As an employer, I’ve seen my share of Social Security mismatch letters over the years. For those who don’t know, if you’re an honest employer and send in tax withholdings to the government, the SSA used to (they haven’t sent them out in a while) send out a letter notifying the employer that the SSN that they have doesn’t match the name you’re sending in taxes for. THEY KEEP THE TAXES, but they warn you to look into the discrepancy.

Here’s where it gets confusing. Some labor law attorneys say that the employer’s responsibility is to inform the employee of the discrepancy and have them look into it. If the employer receives a letter the following year, they inform the employee of the discrepancy and have them address it with the SSA. If they receive a third letter, they are told to terminate the employee.

Other labor law attorneys say that you have 90 days to address the discrepancy. There are conflicting stories you get from the attorneys, but essentially an employer is not allowed to treat the mismatch letter as a grounds for termination. In fact, I’ve had at least two native-born Americans receive mismatch letters. One was because of a misspelling of a name on the paperwork and another was an SSA error.

In other words, don’t throw Meg under the bus just yet. The law is tilted in favor of the employee in these cases. Meg filled out the required forms (albeit with forged documents provided by the employee), paid her above market wages, properly withheld and sent in the required taxes, and when informed of her illegal status, terminated her. It’s not like she had a housekeeper that she paid under minimum wage and paid her under the table. Meg paid her above market wages and sent in tax withholdings. She went above and beyond what most people hiring domestic help in California would have done.

This will backfire on the Dems. If it came out 5 days before the election, maybe not. But they pulled the trigger on this way too early. The electorate are sick of the lies and the games. They’re ready for change, and Jerry Brown isn’t change.

Did you hear her on Levin tonight - ugh? As for the maid, she falsified her SS# - so she committed crime over crime. Dunno if the Whitmans knew, or were simply sloppy. In any case, they paid her very well.

So it comes down to gotcha politics by the RATS. Course the RATS are just fine with 5 or 10 tax evaders taking all kinds of high positions. Then we find out Murray’s farming out tax payer’s hard earned monty to her lobbyists. HYPOCRITES.

Taking a step back here, I have a basic question to ask. Does it make sense for us to expect individual citizens and small businesses to determine whether someone is here illegally or not? Wouldn’t it be more efficient for some large entity or entities to make this determination? Maybe the federal government could do this for everyone?

Meg Whitman is what she is. She may be some or all of what you say and she’s still spades better than the RAT earth to Moonbeam.

The best way past a “scandal” for a Republican is through it. Take a day or two - no more, no less - to think it through, find a line of attack and go on offense. If George Allen had done that instead of trying to plead, ignore and then cower his way past the “macaca” incident, we’d not have the tragedy of both Senators from the Commonwealth of Virginia being Democrats.

On the latest so-called “scandal!” and “controversy” that has all the political talking heads in California running around screaming at the top of their lungs i.e. Meg Whitman’s illegal alien former housekeeper; if I were advising Whitman I’d tell her, apart from her offer to take a polygraph test, to call a Press Conference, and go on offense. I’d tell her to pound on the following points;

The writing on the letter is not her husband’s. Period. He says he didn’t write it because he never saw the letter. If he had, and gone as far as to write instructions on it for Santilla, he would have discussed it with her.
Obviously then, Whitman’s husband’s handwriting was forged. As a nine year employee, Santilla would certainly be familiar with it and may even have legitimate correspondence from Dr. Griffith Harsh (Meg Whitman’s husband) as a baseline for the forgery.
The Whitman campaign demands the original copy of the letter for forensic dating to determine the time when the letter was actually printed and the time the supposed note by Whitman’s husband was written.
Since neither Whitman nor her husband saw the letter, how did Santilla get a hold of a letter from the SSA to Meg Whitman and her family? This suggests a crime on the part of Santilla (intercepting mail) and Allred aiding and abetting after the fact.
Gloria Allred has made a disgusting habit of popping up in the last weeks of a campaign to level false allegations against Republican candidates in a bid to torpedo their campaigns. She did this back in 2002 when she tried to derail Arnold’s election bid with false sexual harassment charges and she’s doing the exact same thing now. Why is she being granted any form of legitimacy knowing that this is what she does?
To the Press; is she supposed to employ illegal aliens? Is that not illegal? What exactly is Allred and the press corps’ complaint? Are they really complaining that Whitman failed to do something that went against the law? Furthermore, an employee lied to her about her immigration status with false papers, obviously intercepted mail between her and the SSA - when she discovered it, she let the employee go; where’s the “scandal” here?
I repeat; for Republicans, the best way past a ginned up “scandal” or “controversy” is to plow straight through it - not trying to move on past it or hoping it goes away. Democrats can do that. Republicans can’t. Republicans have to up the ante and go on offense.

Force the partisan hacks calling themselves journalists and trying to make it a “scandal” defend why it is a “scandal.” Attack their decisions on the legitimacy of the issue. I guarantee that by the end of the week it’s on page B53 on its way to an ignoble death before it ends up torpedoing the Democrat’s chances.

I couldn’t agree more with your synopsis.

Our attorneys on retainer consists of an office of 2 partners, and over time, they’ve had a couple other guys there. When even they can’t agree on the tax laws, there is an issue. Now, don’t even get me started on each of our counties laws, and then you toss in each city and municipality, not only on taxes, but on immigration, and its mind boggling.

The only purpose it serves, is to keep lawmakers and lawyers employed.

Good post. Makes the situation clear.

It may not mitigate my opinion of Meg Whitman, but it does clear up what her options in fact were. I'd be "too busy" to deal with it too if my array of options looked like that.

You guys, it’s nice that you all want to help defend someone who is wearing your team colors (Republican), but Meg Whitman is not one of us. She never voted in her life before recently, has spent over 100 million dollars to buy this race, has put campaign ads supporting amnesty into Spanish while opposing it in her English ads, and is probably lying about not knowing this maid was illegal. After all, why should she care back in 2003 - she wasn’t running for office then.

BOR showed a clip of ‘Niky the maid’ on his show last night. Her face was scrunched up like she was crying and acted like she was crying while she was reading comments off of a piece of paper. She then was wiping her face w a tissue. Maybe it was the angle of the camera (though it was a fairly close-in shot), but I didn’t see any actual tears.

Bill did also mention that if the maid was that upset about the ordeal, why did she have to read from the paper - - if he had been that upset, he would have been able to tell his story w/o reading - just expressing it from the heart. I’m not that fond of BOR most of the time, but I thought that was an interesting point.

It’s also interesting to me that Gloria, just like Chucky Shumer, never met a camera she didn’t like, hasn’t been on any of the FNC shows that I’ve seen, but has resorted to going on radio shows (Hewitt - she hung up on him) and Levin (he blasted her) - threads on both of them are on FR.

FACTOID Meg hired the woman thru an agency which was compelled to verify her status using background checks, etc. The border-jumper (1) falsified documents, (2) used her sister's ss no, (3) stole US mail (federal offense), (4) hid the SS letter for years (obstructing justice).

The illegal border-jumper filed falsified documents among several federal crimes.

Therefore, by defending the illegal, Allred, an officer of the court, is aiding and abetting several felonies.

FACTOID A lawyer must bring a case to court with "clean hands"....meaning no laws were broken in the effort to seek jurisprudence.

today, the Whitman regime attempted to connect Alred with Brown by political association in the distant past .

Weak move IMO, we all know this is just a political move to win the mexican vote and the charges won't stick.

Witman needs to stop backing up on her heels and flip flopping like a skary kerry trying to please everybody or she's gonna lose bigtime,

Meg should have hit the buy it now button, stupid stupid move not to send the nanny off without a lexus, a house in the valley and the promise of monthly payments as long as the cakehole stays shut

it doesnt matter, the allegation is enough, if Meg stirs up the hispanic hornets nest, there could be busloads of illegals in line at the county recorders offices statewide to cash in on the “early voting” provisional ballot giveaway
