Drudge has a link up to the latest LA Times story. Anthony Kennedy is grilling the Solicitor General with questions which sound like they came straight from Limbaugh.

If SCOTUS upholds this law, it will be another Dred Scott case.

There is a solid plurality in the country who are simply not going to put up with this BS any longer.

The libs on the court will not dump it, and the “moderate” on the court might not. pretty slim hope of dumping it.

I think the new law of the land will be that the government can force you to sign a contract. Currently that’s illegal and unconstitutional, but if this restriction impedes interstate commerce and damages the health of children, or is concordant with International Law, they may go for vetting it.

The current system will bankrupt the nation, The HCRA will bankrupt the nation. The only solution would be to abolish all insurance and go to a cash only reimbursement system. Only then will market forces be brought to bear on the health-care industry and health-care consumers alike. Mean spirited it would be, but this would embrace the conservative principles of free markets and self reliance.

If SCOTUS voids ObamaCare:
1. Newsmedia orgy of medical sob stories.
2. The dynamic of the election changes. Leftists use free healthcare to buy votes from the dependency set, and demonize the right for denying the People their right to services paid for by someone else (See #1). The Repub’s will lose an issue that motivates their voters, and will be too timid to frame the issue to advantage. This could effect turnout significantly.
3. If Repub’s were smart (we’re in “optimism mode” here), they would assemble a simple, easily-presented set of reforms that addresses real healthcare problems without destroying personal freedom (e.g., rampant Medicare & Medicaid fraud; runaway costs of malpractice insurance and defensive medicine; insurance exclusions for pre-existing conditions; portability/de-coupling insurance from employment; MSA’s and coops; etc.). They basically had this during the ObamaCare but the Dem’s blocked even holding hearings about it. This would show willingness to address the problem, and demonstrate that the gigantic, hyper-intrusive ObamaCare concept was actually about power.

If SCOTUS finds any part of the law unconstitutional, it will describe, within its opinion, the sorts of statutory language that would cure the infirmity.

Then it tosses the issue back to Congress. At some point, Congress will pass a federal health care package, be it single payer, or some other form.

It is constitutional to have a mandatory federal retirement plan (FICA).

The only constitutional issue with federalizing health care is finding the correct form. There are NO substantive barriers to federal power. All the barriers lie in formalities.

Did I miss something here ,,,, there were NO DEBATES ,,, the republicans were not even allowed to participate in any debates . This bill was passed through a process called reconcilliation wasn’t it ???

Back then the chambers of both houses had dem majorities so the Repubs. were dissed .

The SCOTUS is just deciding the mandate part of Obamacare. If that is struck down it would in essence gut Obamacare, but not necessarily repeal it in total. Consider a turn down by the SCOTUS to be a hard stunning blow, but not necessarily a kill shot.

We go back to having the best medical care in the world. The free market allows new lifesaving treatments to evolve making it even better.
The obamacrap health care takes medical care backwards into the same kind of dysfunctional medical care swamp that England has. It would work great unless you are old, disabled, sick or badly injured. If any of these things happened in your life your case would have to wait in line to see if there were more funds available for treatment.

You are probably correct. I know there is a nonseverability argument, but if just the mandate is struck down and the rest of the bill stands, that will also be a disaster. The rest of the bill will completely destroy the insurance business through a combination of bankruptcy and soaring premiums and then Obama will say that only the government can save us from total chaos, bodies in the streets, etc. We need a complete repeal, somehow.

I saw a chart plotting the cost of health care for the general population, against medicare and Medicaid reimbursement rates.

Not surprisingly, as medicare and medicaid reimbursement got lower and lower, the cost to everyone else went up. Wish I had that chart now...

Anyway, the point was that as Government messed with their own programs, the civilian world costs soared, so naturally Government came in to fix the “crisis”.
