Supreme Court Justice Breyer Open to Banning Koran Burning

U.S. Supreme Court Justice Stephen Breyer has expressed a willingness to ban protesters from burning the Koran as the modern day equivalent of shouting fire in a crowded theater.

The Supreme Court has ruled burning the American flag in protest is protected speech under the First Amendment of the Constitution.

Breyer spoke to George Stephanopoulos on ABC's Good Morning America today:

But Supreme Court Justice Stephen Breyer told me on "GMA" that he's not prepared to conclude that -- in the internet age -- the First Amendment condones Koran burning.

“Holmes said it doesn’t mean you can shout 'fire' in a crowded theater,” Breyer told me. “Well, what is it? Why? Because people will be trampled to death. And what is the crowded theater today? What is the being trampled to death?”

Breyer is promoting his new book, Making Our Democracy Work.

Breyer was appointed to the Supreme Court in 1994 by President Bill Clinton.

If it wasn't so pathetic and sad, it would be funny. How many years have we witnessed every piece of religion moved from the public square?

No more Christmas pageants or choral programs at schools
No praying in school
No Christmas displays in the public square
No mention of Thanks to God or Jesus Christ during a graduation ceremony
A portrait of the Virgin Mary covered in cow dung in a museum is protected as “free speech”

If Breyer had his way the Koran will be protected by SCOTUS?
He is so wrong. Burning the Koran does not incite violence anymore than burning the Bible incites violence. The violence is self incited.

I am sure Stephanopolus asked Breyer if the REAL issue is the lack of self-control on the part of the herd?

There it is again. Obama used that phrase the other day too. It struck me odd he appeared to blame the internet, when it was cable news that really kept the story alive all through August. Wouldn't have anything to do with them want to take over the internet...........nah.

So I guess kicking the shiz out of anyone burning a flag is a way to get The Court to ban it, according to this logic. Somehow I do not think this is what was intended, The Constitution is not supposed to morph with public opinion, it is amended by a 3/4 majority of The People’s representatives.

The internet has been around since the late 1960s. I’ve been online since the mid-1980s. Websites have been popular since 1995.

Hard to call this “an age” now worthy of special considerations of the Constitution.

Islamists live in the 8th Century. ANYTHING more modern than that is a “modern age” to them.

They are intolerant of other faiths (Saudis burn Bibles and kill non-muslims who dare enter some of their segregated cities) and do not recognize the laws of other nations (like the United States’ freedom of speech and freedom of religion including being CRITICAL of a religion).

Where are all of those who demand that religion be behind closed doors today?

I was merely reinforcing (agreeing with) the point made about Breyer being off-base bringing up the "fire in a crowded theater" analogy. There is nothing in the Constitution specifically that prohibits you from doing so. But if you do so with malicious intent and harm befalls anyone or property loss occurs as a result, you are subject to criminal penalties. Criminal acts fall under the purview of criminal law.

The courts have interpreted free speech quite broadly, as we all know (e.g., flag burning). That a Justice of the USSC would fall into the PC trap of placing Quran burning beyond the reach of similar interpretation is pretty sad. We had a local story about a guy burning a "Rainbow Flag" (who could be against rainbows?) on Gay and Lesbian Pride Day. Think the ACLU stood up for his free speech rights? Fat chance. They wanted to get him for a "hate crime", but I think all they pinned on him was an illegal burning rap (no permit to burn).
