This story should blow up huge. An iconic American company being hassled about wood, and being told to ship jobs overseas? This should be the GOP response to Obama’s speech—a brief telling of this story. The title of the response should be “All You Need To Know.”

I doubt his poll numbers will go any lower no matter what happens. There are liberals who will never abandon him and we know 95% of blacks won’t. They won’t vote republican.

an ill wind blows through this country. The federal ‘family’ in 2009 took Gibson’s property without charges. Valuable property necessary to conduct operations which Gibson now has to sue to get back. Where is the property now?

Henry Juszkiewicz, the CEO of Gibson Guitars, Inc. was on The Dana Loesch Show this afternoon. Gibson is under attack by the the Obama Justice Department for accusations that the company broke American Indian laws.

Juszkiewiz said the government suggested that the company’s use of unfinished wood from India is illegal, not because of U.S. law, but because of the Justice Department’s interpretation of a law in India. The Holder Justice Department raided at least two Gibson manufacturing plants this week forcing hundreds of workers off their jobs. Juszkiewiz says the company lost a million dollars this week.

Finally, Henry Juszkiewicz told Dana, “The Obama Justice Department wants us to just shut our doors and go away.” He says he will continue to fight for the Gibson company and its workers.

Juszkiewicz held a press conference yesterday in front of the Gibson headquarters.

The Obama Justice Department confiscated over $500,000 in materials back in 2009. Gibson is going to court on Monday to discuss a previous request for the government to return the property.

More… Gibson Guitar CEO: “We’re Being Targeted.”

Gibson is the only guitar company targeted by the Obama DOJ under the
Lacey Act.

Tennessee is a right-to-work state.

Guild, Ovation, and Hamer are in Connecticut;
Alvarez is in Missouri;
B.C. Rich is in Kentucky;
Heritage is in Michigan;

All are forced-union states.

Peavey is another guitar and electronics company, located in the
right-to-work state of Mississippi.

Since 2009, Peavey has been the target of multiple lawsuits filed by
a competitor, MUSIC Group, which alleges that Peavy products fail to
meet federal safety and emissions standards.

Sadly I doubt they would care, or know about it. If I didn't read it here I would not know about it.

I have been wanting to purchase a Gibson LesPaul for quite some time, I think I will bump that purchase up on the list.

I believe it depends on whether word gets out about the raid and demands. If the Republican Candidates are smart, they will shout it from the rooftop. There are some musicians out there (and I’m talking from the top tier to the coffee shop guitarists) that are die-hard Gibson fans. If they hear the truth (keyword, truth) they won’t be too happy with this attack on their Gibsons.

The conservative media is being played like a violin by Henry Juszkiewicz.

Gibson's press releases are carefully worded so as to be misleading at best.

Do we all still believe that the government's taken no legal action with respect to the Madagascar ebony raid? I don't. I've been reading the affidavits, pleadings, and exhibits in U.S. v. Ebony Wood in Various Forms, Case No. 3:10 CV 00747, still in the United States District Court for the Middle District of Tennessee, Nashville Division - including Gibson's own answers and motions. (And by the way, Gibson, I don't believe the answer of the German company involved in your purchase of the Madagascar ebony, saying that the government's seizure documents should be thrown out, because they referred to the pieces of ebony in Gibson's factory as "fingerboards," when, according to your cohort, the ebony could have been there to be used for "matchsticks or doorstops.")

And Henry? I've also read the affidavits and other documents involved in the recent raids on your factories in Nashville and Memphis involving East Indian Rosewood.

For the record, Henry, I don't believe the affidavits of government agents as the absolute truth any more than I believe the press release of a financially unstable company that faces economic losses and possible criminal charges for its officers. But when the affidavits give names, flight numbers, dates, street addresses, and contain the emails and interviews with a number of people, they start to become more believable - or at least the kind of things that are more believable than press releases that don't state any backup facts.

I was surprised to learn that the most recent raids started as a result of imports into the 'customs port' (by airline) of Dallas, Texas, involving containers that didn't have the Gibson name on them or any of the identifying paperwork.

Yes, the containers didn't have the Lacey Act paperwork. Yes, when opened, the description on the paperwork didn't match the Indian Rosewood contents inside. Yes, the customs work paperwork left the 'ultimate consignee' blank on some forms, listed a small (10-17 person) company in California on some forms, and on other forms, simply contained instructions to ship the product to another company (a warehouse) in Nashville and to call an employee of the company in California.

Yes, when called to complete the Lacey Act paperwork, the employee of the California firm then 'corrected' the paperwork to show Gibson as the 'ultimate consignee.'

And yes, when the government went to the warehouse in Nashville, they found another shipment of East Indian Rosewood that had come into Canada and been shipped to the warehouse under paperwork listing the California company as the 'ultimate consignee.'

And yes, when the government asked the warehouse company, they produced an email from the California company stating that, for customs purposes, it really wasn't the ultimate consignee, but that Gibson was.

And yes, Gibson has an importer and the government has records showing that Gibson does its own direct importing.

So I assume there was no reason in the world to use all of this subterfuge to get the East Indian Rosewood - incorrect description of contents, listing the ultimate consignee as a company in California but directing shipping to Nashville and/or having that company say it wasn't the ultimate consignee, having shipments come through Canada under the name of another company.

And Henry? I know what an 'ultimate consignee" is. If I'm an import company and I import wood for Gibson, then I'm listed as the importer of record, but Gibson is legally the 'ultimate consignee." I mean, if you want to do it, well, legally.

Henry? I don't trust the Obama DOJ an inch. But it's shame how whatever you say, no matter how incomplete, becomes the gospel truth for conservative bloggers.

If Obama tells us that we should use more transgendered Black union labor, I, for one, wouldn't use that as an argument to justify my purchase of dozens of stuffed bald eagles from a transgendered Black union taxidermist.

Could you please explain that for me? Gibson's name wasn't on any of the export paperwork. Luthier Mercantile's name was.

The customs documents filled out in India (probably not by Luthier Mercantile, because the company, privately owned, only has offices in California, and employs fewer than 20 employees, but possibly by Gibson, because Gibson has an office and employees in India - although Gibson has a firm it uses for its import/export work) incorrectly described the contents of the two containers.

The export paperwork authorized the export of the items described on the paperwork - which wasn't what was in the containers.

The containers entered customs at the Dallas customs port. They were stopped there because there was no Lacy Act paperwork. Gibson's name didn't appear on any of the import documentation. When the containers were opened - the contents didn't match what was on the import documents.

You can read the rest of my post above for how the Dallas shipment eventually led to Gibson.

Did Judge Martin have a prior interest in the case (support a competitor)?

The U.S. Attorney who preceded Martin was Ed Yarbrough. During his tenure the first raid appears to have taken place.

I'm a minor musician and a long-time guitar collector. Henry Juszkiewicz (and his two co-owners) saved Gibson after purchasing it and turned Gibson's quality problems around (let's not get into his management after turning Gibson around).

I am a die-hard Gibson fan. I own Gibson electrics, Gibson acoustics, a Gibson mandolin, and two Gibson banjos. I recommend them.

I happened to know a little about the first raid on Gibson. When Henry's Press Release (and it's Henry's, not Gibson's - nothing leaves Gibson without Henry's blessing) and public statements started to leave out some key facts and make statements that were misleading, I was stunned that everyone (including Fox and Michelle Malkin) accepts them as Gospel.

And, no, I don't work for the government. I actually have to deal with officious government agents in my job.

Given that Henry Juszkiewicz is, and has been, the most aggressive and polarizing figure in the guitar industry for years, isn't it possible that Gibson has been more aggressive than anyone else in pursuing its wood?

This is the same Gibson that sued Activision, GameStop, Amazon, Wal-Mart, Target, Toys "R" Us, and Kmart over "Guitar Hero" because Gibson had once patented headphones and a video game where you could watch a concert and pretend you were playing. Not control the playing like Guitar Hero. Just enjoy the virtual reality. Gibson's suit was thrown out and called frivolous by the judge. Gibson didn't sue over the shape of the Guitar Hero controller. Yes. Gibson's that aggressive.

Do you have a source for this information of yours? I have seen these same accusations you are given in comments sections of articles but none provide a source.

And why is it that no charges have been pressed against Gibson? Though we have two raids, millions of dollars of materials confiscated, employees interrogated and harassed, private company documentation confiscated as well but no charges.

If this is to be the government operates whereas they just continue to harass and apply pressure to employees and confiscate records and materials to scour over eventually they will create some sort of case against Gibson but that could probably be done against any company if there was a non-stop witch hunt to find a way to charge them with something. Possibly a employee will even help them fabricate something due to the harassment.

But it would be helpful if you could provide a source for these accusations you are making against Gibson.

I'm not. I own Gibson products and will buy more. I'm troubled that nobody seems to care about any facts. They simply believe as The Gospel anything that Gibson says.

I will say, this wouldn't have been the case three years ago. Obama and his DOJ have acted so outrageously that Gibson's claims are now believable. Not as believable if you care to learn the underlying facts, but believable at face value.

Is it a hazard to the health and safety. No
Were people harmed in the exporting country manufacturing this item? Can it be proved with something other than junk science that they were harmed? No

When Henry's Press Release (and it's Henry's, not Gibson's - nothing leaves Gibson without Henry's blessing) and public statements started to leave out some key facts and make statements that were misleading, I was stunned that everyone (including Fox and Michelle Malkin) accepts them as Gospel.

What are some of these key facts and details?

Could you give us a source for these accusations referring to import papers you are talking about? I have not seen any evidence of this in even left-wing media sources.

The CEO of Gibson has said (in his YouTube clip) that they have sworn affidavits from numerous members of India’s parliament stating that Obama’s administration is misinterpreting India’s law and that Gibson acted legally.
