"We've said here before that the Republican cast of presidential characters for 2012 isn't very exciting. The GOP, we've said, may have to reach down to the next generation to find a candidate who can wake things up, and we've suggested Marco Rubio, the new senator from Florida.
Now, Rubio may be making his move. From The Politico:
With a landmark spending debate engulfing Washington, the Florida Republican has, virtually overnight, launched the national profile the conservative movement has been clamoring for.
During his first national interview Monday, Rubio pounced on President Barack Obama — from the friendly confines of Laura Ingraham’s conservative radio show. He blasted a statement to the media, pledging to vote against the Republicans’ short-term spending resolution and calling it a “nickle-and-dime” approach. And he’s vowed to vote against everything that comes through the Senate unless it deals with addressing the $14 trillion debt crisis. ...snip... “Marco Rubio says, ‘What is this continuing resolution crap? I didn’t come in here to fund the government every two to three weeks, and $6 billion here and $6 billion there. What the hell is going on here?’”

I sure wish the writers of the Constitution had taken an extra minute and actually define the term "natural born citizen"!

Jindal is not eligible to be President as he is not a natural born citizen. He was born four months after his folks moved to the U.S.A. They were still citizens of India.
We have a Constitution and we either follow the law or rip it up.
Too many people flaunt laws that they find inconvenient - the Democrats saw Obama as a terrific opportunity to control the whole government. They know he isn’t eligible. Governor Richardson of New Mexico even said in a speech, in Spanish, that Obama is an illegal alien.

Citizens engaged in military duty have traditionally been considered ELIGIBLE. Period. It makes NO difference whether he was born on base or in another hospital in Panama. It was the duty position of his parents. As a military wife, I assure you this is true... although you can get the same assurance from *official* sources if necessary.
I would not want McCain as president but he is most definitely eligible.
If Rubio's Cuban immigrant parents were not naturalized U.S. citizens at the time of his birth, he is NOT eligible for either the office of president or vice-president.

Nope. McCain was born in the city of Colon, Republic of Panama. He is a citizen-by-statute because his parents were both U.S. citizens. American citizens born in Panama know this, and several have posted on Free Republic to report that fact.
The Senate had a dog & pony show supposed to make it legit for Sen. McCain to be Prez - but you can’t alter the U.S.Constitution that way. Any proposed changes must be approved by the States and is usually quite lengthy.
Not so Randita. Satindoll is quite an authority on the topic, and so was Chief Justice Morrison Waite who said, in his decision for Minor v. Happersett (1874):
“The Constitution does not, in words, say who shall be natural-born citizens. Resort must be had elsewhere to ascertain that. At common-law, with the nomenclature of which the framers of the Constitution were familiar, it was never doubted. that all children born in a country of parents who were its citizens became themselves, upon their birth, citizens also. These were natives, or natural-born citizens, as distinguished from aliens or foreigners.”
I could quote a dozen other authorities, but you can find them in rxsid’s thread on natural born Citizenship, or at Mario Apuzzo’s site, or find The Venus, Minor v. Happersett, Perkins v. Elg, Wong Kim Ark (noting that Horace Gray sites Waite's definition).
Were Rubio to run, it might be interesting to see the discussions when conservatives who have read the framer's essays and SCOTUS cases reject Rubio, enough as to deny him the candidacy, to see what the Democrats would do with Obama? This time Republicans will have become aware of the definition becuase it will affect their candidate. Would some Republican then bring the challenge which the RINOs would not bring because McCain's natural born Citizenship is suspect?
I say, bring on Rubio, or Jindal. The Democrats couldn't say a word. The Dems would then trot out Hillary. That could lead to Hillary v. Bachmann or Hillary v. Palin.
The only way to make Rubio, if, as we suspect, his parents hadn't naturalized before he was born, would be a constitutional amendment. Would Democrats support an amendment which would permit the charismatic Rubio to run? They wouldn't even attempt the amendment McCain needed; they tried a law, SB 2678, “A Bill to Make Foreign Born Children of Military Citizens Eligible to be President”, sponsored by McCaskill and Obama, in Feb 2008. They knew it would have no effect, since only an amendment can change a provision of the Constitution.
Obama’s father is exactly why he is not president, except in the mainstream media. He is in the White House in clear violation of Article II Section 1, defined, as are most all other terms used in the Constitution, by our common law, as Morrison Waite explained in his decision.
No one is altering the Constitution NOR the military tradition of this great nation....NOR 8 USC 1401(c).

A natural-born citizen according to 8 USC 1401(c): “a person born outside of the United States and its outlying possessions of parents both of whom are citizens of the United States and one of whom has had a residence in the United States or one of its outlying possessions, prior to the birth of such person.”
Without any other court ruling, citizenship must be presumed.
AND... the normal legalese notwithstanding....it is ordinary common sense. Why would military personnel be denied their rights....simply for obeying orders to be stationed in a location deemed necessary by the U.S. government?
I’m not sure the basis of your assertion that “natural born citizen” = “born in US of US citizen parents.” This definition is not in the Constitution and has never been reviewed by in the Supreme Court. The practical definition is “born in the US to parents that are legal residents of the US (citizen or not) OR born anywhere to parents who are US citizens.”
I’m open to correction, if this isn’t precise.
