CBS: Herman Cain waived confidentiality: accuser's lawyer

But Joel Bennett, the lawyer for one of the accusers, who is a married federal employee who lives in Maryland, told CBS News today that his client is telling the truth.

"I wouldn't characterize it as an ax to grind," Bennett said. "I'm sure she feels as though she wasn't treated properly by Herman Cain."

But Bennett said said he does not remember the specific allegations, or what kind of settlement they eventually reached.

"I reference this lady's height," Cain said. "And I was standing near her and I did this, saying 'you're the same height as my wife.'"

Bennett said Cain was talking about the case of another woman, not his client. But Bennett said now that Cain is talking about specifics, the confidentiality agreements may no longer be binding.

"I think the National Restaurant Associaion ought to waive the confidentiality and non-disparagement provisions and let the two women, if they choose to do so, come forward and tell their stories so that it can get a complete public airing," Bennett said.

If I were Cain, I would go ahead and release all of the case info myself. Probably nothing to find, like that data dump that Palin did.

I have signed many of these types of documents when contracting with someone to design something they want to retain the rights to. Each is different in many way but where they are all alike is the penalties for divulging the details of the item.

I have no restrictions on speaking in generalities and in a case as Cain’s the confidentiality is typically directed to the specifics of the settlement, names of the parties involved and any other details that attorneys can agree to and submit to their clients.

This douche-bag attorney saying that the chin height comment was not a part of his clients complaint and then say because Cain mentioned it was cause that Cain broke the NDA is beyond stupid.

The media will make sure this is an absolutely devastating scandal and make sure that all Cain will be able to talk about for the next few months will be in defense of his horribly disgusting actions ..... In the mean time Romney and Perry will sit back eat popcorn and watch the fireworks.

After the dust settles then it will be the next front runners turn to defend against the scandals coming their way.

It's too bad most Americans that rely on the network news for information are overly dazzled by all of the smoke and mirrors provided by the MSM that diverts attention away from the true issues facing this country!

If the condidentiality agreement covered specifics of the complaint rather than just circumstances of the settlement, it seems possible to argue this attorney violated confidentiality by linking Cain's behavior to the other complaining lady.

The lawyer making comments does not have the agreement in hand and has no idea what it says. He does remember the details. Huh? The lawyers says “now that Cain is talking about specifics, the confidentiality agreements may no longer be binding”. He says this without knowing anything. Apparently without knowing if Cain is even referring to his client? Former client?

This is either a very stupid lawyer or what we are watching is very bad theater....

I am certain that Larry Sinclair believed that he didn’t get fair treatment from Obama either after snorting cocaine and giving him head in the back of a limo in Chicago, poor Larry only wanted a couple of bucks to shut him up too bad Barry didn’t comply....

The strange part is the media did comply and effectively shut down Mr. Sinclair

She signed the agreement, got the money - that’s the deal!

I would bet the woman has been offered Millions from the National Enquirer. She can embellish the entire story and not be touched, but destroy the campaign of Herman Cain.

Herman Cain should come up in a very open and public forum and state ... “Nearly everyone in high political office has these types of allegations thrown at them from time to time, and the accusers are usually after a little fame and money, President Obama for example, is alleged to have done cocaine with and had homosexual relations with a man by the name of Larry Sinclair in Chicago back in 1999. Now of course I don’t think it’s true, but Mr. Sinclair certainly seems to believe it, he even wrote a book about it, so I wonder why the media is bothering me with these type of distractions but failed to bother President Obama with the same type of allegations when he was running his campaign? I know it must be because the left and the media are afraid to talk about real change, real bold solutions for the current out of control government takeover in this country, they are afraid of Herman Cain and the 999 plan.”
