Yes, they should fire the stupid person that came up with the idea of buying stickers for every employee for each day that was accident free. The very idea that wearing a numbered sticker stopped accidents is just "unfathomable stupidity".
Private companies have won court cases over bigger issues than this when it comes to what people can claim as discrimination. But if he can find a lawyer stupid enough to take the case on a contingency let him have at it.
