Yet another unanticipated fastball has been hurled directly at the radical lefts destructive agenda. It is called the Repeal Amendment. Brainchild of Georgetown Constitutional Law Professor Randy Barnett, the proposal has gotten legs with the help of Florida attorney Marianne Moran, Executive Director of RepealAmendment.org.The proposal calls for a constitutional amendment that would allow the states, by a two-thirds majority vote, to repeal objectionable federal legislation and regulations. Virginia Representative Eric Cantor, slated to be Majority Leader in the upcoming Congress, has gotten behind the movement, as has Virginias governor, and lieutenant governor, leaders in the state legislature and Virginias Attorney General Ken Cuccinelli. Cantor articulates the justification well:

Consider that laws, especially amendments, have two sharp edges that cut both ways. Take the time to consider how such a law would be applied in CA or MA, where the insane are in the majority.
THANKS for posting this link. I immediately forwarded it to friends.
Once again this is a stuip idea that I don’t think I could support: The tenth amendment already covers this, what we really need is an amendment limiting the courts to rule in an originalist way, and making it easier to impeach them.
J.S.
I’m all for this, I will never quit fighting these despots.
But it’s too late for this method to work.
This will incite more [illegal] edits and behavior by the Feds. I am of the opinion that the current new levels of intimidation by DHS and TSS are directly related to the Nov election results. They are going to show us who is boss.
Each new (legal and proper) attempt by the people to shrink the Federal monster will be met with more repression by bureaucratic agencies that make their own laws without congress.
Bet on it.
Yes, but does congress follow 10th amendment?
Repeal the 17th amendment.
the obottoman empire must be crushed !!!
Thank God our freedom and our future just may be saved from this Regime and the RATs and RINOs in Congress and any other political tyrants and/or traitors. You know their names!
Something we've been calling for on FR since the beginning...
Bad, bad, bad! We do not want a Constitutional battle at this time in this country! It’ll open the door to all kinds of tweeking with our Constitution.
Great idea! Until it gets handed over to the SCOTUS and it will be SSDD all over again.
What we really need are gallows. Lot’s of ‘em.
Too bad we need an Amendment to support the existing 10th Amendment.
If Virginias Attorney General Ken Cuccinelli is on board - count me in. He would make a great President.
He is like Sarah or Michelle Bachmann in a suit. ;-)
Ken C gets in the face of the libs. I sure wish Christie were more like Ken.
Well, the states where the leftist residents wish to live in a leftist world, then I suppose let them if that’s what they think they want (since you can’t stop them anyway). The producers will eventually leave the state for a saner residence, the non-producing leftists who are left will find that the emaciated money sow in their state government will eventually dry up - and then, good luck to ‘em.
the Spirit of the Lord is moving in a mighty way in this nation as He has heard the prayers of His people and is answering.
I say go ahead and let them become ecotopia, homoland, or east germany. That would clear out the minority of idiot termites chewing away at the foundations of states that are still somewhat sane by giving them a beacon to home in on. It would also give the people that actually have some common sense and decency, but live in nuthouses, places to go.
Its going to be much easier for the states to repeal onerous liberal laws and regulations than its going to be easier for the state to repeal conservative laws and regulations they don’t like.
As far as CA and MA are concerned, there are far more red states than blue. If it could be limited to this amendment and no further tweaking, this could restore the “Republic” and counter the “democratic” trend of our country. It is the progressive bendt of the populous urban blue states that is finding its majority voice in Congress. It is these areas that like big government largess and embrace the collective over the individual. Such an amendment might even counter the expansion of the Commerce and treaty clauses that have created a top-down government and reduced our states to mere implementing tools of federal legislation in broad areas.
i don’t like it. What if california decides to repeal freedom of speech to keep people from criticizing al gore’s stupid ass global warming bullshit?
What if new york decides to repeal right to due process when applied to women’s rights issues? ie, if you are accused of stalking, you go to jail without a trial? or if you say something critical of gays?
This is an amendment that I support.
Yep, I ripped John Conyrn, my Senator, a new one for his sponsership of net neutral and helping the RINOS.
btt
Like that will ever happen.
But I like the idea. Removes states with high density populations from over powering the other states.
“Yep, I ripped John Conyrn, my Senator, a new one for his sponsership of net neutral and helping the RINOS.”
I didn’t realize he was had sponsored net neutrality. I don’t know about you, but I’m getting real tired of having to call his office constantly and berate his anti-conservative boneheaded moves. First he’s for getting rid of the anchor baby law, then he goes to Uvalde and backtracks. That’s just one in many. His time has long been up, but we’re stuck with him until 2014. If we can get rid of KBH in 2012, it might scare the daylights out of him.
Repeal the following Amendments and institute these:
1. Repeal the 16th (Income Tax) and 17th Amendment (Direct Vote of Senate)
2. Repeal the 26th Amendment (Voting Age Set at 18)
3. Set a Balanced Budget Amendment
4. Pass a State Repeal Amendment
5. Repeal Obamacare
6. Make Abortion Illegal Amendment (Right to Life)
Then they would need 2/3rds of the states to agree with them.
The Constitution itself would stay intact. This only applies to legislation and regulations forced on us by the Federal government.
Go back and read the fourth sentence of the article.
2/3rds of the STATES legislators would need to vote to repeal the laws, not the citizens.
Yeah, in reality, that would be the better way to approach this. But if you’re going to that trouble, throw this in as an added safeguard that will prevent those whom the state legislators send to represent them in the fedgov partake in usurpation.
The Constitution has already been tweaked beyond recognition by the courts and the executive branch. We have nothing to lose.

It’ll be breaking news if and when an amendment is ratified. Until then it isn’t.
Yep, there was a list of the co sponsors here on FR a while back.
He needs to go especially due to the fact he helped RINOS and not conservatives win 2010.
I’m getting real tired of what the States can do. You fools, do it. Start the ball rolling and while your at it, work on impeachment for our communists black Muslim leader.
Spread the word viral over the Internet while we still have that freedom that they’re trying to take.
Agree with your post, and because of the Liberal City, the Liberal Judge, the liberal jury foreperson, the majority Democrat Jury, the timing in which the Judge disallowed a delay until after the four day Holiday I believe a message, a threat was sent to the GOP, to the TEA Party, to the Conservatives by the verdict in the Tom Delay case in Texas.
Acquitted of every other of the trumped up charges against him this verdict stinks of collusion, of tampering, of influence.
It appears a threat to us, to our people going into this new Congress to me.
Hot Damn.
Not too sure this one makes a lot of sense. Keep in mind that this could cut both ways...
It’s time to take back the country. This might not be the way to start.
California will become a Hippie Wasteland.
America was created by and belongs to God.
