Your point does not matter.
Rubio was born on US soil.
Rubio was a CITIZEN AT BIRTH, and that is all that matters.

“Natural Born Citizen” means “Citizen at Birth”

Court cases prior to the 14th Amendment, and Court cases before the various, changing legislation on Citizenship, do NOT control in this matter. Those decisions are moot, as they were made with no Constitutional or Legislative guidance, as their was none.

Now there is guidance.

Look at a passport application, that is all you need to know about citizenship.

Why, he’s a big Romney lover. That disqualifies him. Glad we found out just in time what he’s made of.

Rubio is definitely off the list for supporting Romney. People say that he just owes Romney favors, but it tells me that Rubio was bought off.

Natural Born Citizen, today, means CITIZEN AT BIRTH

The Framers just wanted to prohibit NATURALIZED citizens from being POTUS. While the language they used was interpreted without Congressional guidance, at the time, NOW THEIR IS CONTROLLING CITIZENSHIP LAW and the Courts do not have to look at Common Law or Natural Law.

Like Obama, Rubio is not eligible under Article 2 US Constitution. Rubio is not an NBC. Obama is not an NBC.

I remain optimistic sooner or later the rule of law will prevail. If it doesn’t, then we all may as well become violators of the law. Since the rule of law is/will have become meaningless.

You like Romney too? Because Rubio does. He says Romney is a conservative. He believes Romney will be the nominee. He has always had a heart for Romney. Plus the fact that he is not a natural born citizen means he is not qualified for anything higher than what he has already attained. RINO Rubio can stay right where he is.

Hey, what a great idea for a ticket I would never vote for, ever, since the author implies that Romney will our the GOP nominee. The saints, apostles, martyrs, and a choir of angels could could appear on my front lawn in a cloud of glory to call on me personally to vote for Romney and I would tell them all to go straight to hell right before I turned on the sprinklers.

I will never vote for Romney.

My Senator, Jerry Moran, has made the case, along with others, that, for instance, illegal alien couples who have a child in the United States can not DIVORCE in the United States, can they?
So what of their children, who are obviously NOT “-— subject to the jurisdiction thereof-—”

I think that Congress can define this issue, without any Constituional Amendments.

We can stop the Anchor Baby problem with simple legislation.

Born in Miami, FLORIDA in 1971. His parents were Cuban citizens who became U.S. citizens in 1975. Babies born in the U.S. hold citizenship here even if their parents are not citizens.

Sorry. His parents had to be citizens at the time of his birth for him to be an NBC. They were four years too late. Close but no cigar. He is a native-born citizen, not natural-born. The two are, Constitutionally, NOT the same.

I understand your passion but you allowing your emotions to cloud reason. You may want to revisit your definition of native vs. natural born citizen after the judge rules on the Georgia ballot challenge this week. Here is a reference to the court cases they used as a basis for filing the complaint. Obama is not a natural-born citizen, never has been and neither is Rubio, based on the citizenship status of their fathers at the time of their birth.

You have no idea what “subject to the jurisdiction thereof “ means do you and that is a wholly different argument from the NBC clause of the Constitution.

Some of you anti-sovereignty people actually believe that the 14th amendment gives citizenship to the anchor babies. Whether it does or does not, the 14th amendment only deals with citizenship. Citizenship would only qualify the anchor babies for president if they were alive at the adoption of the Constitution. Since they were not, these mere citizens cannot become president. Only natural born citizens can run for office of president now.

Anchor babies are not now, never have been and never will be NBC. They cannot rightfully run for the presidency without the Constitution being amended. They are the very reason the founders stated what they did about who could become president in Article 2 section 1 clause 5 of the Constitution.

No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.

Plain as day. One - a natural born citizen or two - a US citizen at the time of the adoption of our Constitution are the only ones eligible to run for the office of President.

Natural born citizen means citizen born of two parents who were citizens at the time of birth. This parents were not citizens of the US when he was born. PERIOD

In the oral argument of Nguyen one of the Justices joked about the literal meaning of that clause as written

“No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President;”

As Written it means that no one can run for President unless they were a natural born Citizen OR a citizen of the United states ...either qualifier.... AT THE TIME OF THE ADOPTION . After those people were dead , no one could be President.

Yes, that is what it says.
So if that wasn’t their intent what did they really mean.

Natural born citizen OR citizen of the US at time of Adoption. Years down the road they knew the second wouldn’t be needed. It was only needed in the beginning.

So if you don’t take it as written - what could they have meant....

So where is it today.

Today, you have Kim Wong Ark that very likely will not be overturned and a Court of Appeals case that says Kim Wong Ark indicates Obama can run for President.

It is possible that Kim Wong Ark could be overturned. You never know. But to say that it is clear that Obama can’t run for President is just plain wrong.

Justice Fuller, in the dissent of Wong Kim Ark, didn’t agree that Ark should be able to run for President. He knew the majority opinion would allow it and felt that it set the wrong precedent.

I happen to agree.

But it is what it is....
