-waving -- that what these guys did was "piracy," according to the Smith decision. The relevant statute dates back to 1819.

Hmmm, sounds like the judge gave the prosecution every opportunity to turn this around and let him keep the piracy charge in play. Perhaps an argument can be made that the judge erred by making the Smith decision the "controlling legal authority" but the prosecution could have made the case for a better precedent. Again, we have the prosecutors snatching defeat out of the jaws of victory. Inept prosecution seems to be the norm these days.
