Does Obama's jobs bill actually defy the Constitution?

As discussed yesterday at The US Report, President Obama is peddling a jobs bill that contains elements that may actually be unconstitutional. But there appears to be more to the story.

The American Jobs Act states on page 133 (Section 176) that “A State's receipt or use of Federal financial assistance for any program or activity of a State shall constitute a waiver of sovereign immunity, under the 11th Amendment to the Constitution...”

This strips state sovereignty and increases dependence upon the Federal government. And if it were to pass, this legislation would open the door for trial lawyers to sue the states in Federal court. Just follow the money.

Here's what the Eleventh Amendment says:

The Judicial power of the United States shall not be construed to extend to any suit in law or equity, commenced or prosecuted against one of the United States by Citizens of another State, or by Citizens or Subjects of any Foreign State.
Basically, this amendment prevents the Federal government from hearing cases brought against a state by a citizen of another state or country. But Congress – and the states themselves if they so choose – can abrogate this Eleventh Amendment protection according to the Heritage Guide to the Constitution (pg. 376):
Congress can, for example, require the states to waive their immunities as a condition for receipt of federal grants under the Spending Clause (Article I, Section 8, Clause 1).
Why would the Federal government need to suspend the Constitution in order to save jobs? And when did the United States become so dependent on the government for jobs in the first place?

There are certainly a lot of missing records. I think they are not released because (one) they will expose Obama’s socialist past and positions and (two) keeping them hidden allows his opponents - such as those seeking definitive proof of his citizenship - to be marginalized.

Obama has a crack team of lawyers to consider the Constitution and the law for him. They just have to find clever ways to get around it, such as defying the War Powers Act in Libya and scores of other examples.

The Federal government wouldn't. But Zero and his fellow jackbooted fascists need to suspend the Constitution so that they can continue to force everyone out of their jobs.

I know they said this comes from Heritage, but how is it affected by Article IV Section 4:

Section 4 - Republican government

The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.

This administration is forcing states to give up their Republican form of government, and is organizing internal riots and mobs to attack the states.

Just happened to see Cain being interviewed by Larry O’Donnell tonight when I was flipping channels. Cain did really well. O'Donnell tried so hard to make him look bad. Cain made O'Donnell look like a fool. When will people stop judging blacks by what they did 50 years ago??

You are correct. The only people that the constitution does not apply to are non-citizens and the military.

So lets say even though I am self employed, I one day decide to give up what I do for say, a week, and try and get a job as a High Up Gov’t Bureaucrat, but then the gov’t doesn’t hire me on (of course), can I sue the gov’t and collect because I wasn’t hired? After all I have been unemployed since 1993! (The Clinton Years!)

This bill has one and only one intention- To cause maximum CHAOS, as in all of Buckwheat’s decisions. And it’s so dead that they can’t find a dim to sponsor it. Mitch McConnell has tried to introduce it and Dingy is blocking it.

I saw the same interview, and I loved the part where Larry-O tried to misquote Cain and then “move on” to the next topic. Cain exploded, and forced Larry-O to listen to Cain’s correction. Cain reminded me a lot of Rumsfeld’s press conferences when he would do similar corrections to our sorry, liberal, hostile media. Or is it our hostile, liberal, sorry media?

As far as people judging others, I am reminded of two Quaker Brothers talking about the condition of the world.
