Sheriff releases video of SWAT shooting into house of ex-Marine

The Pima County Sheriff's Department released a video Thursday that shows a SWAT team shooting into a suspect's house. He died after being shot 60 times.

Jose Guerena, 26, was shot and killed May 5 when Pima County authorities served a search warrant on his home.

The Sheriff's department says five SWAT team members fired more than 70 rounds in less than 10 seconds after the former Marine pointed an assault rifle at officers. His wife contends the family thought the officers were robbers. He was shot 60 times

In statements made to detectives after the shooting of Guerena, one deputy stated he opened fire after seeing a man pointing a rifle in his direction. He said he felt his own life and the lives of his teammates were in danger when he opened fire.

He was unsure how many bullets he fired.

Another officer stated he kept shooting “until his weapon ran dry” that is he ran out of bullets. He said he saw a muzzle-flash, and thought one of the officers had been hit, when he opened fire.

The big question still remains unanswered. Who fired the first shot?. Was it Guerena or a SWAT team officer? Did Guerena fire at all?

All of that is still under investigation at this hour. Sheriffs officials have declined to comment. The sheriff says he will release a statement, at a later date when he has more information to share.

How come Dupnik’s lawyer said they knocked for 45 seconds??? Is anyone telling the truth anymore??? Anywhere in the gubt?

No, there is no question about who fired the first shot. Mr. Guerena’s rifle had the safety on. And, the SWAT team did not allow medical first responders into the house. Mr. Guerena bled out.

That's not the big question. The big question is why do we have paramilitary organizations committing urban warfare against our homes? The burden of proof that we have a MAJOR drug dealer/terrorist/known suspect in a high felony such as murder/rape. We must know the ADDRESS. We must have high level of certainty that the perp is there and civilians are few if any. That should be minimum qualifications before even getting a warrant.

Arguably, this Marine was not prepared to save himself. He did, however, save his family. These killers need to be hauled in front of a Military tribunal.

Yeah, this wasn’t a “THIS IS THE POLICE, WE HAVE YOU SURROUNDED, COME OUT WITH YOUR HANDS UP!” operation.

The brief siren sounds like a car alarm, I heard no loud verbal announcements, and imagine what you’d think, waking up and hearing a pounding at your door, your wife telling you that there are armed strangers outside, followed by a shot (door breaching), the door being kicked in, and masked armed men entering your home.

When they saw him with a firearm, they shot him to pieces.

This is a recipe for executing a perp or murdering a homeowner, strictly depending on if they get the address right and the tip isn’t bogus.

I bet Bin Laden got more of a chance to surrender than this guy got. I’m not saying he’s innocent of the crime that brought the cops to his door, that remains to be seen, but it looks like his only chance to avoid being shot full of holes was to abjectly prostrate himself the second they poorly identified cops started beating on his door, and that goes against everything the Marine Corps teaches you.

It’s disturbing at the very least, and if it turns out they went after an innocent man, it’s an outrage.

How could they have served a search warrant with all the shooting? Did any LEO actually knock at the door?

Court documents that show what officers were searching for in the case have been sealed and what was seized as evidence has also been sealed.

Why the secrecy?

Authorities say Guerena didn't fire a shot and his AR-15 rifle had the safety on.

Gosh, doesn't that make it sort of difficult to justify 70 rounds in less than 10 seconds?

The family has now hired an attorney, who's asking for records including radio communications, police logs and 911 recordings from that day.

To the family: GOOD LUCK and may Justice prevail!

I am strongly in favor of gun rights, but not that many people have a loaded AR-15 within reach when someone knocks at the door. So maybe this was a dangerous person. But even the worst criminal suspect has the right to a trial, rather than having an execution squad sent to his home, where his family also lives.

This case will end like 99.99% of other like cases. The thugs followed procedure. Bang bang you’re dead!

The reason for the search has been sealed by the courts. IOWs, coverup in progress. Before they are done, this Marine will be a child molesting, drug dealing, serial killer, and a threat to national security.

BTW, there is no such thing as an “ex-Marine.”

Apparently you are behind the times. It has been determined,and admitted to by the police, after several lies to the contrary, that the AR15 Guerena had still had on the safety and no rounds were fired by him. The stupid swat team didn't "serve a warrant" either, they broke his door down and gave every appearance of being criminals. This was murder pure and simple.

So, no, there is no big question, the question has been answered and these murderers need to be behind bars, along with the judge who issued the no knock warrant, a warrant, BTW, which has been sealed and blocked from public view.

The tape is heavily edited. I'd like to see the original. There is one version toward the end where you can hear them announcing themselves loudly.

Yep. The video sure shows a different version of the events than what Storie described. From the time they hit the siren until the last shot was fired was only 45 seconds. Unless Guerena had that AR just sitting around ready to roll (while he was asleep and his 4 year old was up wandering around) he must have been hustling. I can't say he didn't do it but this video makes version #5 of the cops story.
