It was NEWT talking about the pipeline and calling that decision “stunningly stupid” and 0 being beholden to the environmentalists that finally moved this guy to the other side.

Caller of the Year on Rush right now! Black truck-driver, Obama supporter, says “I’m done with these people, and thanks to you Rush”. The last straw was killing the pipeline which the caller beautifully described is anti-American, and will result in higher costs for ever family.

One for the record books today.

Privacy is much different than unreasonable search and seizures. If a private citizen is not allowed to grope me when I am in public, then the government should be held to the same standards. If it is acceptable for a government goon to grope whomever they deem worthy of the groping, then I should be free to grope whomever I deem worthy of groping.

Privacy in your context is more related to evesdropping than it is to the actions of the TSA.

“The Fourth Amendment has been repeatedly found to not apply when you’re travelling.”

What other enumerated rights do we lose when traveling? Do journalists lose their “free press” when they travel? Can I be tried repeatedly for the same crime if I am traveling? Do I lose the right to a trial by jury if I am traveling? If I am able to lose one of the enumerated rights while traveling, then we are able to lose them all. Is a free people a people that only retains rights when they are not traveling or can a free people freely travel?

Be very careful of the “living document” trap. They love to snare even conservative folks in those traps.

Much of current jurisprudence is wrong and we all know that from FR. One blatent example is the twisting of the constitution to give us “right to medical privacy between a doctor and patient” which was then further twisted to set up government sanctioned murder.

We have Kelo over riding private property. We have the interstate commerce clause being used for anything and everything. Now we have the confiscation of our physical beings being decided in court and their decision will be a matter of jurisprudence.

That does not make it constitutional. Period.

“It’s faulty logic to ASSUME we know how anyone would react in any situation, and to say historical figure x, y, z would react this way or that in a given situation with today’s parameters is such a nonsensical debate to have..”

Which is why they gave us such a beautiful governing document. They knew we would have to constantly battle despots, and they were hopeful that those giving their consent to be governed would maintain individual liberty with a vengence. Sadly, in that our public has failed them for 80-90 years....

Again, I point to the current jurisprudence on the matter. There is a lessened standard to search someone when they are travelling (which relates back to the privacy interest, as I've repeatedly gone over). For example, pretextual stops are 100% okay and give officers the probable cause necessary to stop you and visually search your vehicle in which you're traveling.

If you read carefully my comments, I did not say this was or was not within the bounds of the original intent of the Constitution; arguments can and have been made on either side. Regardless of your opinion or mine, the controlling law NOW says that your Fourth Amendment rights are not applicable when you travel because you voluntarily put yourself out there. That's not just wiretapping, it's Supreme Court decisions relating directly to searching cars, trunks, passengers, “smelling” marijuana; pretextual stops; even with respect to renting homes, visiting other’s homes, and so on.

On a personal matter, and for the record; these are NOT decisions I've made or argued in favor of; they are the controlling case law as decided by the Supreme Court of the United States. You can argue that they aren't the arbiter of what is and isn't constitutional and I understand that argument; but Marbury vs. Madison has controlled since it was decided. I personally think that decision was an over extension of the judicial branch, HOWEVER, as it has stood for over 200 years, it's the accepted law of the land.

And back to the specific incident at hand; if Rand Paul's argument is the TSA is unconstitutional, then why hasn't he introduced a bill eradicating it? Why is his defense that the “TSA is more concerned with people who don't want to harm us...” rather than the TSA is completely unconstitutional.

Again, my response was directly to a comment that stated historical figures would do x, y, or z.

Whether we like the decisions that are made or not (and it started way before Filburn, it started with Marbury), the Supreme Court unfortunately decides and dictates what is and isn’t constitutional (or at least until Marbury is overturned). That is why it is so important to look at who potential judicial nominees will be and why it’s imperative that we ensure that there are as few Kagans and Ginsbergs, Stevens, and Brennans who serve on the Court as possible.

Until the controlling decisions are overturned, however, they still are considered controlling law, regardless of what you or I think about the Constitution, or regardless of what you and I think Madison, Revere, Adams, Washington, Patrick Henry, etc. would do.

I agree with you on this.

I do admit that I was taking the abstract approach and from the rest of your text it seems that we most likely are in agreement that the government has been on a continual creep to infringe upon our enumerated rights. I had that feeling as I started to respond to you, but could not hold back as a cople of the phrases hit my own hot buttons.

What really angers me is that the populace just doesn’t seem to care, however SC has given me a bit of hope.

I’m frustrated that the Candy-Newt interview is not yet on video at least anywhere I can find it, but delighted to hear that Candy got the smack. She is typically such an obvious faux “concern troll” in her style that my head frequently comes off.

Forgive if I was harsh....I am one of those who still stands (even if in my home) when the Anthem is played,,,,and more often than not, I get a tear in my eye as it is being sung/played...I just prefer the tears are from my love of country, and not from the pain from the vocals ;-)
