Obama Got Served
American Thinker ^ | February 1, 2012 | Cindy Simpson

[snip]...Jablonski remained true to his word -- neither he nor Obama showed up for the January 26 hearing. I noted last week that Obama was not scheduled to be anywhere near Atlanta on the date of the hearing, although I had wondered if still, perhaps, Georgia might be on his mind. According to reports in the blogosphere, the president's schedule on the morning of the 26th was open, and according to an unnamed source, Obama watched the live feed of the hearings.

Perhaps Obama, as well as the several mainstream media news outlets I spotted at the hearing, were merely watching in hopes that the "crazy birthers" would really do something...well, crazy. Or unlawful. In fact, though, it was the president himself and his defense team who were the ones defying the rule of law.

The mainstream media, in lockstep with Obama, reported nothing of the events, in a stunning blackout on a truly historic hearing -- one that discussed the eligibility of a sitting president to run for a second term. And more troubling was the fact that the media failed to acknowledge the even more sensational news -- that the president and his defense attorney snubbed an official subpoena.

Today, Attorney Van Irion, on behalf of his client, Georgia resident David Welden, filed a "Motion for Finding of Contempt" with Judge Malihi...

Dear Leader’s father was never a US citizen and was over 21 when zero was born. His mother was 17, not 21 so he does not seem to have a path to citizenship, even if born in Hawaii. There has been no credible evidence that he was born in Hawaii and no laws to say that babies born in the US to foreign parents are US citizens, otherwise known as anchor babies. This is just case law not backed up by congressional law. Most lawyers I have known were more dishonest, manipulative and destructionist in their beliefs as any group of people I have ever known, so congrats.

“For the purposes of this case it is not necessary to solve these doubts.”

That is, for the purposes of the case of Minor, a female seeking the privilege to vote.

Now is the time to settle the case for the purposes of Obama, the son of a British subject seeking the privilege to be president of the United States.

Marco Rubio

born May 28, 1971 in Miami, FL (Meets the Jus Soli Requirement)

Parents were
Mario Rubio born in Cuba, naturalized Nov. 5, 1975.
Oria Garcia born in Cuba, naturalized Nov. 5, 1975.

Parents were NOT US Citizens at the time of his birth (Does NOT meet the Jus Sanguinis Requirement)

Marco Rubio is NOT a NATURAL BORN CITIZEN.

Marco's status is the same as that of Barry Soetoro, aka Barack Hussein Obama, who is NOT a Natural Born Citizen.

“Incidentally, since my mother was born in Canada, I am not a natural born citizen either.”

Just to clarify for those reading your post. I don’t know what your NBC status is, but your mother being born in Canada does not necessarily make you ineligible.

***It was her U.S. citizenship status at the time of your birth***,

not her place of birth. Very different.

I’m sure that’s what you meant.

“Natural Born Citizen means Citizen at the moment of Birth, and NOTHING ELSE.”

The founders were pretty smart and thoroughly analyzed every word and concept in the draft Constitution, so if you are correct they would have merely required one to be a citizen, not a natural born citizen. Moreover, they were legitimately concerned about potentially divided loyalties of the commander in chief. You are wrong!

Legislation has been passed, since that time, which now controls.
Then simply state what the "legislation" that was passed is so that others can check the veracity of your statement for themselves.

All natural born citizens are citizens, but the reverse is not true. Not all citizens are Natural Born Citizens.
Good to see somebody got to it before I did. I should have read down instead of up after my reply.
Nothing more than a "gotcha" statement.

I have been asked a few times now, about that case. I hesitate to post much info on this thread, as some in the “birther” camp are a bit rude, sarcastic, and prone to hate anyone who disagrees with them on tactics, law or history.

I will try to post more info on my FR bio when I get a chance.

Rubio needs to be selected for the VP slot.

That will bring the issue to the forefront, and people will finally see the hypocrisy in Obama's claim to Natural Born Citizen status. When Obama drops out of the race, the Republican nominee can then choose another running mate.

First it was legislation. Now it's rules. Which is it?

There is plenty on this very thread to show the weakness of your argument.

Natural Born Citizen means CITIZEN AT BIRTH!

The Courts, at one time, held that you must have parents who are citizens, at the time of your birth, for this to be true. The Courts so held because there was no Act of Congress at that time to define Citizenship.

Now there is.

Your “case law” is, therefore, worthless. Legislation trumps Common Law. Legislation trumps Case Law based on Common Law.

At the risk of sounding paranoid, I hope you’re not referring to my post #72:

“Since I am not a lawyer, as you appear to be, please enlighten me. Thank you.”

“Appear” and “accuse” are not interchangeable in the English language and by the rules of Logic. (If you catch my drift)

“Nonsense. Your parents’ birth doesn’t matter. It’s YOU who matters.”

No offense, but this issue requires a lot of study. It is amazing how sure people are about citizenship issues, when in fact, they know almost nothing about it. What they think they know, and are so positive of, is just plain wrong!

Your father, born of U.S. citizen parents, would be a “citizen by birth” regardless of where he was born. He would not need to be naturalized. He couldn't be president, but I'm guessing he never wanted to. YOU, on the other hand would have no issue for NBC, at least on your fathers side, because he always was a citizen from birth.

Only as to eligibility for president & vice president does being a Natural Born Citizen matter. It doesn't make you a better person, or a better citizen.

Wrong.
The Founders wanted to deny NATURALIZED Citizens the ability to become President.
That is the purpose of “Natural Born” -— to distinguish between NATURALIZED.

“BS
Rubio is qualified”

Rubio might be qualified, but he is “ineligible”

Article XII

“.......But no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States.”

Article II, Section 1, Clause 5.

“No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States. “

It’s called capias, which is a name for a number of writs that command a sheriff or other officer to arrest a person and bring them before the court. They cannot be executed outside the jurisdiction on the issuing court.

There are state statutes that require courts to issue capias, warrants, or other writs on out-of-state actions in certain circumstances, such as child support situations. These statutes are in derogation of the common law rule that no capias would issue on a foreign cause of action.

I’m not sure what Delaware was doing, but I rather doubt a sheriff in Maryland would feel compelled to obey the writs of a Delaware court. There must be some compact or other arrangement where the local court issued capias on request of the Delaware authorities.

WRONG! The person whose father was born in Canada to two U.S. citizens, is a “citizen at birth”. FACT

Are you saying he would be eligible to be president of the United States (a Natural Born Citizen) having been born in a foreign country?

That IS what you are saying and it is RIDICULOUS!

So if Ahmadinejad's wife flew to the US and had a child here, said child would be a Natural Born Citizen? I don't think so. It was the obvious intent of the founders to have a Presidential candidate be free of foreign entanglements. It's about allegience.

Two citizen parents, born on US soil = Natural Born Citizen. That's logical.
