$11,000 fine, arrest possible for some who refuse airport scans and pat downs

The Transportation Security Administration (TSA) is warning that any would-be commercial airline passenger who enters an airport checkpoint and then refuses to undergo the method of inspection designated by TSA will not be allowed to fly and also will not be permitted to simply leave the airport.

That person will have to remain on the premises to be questioned by the TSA and possibly by local law enforcement. Anyone refusing faces fines up to $11,000 and possible arrest.

"Once a person submits to the screening process, they can not just decide to leave that process," says Sari Koshetz, regional TSA spokesperson, based in Miami.

In all this debate I see something that makes me think freedom is going to win and this will not stand. I’ve been reading FreeRepublic for years and I also read the DU forum. Normally the opinions are polar opposite.

I have NEVER seen an issue generate the same common reaction on both boards. The spirit and the content of the anti-TSA posts are almost identical. That is amazing to me.

This is a defining moment for our country, when the government has overstepped it’s authority to the point that people on the left and right are outraged. Anyone who cares about freedom should recognize it is time to defend it or lose it.

I think the best question to be asking is “Where does it end?”.

Apparently, there will be no end to it that we could ever morally accept as the “new normal”.

We can’t carry on as though gross error in the name of an “abundance of caution” or to “err on the side of caution” is the way it has to be.

Does the TSA’s quality assurance and continuous improvement program include the “voice of the passenger”? Does the TSA even have a quality initiative?

Of course, if you are able to pay a fine of $11,000, you will have tripped the $10,000 threshold for further investigation and for failing to declare you are traveling with that much cash. Additionally, it might be seized as terrorist or drug money, with the burden of proof on the person with the cash to prove it was theirs. If not performed, they could probably seize everything you own based upon the same drug and antiterrorist laws.

Excellent point regarding the ridiculous laws regarding money. I'm sure that we've seen the tip of the iceberg here regarding "travel laws" .

What would TSA do if every passenger showed up in Burkas and carrying Muslim prayer beads and a copy of the Koran?

Then approached, by a TSA agent, you say “My name is Jose Maria Mohammed, and I am a cross gendered new Muslim. Any attempt to pat me down or force me into the scan will be a big violation of my rights and privacy!”

I don’t understand where the constitutionalists are on this as an abridgement against the 4th amendment. We all want security, but these gestapo tactics to get people to comply to humiliating procedures is dangerous to our liberties. You’d think the ACLU would be on this, but....guess since it’s a Democratic administration pushing it, they’re not rocking the boat. If a Republican administration was pushing this they’d already be in court.

The new procedures & scanners raise an interesting issue:
You are now forced to either a) submit to a scanner that will transmit pictures of your naked-body* to parts unknown OR b) submit to a highly invasive “security” ‘pat-down.’

{*Or, to be more accurate, highly-accurate computer-generated reconstructions thereof.}
Given the above, can I forgo both the pat-down and the voyeuristic scanner if I remove all my clothing prior to entering the TSA checkpoint?
If so, would/could I be prosecuted for “indecent exposure”?
If a small child were to enter the invasive scanner, would the operator at the other end be a felon for possessing child pornography?

The American Civil Liberties Union of New Jersey said in a press release they will stand alongside legislative leaders from both sides of the aisle to support a resolution asking the United States Congress to review new TSA screening procedures at airports that violate privacy, and provide little in the way of security enhancements.

“This technology involves a direct invasion of privacy,” said ACLU-NJ executive director Deborah Jacobs, “It produces strikingly graphic images of passengers’ bodies, essentially taking a naked picture of air passengers as they pass through security checkpoints.”

The ACLU maintains that the likely effectiveness of such a technology in preventing attacks does not justify the level of intrusion involved.

BOYCOTT FLYING, and let them stand in the unemployment line like everyone else...I will NOT get on a plane or vist an airport, period! As long as cars are available, or trains, there will NOT be one penny paid for this unbelievable invasion of privacy.

When are the American people going to quit complaining and take action! Stand up! Do meetings by online, and stop giving in, if we take a stand agains this molestation by not buying tickets, then the airlines and congress will change their ways, or starve.
