There is zero moral force for any American to obey administrative agency regulations. If our Congressmen did not pass a bill, and the President did not sign the bill into law, it ain't law. Absent that, there is only coercion and fear of retribution to force compliance. Welcome to tyranny.
Congress has delegated regulatory authority to the Executive. This is practical and legal. Army Regulations, for instance, derive from the Uniform Code of Military Justice (UCMJ) which is public law, passed by Congress and signed by the President.
Yes, it has. It is an illegal delegation. The sovereign people granted certain legislative powers to Congress. Congress was not given authority to assign those powers. Imagine if you gave certain powers of attorney to someone and that someone gave them away without your permission. You would be very angry, and would revoke the power of attorney.
As for the UCMJ, Congress has Article I Section 8 power to make special rules for the land and naval forces.
Florida recently enacted law that requires state agencies to obtain legislative approval for any proposed regulation that could cost more than $1 million over five years. It should be a model for the feds.
